    Well, well, well! Someone told me and I looked, and now they've changed their website! Price (whichis lower) is quoted on first page of nuisance calls page. Looks like someones had their wrist slapped - or knoe the were about to have their wrist slapped and changed the site first! Does this mean that they will say that their pricing structure was ALWAYS there and that all of us have made a mistake?

    Yes I see that so maybe someones hand was slapped. It still is hardly noticeable but at least it  is there. Still is the worrying issue of the Paypal logo that doesn't take you to paypal!!

    Also put a reputable merchant service when you check out. No one would want to speak to you Mr Irvine... as no one should hand there money over to someone who phones...

    CONTRACT OF SERVICES

    (the "Contract")

    BETWEEN

    The Advertising Protection Agency

    (the "Service Provider")

    - and -

    (the "Client")
    SERVICES

    1. The Service Provider agrees to make representation on behalf of the Client where necessary regarding all matters brought to its attention whereby the Client informs an unsolicited sales, market research, silent or recorded message telephone call has been made to a telephone number that the Client has registered with the Service Provider from a Telemarketing Firm. The Service Provider agrees to be on standby 24 hours per day, 365 days per year. Contact details of how to reach the Service Provider at all times will be provided to the Client.

    An unsolicited sales, market research, silent or recorded message telephone call is defined as any call that the Client has received from a Telemarketing Firm that has not been invited or requested by the Client whether the call was made by an individual or an automated dialler.

    Telemarketing Firm is defined as any firm in the world that contacts telephone numbers to offer goods or services, to undertake market research, announce competitions or play recorded messages regarding goods, services or promotions.

    2. The Service Provider agrees to register the Clients’ telephone number(s) on to TAPA's International Opt Out Ledger and broadcast the telephone number(s) online 24 hours per day, seven days per week on its website for Telemarketing Firms to edit the Clients’ telephone number(s) from their tele databases. Details of how to access TAPA’s International Opt Out Ledger will be provided to Telemarketing Firms for Telemarketing Firms to edit the Clients’ telephone number(s) from their tele databases.

    3. Where the Service Provider is informed by the Client that he is in receipt of an unsolicited approach to a telephone number registered with the Service Provider, the Service Provider ensures that the Client will not have to liaise with the Telemarketing Firm that made the approach to the Client directly from that time onwards providing the Client provides the necessary details of the Telemarketing Firm responsible for the unsolicited approach to the Service Provider. The Service Provider will make all future representation on behalf of the Client where necessary and will enter in to litigation where necessary.

    4. The Service Provider will ultimately guarantee the cessation of future unsolicited sales, market research, silent and recorded message telephone calls being made to the Client from Telemarketing Firms for the term of this Agreement providing the Client adheres to the terms of this contract. The Service Provider will also provide to the Client various data, counselling and legal assistance where necessary to ultimately achieve this objective.

    5. The Service Provider will take the necessary action to ensure that unsolicited sales, market research, silent and recorded message telephone calls made to the Client from any UK based Telemarketing Firms are done so unlawfully within 30 days of the Agreement Date commencing. The Service Provider will achieve this by registering the Clients’ particulars on to the various UK public opt out registers. The Service Provider agrees to carry out any necessary lawfully binding registrations on behalf of the Client each annum where necessary for the term of this Agreement.

    6. It is the Clients’ responsibility to notify the Service Provider that the Client is in receipt of an unsolicited sales, market research, silent or recorded message telephone call from a Telemarketing Firm which they have not invited or requested. At no time, will the Service Provider be responsible for contacting the Client to enquire whether the Client is in receipt of an unsolicited sales, market research, silent or recorded message telephone call from a Telemarketing Firm which they have not invited or requested.

    7. The Service Provider only acts to eliminate any unsolicited sales, market research, silent and recorded message telephone calls from Telemarketing Firms and takes no responsibility to any other telephone calls that the Client may receive from other callers. The Service Provider can only deal with disputes with Telemarketing Firms.

    8. The Service Provider will report complaints where necessary to the Information Commissioner’s Office (ICO), the Office of Communications (Ofcom) and the Telephone Preference Service (TPS) against any Telemarketing Firms found to be repeatedly in breach of its legal obligations on behalf of the Client.

