    TAPA is an very elaborate scam, they need to be stopped, does anyone know where they are based  or can anybody please let us know who is behind them, I paid them on card and they have took the payment four times in the past year, Thankfully my bank has retrieved the money back, do not give them your card details. Avoid at all Costs.

    Hi All
    I received a pack from The Advertising Protection Agency yesterday with a invoice for £69.85. I don't know anything about this company, except I must have looked at their website a couple of weeks ago when I was on this site for another scam company (Satlite Limited). Yesterday was 3rd October, but the date on the letter was 21st September (magical 7 days cooling off period just expired). Got a call today from a Chris Irvine from their "accounts department" implying I, or someone in my household, completed a registration form on-line. When I said this had not happened,  he said I had not to worry, but then explained that the process would be that I would receive a court summons (but i hadn't to worry if I was not responsible - they would be able to trace the address on the "application form" they had received). However he had to warn me that I would receive several phone calls beforehand. When I asked him who would be phoning me he replied that he would(?) I asked him why this was necessary, as I had already told him how I viewed the situation and he told me they had to prove to the court that they had taken reasonable steps to recover the debt! So far, I have one call - the phone rang once then stopped. It was Chris Irvine's mobile phone number. (Forgot to mention - he calls you from an 07808 number, but youu have to contact him on 08443573311) Are you confused yet, because I certainly am. I contacted Action Fraud twice today - the first person told me this was a legit. company, the second told me to ignore everything as it was probably a scam. one thing I do know, is that no company, however legit. can insist that I give my card details over the phone or even in writing. (Their invoice included a payment form whic required me to fill in all my details, including card details - they don't accept any other form of payment). Thought I was getting somewhere with the other number (08442490999) and now this happens. Any support woould be appreciated.

    go back through the last posts and you will get the answers. they are a scam and there is no way that they would dare appear in any court of law. report them to your local trading standards and through consumer direct. Don't give them any money and in the end they will go away.

    8.—(1) Subject to regulation 9, the supplier shall provide to the consumer in writing, or in another durable medium which is available and accessible to the consumer, the information referred to in paragraph (2), either—

    (a)prior to the conclusion of the contract, or

    (b)thereafter, in good time and in any event—

    (i)during the performance of the contract, in the case of services; and

    (ii)at the latest at the time of delivery where goods not for delivery to third parties are concerned.

    (2) The information required to be provided by paragraph (1) is—

    (a)the information set out in paragraphs (i) to (vi) of Regulation 7(1)(a);

    (b)information about the conditions and procedures for exercising the right to cancel under regulation 10, including—

    (i)where a term of the contract requires (or the supplier intends that it will require) that the consumer shall return the goods to the supplier in the event of cancellation, notification of that requirement; and

    (ii)information as to whether the consumer or the supplier would be responsible under these Regulations for the cost of returning any goods to the supplier, or the cost of his recovering them, if the consumer cancels the contract under regulation 10;

    (c)the geographical address of the place of business of the supplier to which the consumer may address any complaints;

    (d)information about any after-sales services and guarantees; and

    (e)the conditions for exercising any contractual right to cancel the contract, where the contract is of an unspecified duration or a duration exceeding one year.

    Cancellation period in the case of contracts for the supply of services

    12.—(1) For the purposes of regulation 10, the cancellation period in the case of contracts for the supply of services begins with the day on which the contract is concluded and ends as provided in paragraphs (2) to (4).

    (2) Where the supplier complies with regulation 8 on or before the day on which the contract is concluded, the cancellation period ends on the expiry of the period of seven working days beginning with the day after the day on which the contract is concluded.

    (3) Where a supplier who has not complied with regulation 8 on or before the day on which the contract is concluded provides to the consumer the information referred to in regulation 8(2) and (3), and does so in writing or in another durable medium available and accessible to the consumer, within the period of three months beginning with the day after the day on which the contract is concluded, the cancellation period ends on the expiry of the period of seven working days beginning with the day after the day on which the consumer receives the information.

    (4) Where neither paragraph (2) nor (3) applies, the cancellation period ends on the expiry of the period of three months and seven working days beginning with the day after the day on which the contract is concluded.

    and by the following methods

    (3) For the purposes of these Regulations, a notice of cancellation is a notice in writing or in another durable medium available and accessible to the supplier (or to the other person to whom it is given) which, however expressed, indicates the intention of the consumer to cancel the contract.

    (4) A notice of cancellation given under this regulation by a consumer to a supplier or other person is to be treated as having been properly given if the consumer—

    (a)leaves it at the address last known to the consumer and addressed to the supplier or other person by name (in which case it is to be taken to have been given on the day on which it was left);

    (b)sends it by post to the address last known to the consumer and addressed to the supplier or other person by name (in which case, it is to be taken to have been given on the day on which it was posted);

    (c)sends it by facsimile to the business facsimile number last known to the consumer (in which case it is to be taken to have been given on the day on which it is sent); or

    (d)sends it by electronic mail, to the business electronic mail address last known to the consumer (in which case it is to be taken to have been given on the day on which it is sent).

    Thanks moet - are you Avalo by any chance? Do I send them an email cancelling a contract I never entered into quoting the consumer distance selling regs...or do I ignore them and their phone calls?
    And when is the next scam going to hit me cos I sure am feeling victimised at the minute! (Check out 08442490999)

    trading standards told me just to ignore them and if they phone tell them you have reported them to trading standards etc and hang up. Unfortunately I paid them the the £39 they demanded as i was so rattled by their aggressiveness when I first phoned. I have now sent emails, fax's and registered letters cancelling as consumer direct told me to do but have had no reply. haven't cancelled this payment with them yet as I have disabled wife etc and don't want more hassle. Anyway as i said Trading standards and consumer direct told me to ignore them. was reading your other thread AMAZING

    Interesting as I received a phone call from a John Medhurst saying he was head of TAPA after I sen't them a list of errors on their website and when I mentioned that I was cancelling under the Consumer Protection (Distance Selling) Regulations 2000 he said they didn't have to abide by them and it clearly says that they do in their cancellation of service section!!

    So in reality this little section really catches them out as they are not complying with the regulations they themselves say they are regulated by
    1. you have to give 7 working days not 7 days
    2. you have the right to cancel by mail, email, fax or in person not only by registered mail
    3. cancellation is deemed to have been made from the moment you send it not 2 days after they receive it as they state in section 30 of their so called terms of service which you only receive 10 days after visiting their website!!
    etc etc etc
    I get more and more angry with this lot

    I've written to The Advertising Protection Agency using your very helpful comments and quoting Consumer Protection (Distance Selling) regulations 2000. Told them that as they were so sure I had a contract, I was now giving notice to cancel, as per the regs, within 7 working days after the day I received the pack containing terms and conditions. Checked it out with Consumer Direct, who approved it, said I was within my rights so I've now sent it off, recorded to "the address last known to the consumer" If this is just a mailing address and they don't get it for another week, tough s**t! It is valid from the day of posting! Phew!!! Doctor gave me some antidepressants this morning. Hope they help me sleep better. Thanks for all the supprt and advice folks. Feel I'm now back on track and ready to fight with you all again - er, not WITH you exactly, but alongside you!!
