Just for starters - they are not complying with many of the legal requirements of the Electronic Commerce (EC Directive) Regulations 2002, and the site doesn't meet the legal requirements of Regulations 6 and 7 of the Companies (Trading Disclosures) Regulations 2008, made under Sections 82 to 85 of the Companies Act 2006.

It's another victim of the cuts and it would seem that Trading Standards offices up and down the country are completely overwhelmed and unable to meet their responsibilities in this area... I actually have a written response from a Trading Standards office in which they accept that a trader is breaking the law by trading on the Internet without complying with basis consumer protection legislation*, but they cannot do anything about it because they don't have the resources to take the case forward!
What an indictment of the present mess, and no wonder the crooks, like TAPA, are laughing all the way to the bank!

Interestingly, their VAT number and their ICO registration are both listed as "The Advertising Protection Agency", which - as has already been pointed out - doesn't exist. So, you can't take legal proceedings against it to recover any money paid - which is the whole point of having the above legislation to protect consumers. If anyone can check their payments, invoices, letterheads for a COMPANY NAME or the name of a sole trader or partnership (the law requires this on these documents as well), that can be posted here and on consumer web sites so that summonses can be served on the trader behind TAPA for such claims. - William Old replies to Dr leaDr Lea, as you are being chased for payment by this David Overton, can you ask him explicitly who the alleged creditor is? They can't have it both ways... the trader behind TAPA is anonymous (unless Peter Marsden is the trader, but he still neds to say so on the site if that's the case) so you can't be held to account for any debt, unless the other (identified) party can prove that such a debt exists!
And Peter Marsden has declared himself to be a "non-trading individual" when registering it... I had received no further phone calls from them or any other contact since november until I received the e-mail on Saturday threatening me with court action if I didn't pay them within 7 days. To say I was shocked is an understatement and a little annoyed. I thought they would get the message and go away.

- Dawn| 14 repliesWell I finally received my letter from TAPA on the 12th of this month, the letter states unless I pay they will start preceedings against me as of the 14th????? The paperwork I received was shoddy to say the least, it looked like a photocopy. I have replied to this letter and it will be the last time I will engage in anything from this company,unless it is from legal means.(for TAPA's benefit that means via my solicitor). I have given my new BFPO as a forwarding address and it remains to be seen whether they persue the matter. I basically told them to take me to court as I owe them nothing, I cancelled the agreement ect... I even quoted the ASA complaint and distance selling regs. I am so annoyed at the fact that they are preying on people and seem to be getting away with it. I know about the bullyboy tactics they have used against others, and it really gets my goat that if they target someone elderly or someone who panics and buckles under their threats, they will continue to prosper.They need to be stopped!!!!!!!!! Cowboys that is what they are and naively I thought they would crawl back under the rock whence they came! Good luck everyone, fight the good fight and I will keep you posted from abroad, if it comes to that.

Have already had the email. Have replied by email and letter citing the ASA judgment and stating that i cancelled within 7 days of getting their printed documents in accordance with Distance selling regulations. I suggest that you contact the ASA and report it to them. - Me myself replies to sweetcher| 2 repliesthere is no way that TAPA will ever take you to court and for a whole host of reasons you will find on this thread. Another is that in a sense TAPA doesn't even exist it is not a ltd company but just a 'trading' name used by a partnership and so if anything ever got to a court the action would have to be taken by the partners themselves which would mean that they would have to reveal their real names and addresses something that they go to great lengths not to do by using a mail forwarding address and false names to hide behind (all this can be found on their own website). As my trading standards officer told me these people trade on fear by using bully boy tactics.
- kyfra replies to sweetcher| 5 replieshiya, i was wondering if anyone has actually been taken to court by TAPA?? i today recieved the letter of action demanding payment for 39.95. i filled in the online form last sept, recieved a call in oct asking for money and said i hadnt realised there was a fee and apologised for wasting their time but i wouldnt need the service (stopping nuisance calls), the guy was fine!! then eight months down the line out of the blue - no emails or telephone calls from them - i recieve this letter!!! has anyones court threat ever been followed up??? am i safe to ignoe it?