    9. The Client will not knowingly falsely report any unsolicited sales, market research, silent or recorded message telephone calls against any Telemarketing Firm to the Service Provider that was not executed.

    10. The Service Provider provides and guarantees its Services only on the basis that the Client provides the Service Provider with all proper, necessary and timely instructions, authority and information to enable the Service Provider to undertake lawfully and effectively the Service instructed and that the Client indemnifies the Service Provider accordingly.

    MINIMUM TERM AND PAYMENT

    11. This Contract shall be for a minimum period of 12 months from the Agreement Date.

    12. The Client shall pay an annual administration fee to the Service Provider of £26.95 inc VAT initially on the Agreement Date by way of credit / debit card payment to subsidise all associated time, stationary and utility costs, postage and packaging of documentation and any other costs that may be incurred by the Service Provider in processing a new Client instruction for the registration of up to five (5) telephone numbers. This fee is based on a monthly subsidy of £2.25 inc VAT per calendar month.

    This annual fee includes the subsidising of all associted time and costs incurred by the Service Provider on an unlimited basis annually in carrying out its duties in providing service to the Client to ensure any telemarketing firms that contact the Client that have not been invited to do so are prevented from doing so in the future and the relevant official complaints filed with the appropriate regulatory bodies.

    A further annual administration fee of £9.95 inc VAT (0.83p inc VAT per calendar month) will be due payable initially on the Agreement Date to register any additional telephone numbers above five telephone numbers (6+).

    13. Failure to receive payment will result in the Services offered by the Service Provider being suspended until the arrears are cleared. The Service Provider reserves the right to not undertake any of the Services offered until payment has been received by the Service Provider for the initial annual period.

    14. The fees subsidise the cost of the Service Provider providing service to the Client on an unlimited basis for the term of the Agreement including any necessary legal fees and any other costs the Service Provider may incur as a result of providing Service to the Client. Service includes unlimited counselling and the processing, diarising and storage of any unsolicited approaches that the Client reports to the Service Provider that he receives from Telemarketing Firms. The first annual administration fee is due in advance on the Agreement Date followed by the same date as the Agreement Date each proceeding year (the "Rolling Date"). The Rolling Date may fluctuate depending on non-working days and public holidays in each calendar month. The Service Provider will debit the annual administration fee from the credit / debit card that the Client used to pay the initial annual administration fee. The Service Provider will continue to provide Service to the Client after the minimum Agreement period has expired and will continue to debit the annual administration fee due by way of credit / debit card until which time the Client provides written notice to the Service Provider that he wishes to terminate this Agreement in accordance with clause 30.

    15. Payments are non-refundable and no refunds, partial or in full will be given for low use of the Services offered by the Service Provider to the Client in accordance with Clause 21.

    AMENDMENTS AND CANCELLATION

    16. No variation or amendment to this Contract shall be valid unless committed to writing and signed by or on behalf of both parties in accordance with clause 30.

    17. Cancellation of the Contract will be by way of writing to the Service Provider providing at least 30 days notice from the next Rolling Date in accordance with clause 30.

    18. Should the Client decide to terminate the Contract prior to the completion of the minimum period of twelve months through no fault or error by the Service Provider then no refund partial or in full shall be due to the Client.

    19. If this Contract is cancelled by either party then any existing issues currently being dealt with by the Service Provider on behalf of the Client and any future issues the Client notifies the Service Provider of will not be deemed liable for Service by the Service Provider.

    20. The Service Provider can cancel this Contract at any time in writing to the address provided in this Contract subject to clause 30. Should the Service Provider cancel the Contract the Client will not be liable for any payment due for any Services provided from the date of the termination of the Contract.

    21. The Client has 7 days from the Agreement Date to cancel the Contract in accordance with their statutory cancellation rights.

    22. No failure or delay by either party to exercise any right or remedy will be construed or operate as a waiver of the Contract.

    23. If the Client does not cancel this Agreement after 12 months the Service Provider will accept the Client wishes to continue to receive the Services offered in this Agreement and will continue to provide these Services without further notice to the Client. The Client will continue to make payment to the Service Provider on the same payment method basis that previous payments were made.

    24. In the event of a refund due to the Client as a result of non-fault by the Service Provider, the Client will be liable for an administration fee of £5.00 for the refunded transaction.

