Speak soon!) - katejo| 1 replyI have been in touch with Waltham Forest Trading standards (London E17) today after a bad experience and threats of court action from TAPA last week. My local branch contacted Camden branch because of the postal address given on the website of TAPA. They have now contacted a branch of TS in Cheshire and are waiting for the result of an investigation from that branch.

Different rules apply to services where the consumer agrees that the service starts before the usual cancellation period expires. These are:
• where you have supplied the required durable information before the service starts and the consumer agrees to the service starting before the end of the usual cancellation period, their cancellation rights will end when performance of the service starts
• if the consumer agrees that the service can start before the usual cancellation period ends, but you do not provide the required written information until after the service has started but in time for it still to be useful, cancellation rights will last for seven working days after the day the consumer receives the information. But if you finish providing the service within seven working days after the day the consumer receives the required durable information, cancellation rights will end on the day of completion, or
• if you do not provide the required durable information at all, your consumer’s right to cancel ends after three months and seven working days counting from the day after the day on which the contract was concluded. This applies whether or not the consumer agrees that you can start the service before the cancellation period ends.
from here it is clear that as they don't provide the info required at the time of going through the sign up procedure online and only when you receive the pack you definitely have 7 working days after you receive that pack to cancel

Durable medium is not defined in the DSRs. Our view is that it means a form in which information can be retained and reproduced but cannot be edited, such as an email that can be printed or a letter, fax or brochure that can be kept for future reference. We do not consider that information on a website is durable as it can be changed at any time after the consumer has accessed it. Technological advances may change what we regard as durable in the future.

- LizzieMI've had a message left on my voicemail (land line and mobile) from the nice Chris Irvine asking me to ring him back about my overdue account!! Think I'll ring consumer direct and ask if there's any update on TAPA. By the way, has anybody noticed the ad at the end of all our posts for "Lending Stream" They're quoting 3043.8% APR!!! They're connected with the debt collecting agency that's linked to Satlite Limited.......and that's another story! (Try entering 08442490999)
- LizzieMFollowing my last post (HAH!! The Last Post??) Consumer Direct suggested that I did return his call, as he just might be acknowledging my letter and confirming that there was, in fact no debt. So I did. To be brief, no, he hasn't had sight of the letter (which he wouldn't have, would he, seeing the address has nothing to do with TAPA), but it didn't make any difference, cos I didn't cancel within 7 days. I mentioned the Distance Selling Regulations and he said I was wrong. I told him to take it up with whoever agreed the regulations and hung up while he was still blathering on. I shall ring Consumer Direct again tomorrow and tell them about the call, but under no circumstances will I speak to Mr Irvine again. (NB I've dropped the 'nice' Mr Irvine).

Does Mr Medhurst/Irvine/Marsden/McGuire seriously think that you are going to pay up when you know it's a scam?!!! Pestering you will only make you more determined that he's investigated and stopped. I suppose these idiots don't think like honest, decent, moral human beings.
I can't believe this is still going on for you all when some of you are being told by Trading Standards that they know it's a scam - why on earth is the website still up?? - LizzieM| 2 repliesBeen thinking people. Look at the adverts on this site - one of them is TAPA, another is a loan company that I know has connections with a debt collection agency operating illegally, to mention two. Is it possible that people like this have set up this site so that victims of scams see the ads, click on them and before they know where they are, are getting demands for even more money? Makes you think doesn't it?

- KatyThis site does seem to be a separate entity originating in America - have a look at the whois site for domain owner details (you probably already have!), and any reviews I have ever found do seem to trust it, BUT the advertising is, to say the least, inappropriate and a joke, it's just as well we all have a sense of humour and irony.
Mr Marsden and his crew seem to inhabit Manchester, he owns the TAPA domain and seemingly has an accountancy firm (good grief) - god help your business if you used them! - KatyJames that's fantastic news if that's actually happening - and if they don't set up again!

I very much doubt anyone will get any money back but at least you can try!
There is an MSE thread on the go at the moment but there are very strict posting rules - you need to check them if you're going to post. Just search..."TAPA...is it a scam?" - loads more info to add to this, it's a good idea to keep a check on the 2 sites
Good news at last. - katejo replies to LizzieMWhen I first wrote my special delivery letter a week ago (before I knew it was a scam and was just telling them I had cancelled within the required 7 days), I pointed out that they were causing more stress than the original nuisance calls which had brought me to finding their ad. Ha Ha!
