LAWYERS forgot about A.B.A. saying PUBLIC RECORDS like JUDGEMENT against Retrieval-Masters Creditors Bureau, Inc. can be put on online. - T90702| 2 repliesSpoke to someone and they said they were from AMCA. He kept asking me to identify myself, and when I told him I wanted to know what AMCA meant he said he would refuse until I identified myself. When I told him I needed to know first, he raised his voice and said "WHEN SOMEONE CALLS YOU AND YOU ANSWER THE PHONE, YOU IDENTIFY YOURSELF! IF THIS IS HOW YOU ANSWER A PHONE YOU CAN HAVE A GOOD DAY!" sounded like he was from India or something. I've gotten 1 call everyday from them..

- JI get at least one call a day from the "Viet Nam" number. I haven't answered it yet, but seeing this, I probably never will.
- mommaG replies to Mr BostonIf they say hello and then make a comment like I guess I lost the customer is that like them talking to a live person on my end? I have had some do that to me.
- Mrs. Smith replies to Mr Boston| 1 replyCan you please clarify your post? To file a claim, do we need to have spoken to a live person more than once in a day or are the repeated calls with "Hello? Hello?" on the voicemail enough?
Thank you. - Resident47 replies to RoseYou don't need a valid debt or a derogatory trade line on your credit reports to be hassled by debt collectors. They call third parties to alleged debtors all the time for permitted skip tracing purposes, or often pretending it's a trace to annoy and shame an intended target whose location is already known.
- Resident47 replies to DWAYNE RAYYou should have seen a paper dunning letter from the collection agency by now. If you don't agree with what it says or how you've been treated, you have a right to respond with a dispute, which will invoke several FDCPA protections.
- Resident47 replies to John| 2 replies} you probably missed a doctor bill in the mail.
Leap to conclusions much? The agency could have been skiptracing a stranger, explaining the reluctance to record messages.
} a blatant violation of the FDCPA
You'd be amazed what some judges don't consider an excessive call pattern. The same three calls in an hour following an order to quit would carry more weight.
} Some law offices advertise to stop collectors
Yes, there are about fifty cowboy attorneys who spam sites like this and mislead the public about what consumer laws say.
} $1500 PER CALL in violation of the fdcpa
You have TCPA and FDCPA confused. The latter is capped at $1K statutory per action, not per violation. The former was written to attack sales callers only and can be applied to debt collectors in only a minority of cases. The TCPA statutory award defaults to $500 a violation. Trebling that requires claims to meet a "knowing and willful" standard. Not so easy to grasp or win as the spamming lawyers promote.
} anything more than 1 call per day
Neither of those two laws set a daily limit on the volume of calls. Maybe you got that from some collections job but not a reputable legal counsel.
FDCPA § 1692k. Civil liability
http://www.law.cornell.edu/uscode/text/15/1692k - Resident47 replies to Mr BostonThere are plenty of ways a collection phone call may violate the FDCPA without a conversation resulting. Covered "communication" may be direct or indirect. Don't confuse your in-house rules for case law.
- Resident47 replies to Mrs. SmithIn your consecutive comments you're seeking legal advice from a debt collection agent, which is rather like talking to the coyotes about securing your henhouse. You can't get tied in knots over live versus recorded encounters. What makes a violation of FDCPA comes down to the agency's conduct and the context of each communication attempt. If you're building a case you need to be clear on whether you did or did not use the FDCPA to make the agency's job more difficult, and when that happened. Some agencies violate early and often with no prodding. Others take more time or in reaction to those invoking their rights. A lot more could be said, but this is not the venue.