    25. If any credit or debit card payment is not made or cancelled by the Client then the Service Provider will be liable for the remainder of the agreed term in full (payable immediately) and retains the right to take action through the Courts to recover payment in full for the remainder of the term.

    26. Interest will be charged at the Court’s rate, which is 8%, plus base rate should any payments be outstanding for more than 30 days in accordance with section 69 of the county courts act 1984. The Service Provider reserves the right to also claim compensation under the late payment of commercial debts interest act 1998, set at £40 on each late payment outstanding for more than 30 days.

    27. The Service Provider may increase the annual payment due after expiry of the minimum period of 12 months of this Agreement providing he gives 30 days notice to the Client. Such increase would be provided in writing to the Client and the Client retains the right to cancel the Service at this stage in accordance with clause 30.

    JURISDICTION AND NOTICE

    28. Contracts between the Client and the Service Provider will be concluded in the English language and our relationship with the Client will be governed by English law and will be subject to the exclusive jurisdiction of the English courts.

    29. The invalidity or unenforceability of any provision in this Agreement will not affect the validity or enforceability of any other provision and any invalid or unenforceable provision will be severable.

    30. Any notice under or in connection with this Agreement shall be in writing and shall be served by being sent by recorded delivery at or to the address of the party set out on the invoice or to such other address as may be subsequently notified by one party to the other. Notice is deemed to be served 2 working days after posting. The Service Provider accepts no liability for any notices that it does not receive that were not sent in accordance with this Clause. It is the responsibility of the Client to ensure that the Service Provider receives any such notice.

    31. A person who is not party to this contract shall have no right under the Contracts (Rights of Third Parties) Act 1999 to enforce any term of this Agreement. This clause does not affect any right or remedy of any person, which exists or is available otherwise than pursuant to that Act.

    MISCELLANEOUS

    32. The Service Provider shall not be liable for non-performance if this is due wholly or in part to an act of God, war, strikes, fire, flood or any cause beyond the Service Providers control.

    33. The Client hereby agrees to the Service Provider that he acts as the sole agent in dealing with all issues relating to the Client receiving unsolicited sales or market research telephone calls unless otherwise agreed with the Service Provider.

    34. The Service Provider acts solely to deal with issues relating to unsolicited sales or market research telephone calls made to the Client by Telemarketing Firms.

    35. The Service Provider is not a legal practice and does not act in any legal capacity or is qualified legally. The Service Provider is an independent profit-making private organisation. The Service Provider does not work under contractual agreement or is licensed by any government department to carry out its day-to-day practice duties. The Service Provider is not associated and does not work in partnership with the Information Commissioner's Office (ICO), the Office of Communications (Ofcom) or the Telephone Preference Service (TPS).

    36. The Client agrees to not hold the Service Provider responsible for any legal judgement.

    37. The Client shall not hold the Service Provider responsible if he receives any unsolicited sales or market research telephone calls. The Service Provider cannot accept responsibility if an unsolicited sales or market research telephone call is made to the Client and cannot guarantee that unlawful, non-UK regulated or unprofessional Telemarketing Firms will not contact the Client from time-to-time. The Service Provider will aim to prevent any further unsolicited sales or market research telephone calls from such Telemarketing Firms at which time the Service Provider is notified by the Client.

    38. Any costs resulting from any action taken against the Client by a Telemarketing Firm including any legal fees or other costs the Client incurs shall not deem the Service Provider liable for responsibility of costs or action taken.

    39. If a Telemarketing Firm refuses to accept the requests of the Service Provider and contacts the Client again intentionally or does so by error after the Service Provider has requested no further unsolicited sales or market research telephone calls are made to the Client, the Client shall not hold the Service Provider responsible in any such instance providing the Service Provider has taken all reasonable action to ensure the Telemarketing Firm does not make any further unsolicited sales or market research telephone calls to the Client.

    40. The Service Provider accepts no liability for loss or damage (direct, indirect or consequential) including all loss of profit or business arising out of any single claim, event, or series of related claims or events (including claims based on negligence).

    41. The Service Provider will use personal information which we hold about the Client to provide our Services and products to the Client, for credit control and market research purposes and to inform the Client about our other Services, products or events we provide that we believe may be of interest to the Client. The associated costs involved with other Services that the Service Provider offers will be advised in writing. The Service Provider may only share the Clients information with staff or other specialist networks with the sole purpose of undertaking the task provided and stated in section: - Services. The Client has the right, by written request, to a copy of any personal data (as defined in the Data Protection Act 1998) which the Service Provider holds about the Client.

    42. The Service Provider is a private organisation. The Service Provider will report to the Information Commissioner's Office (ICO), the Office of Communications (Ofcom) and the Telephone Preference Service (TPS) complaints regarding Telemarketing Firms found to be making unlawful unsolicited sales or market research telephone calls to its Clients where the Service Provider feels it necessary to do so in the interest of public safety. Any information / evidence provided to the Service Provider from the Client that is passed on to a regulatory body will bear the details of the individual or business that provided the complaints to the Service Provider. All correspondence provided to the Service Provider from the Client regarding Telemarketing Firms will be construed as an official complaint against each individual Telemarketing Firm contained in any correspondence. The Client hereby agrees to swear an Affidavit or other legal document at any time for the Courts if required to assist any official investigations by regulatory bodies and the Client also hereby warrants the Service Provider to swear an Affidavit or other legal document on behalf of the Client at any time as a result of any complaints reported to the Service Provider if required by any regulatory bodies or Courts.

    43. The Service Provider is not a charity and has no association, link, partnership or involvement with any charity and does not donate any money to any charity.

    44. The Service Provider reserves the right to make changes to these terms and conditions from time to time. Any changes will be notified in writing to the Client.

    45. Contracts from a limited company are accepted on condition that all the directors of the company are personally, jointly and severally liable for any sums due to the Service Provider for costs, expenses and VAT.

    Lizzie where did you get those terms of service from!!  Section 21 still doesn't say 7 working days as the regulations state. Also they still state that you have to communicate by post and they only accept communications as having arrived 2 days after they receive the letter so by their terms it it physically impossible to cancel. we know that you can cancel by email,fax, post or by hand and cancellation is as from the day of posting. steps in the right direction but my opinion still remains

    TAPA have again changed there stop nuisance phone calls page to

    "please see our Terms of Service regarding subscription starting from only £2.25 per month for registering up to five numbers."

    Just shows that some of us regsterd more than one number and they wanted to charge us for each number and shows the value of signing up for there service.

    Anyone reading this Please use the TPA as this is the group you want to use to stop Nuisance Calls! Not the TAPA who just sign you up for a charge

    well spotted. they now need to get to
    1. rid of the paypal symbol which doesn't take you through to Paypal
    2. Up there online security to the globalsign level they say they have
    3. Educate their customer service staff in good manners
    4. abide by the distance selling regulations as they say you do
    5. change the terms and conditions to read 7 working days as it is stated they should in the DSR's
    6. Send out the welcome pack within 2 days not 10 as they say they will
    7. Cancel the subscriptions of people who feel they have been misold the product
    8. Ok so now they have dropped the cost and show it on the page but it is still right at the end of the page and is not highlighted in any way

    Guess you now know why I always say "in my opinion". I'm sure TAPA have been aware of the MSE site for quite a while. I wonder what's prompted them to make a complaint at this stage. Surely, if they're being investigated, as people have claimed, there must be some evidence on which to base the investigation. Guess we'll have to wait and see and keep posting on this site.

    The Advertising Protection Agency or TAPA is a scam company. You register you phone numbers to get your unwanted texts and phone calls reduced. Your register online and at no point are you advised that there will be a charge for this service. You are advised however that you will receive and information pack.
    When the pack arrives, after careful reading you will find out that they want to charge you in excess of £39 per number you listed and that you have 7 days to cancel.
    However if you send a letter then it wont get opened as the address on the website is most certainly a mail forwarding address.
    Anyway, you will get a phone call, as I did telling you that you owe them money and that if you dont pay they will take yo to court.
    The TPS http://www.tpsonline.org.uk - whos logo is used by TAPA is aware of this company and is looking into its fraudulant activities.
    The PAYPAL logo does not take you to the PAYPAL site and PAYPAL are looking into the fraudulant use of their logo.
    Trading standards are also looking into this company as well as Watchdog.
    If you do register with TAPA and they call you wanting money tell them to take you to court, but make sure you email them and keep a copy of that email when you cancel the agreement.

    Personally all of the people saying how wonderful TAPA is make me think they they work for them and these are the bogus blogs not the other way around.
