FDCPA does work so use it!
I wrote about this company the last week of March.  I told about how after I informed them that the debt they were trying to collect on definitely was not "valid" suddenly my account went into "disputed" status.  Well after the call, I followed up with a faxed letter informing them that they are not to call me again or my husband about this debt and that any communication has to be made in writting.  I went on to inform them that even if I did write a check to Money Mart back in 2001, the statute of limitations has long passed in the state of virginia, so they were four years too late to try to and collect on it.  I called them today just to check the "status" of my disputed debt.  Suddenly the debt was no longer with their company.  FYI they have caller ID and your account is pulled up by your phone number.  Of course there was a record of them calling me because the rep told me that they had my cease and desist letter on file. Either way I let them know that I knew my rights and my state laws and I don't expect to get anymore calls from these scammers! If anyone wants to use a copy of the letter I faxed off you can email me at owensdana83@yahoo.com.  Just please give me a name(it doesnt have to be your real name) and that you need help with HPC that way I can email you a copy of what worked for me.

These people are VERY rude and VERY unprofessional.

They LIE when they tell you they are calling on behalf of an Attorneys office and that if you don't return there call than Legal Action will be taken.

NO such thing can occur, you CAN NOT be put in jail, you CAN NOT be picked up and served like they claim, it will go against your credit like anything else if you default on a payment. They are a Collection Agency just trying to scare you.......DON'T fall for it.......

By Law if you ask for something in writing they HAVE to send it to you within 5 days, DO NOT verify any address, SS#, or personal information, just simply tell them you should already have all that so you tell me what you want to know.

    Hope this helps......

    JOHN
RECEIVED A CALL FROM 904-418-500. A man - who identified himself as John Lemax talked to me. He first said that he was calling from my county and demanded a full restituition be paid by 7 pm. When he gave me a call back number - which is long distance  -- and he said he was calling locally - A BIG RED FLAG hit me over the head. DUH! Not right.  Although - I made efforts to come with the money owed on my payday loan -- I investigated further by stopping at office -- where I obtained loan.  And I was informed that such company still my loan in collections - WHICH MEANS THAT I HAVE NO BUSINESS COMMUNICATING WITH ANYONE ELSE -- ONLY THE COMPANY FROM WHOM I DID OBTAIN MY LOAN.  It is a great relief to know that this web site has a valid purpose. THANK FOR THE INSIGHT ---- HERE IS MY TWO CENTS WORTH.

I thought it was so funny that a rep From HPC called me at work.  I was very cordial with him and he said that he was hired by District Attorney to handle bad checks because it is against the law to write bad checks.  I advised the rep that I work for the county and we do not hire outside agencies to deal with it.  We deal with it ourselves through letters from DA and process servers.  Then the guy got really upset and said that he will tell my supervisor all my business and i am a criminal for writing bad checks.  Then come to find out he was looking for Betsy not Bessie.  Wrong person....i told rep what he is doing is a violation of many things especially FDCPA...and lying for the DA office is not a good idea...then he hung up.  :)

Ma'am, I know exactly who you are, i remember this account. I have never stated I or that we are an attorney's office. We are a debt collection company. Your debt is a valid debt. Payday Loans, just like other debt (mortgages and Credit Cards) are bought and sold as commodities. We buy no debt, we own none of your debt, however we are hired directly by the companies who own your debt currently and are charged with it's collection. This is not a scam, and I ALWAYS treat the debtors I call with respect and dignity. Times ARE very tough out there right now and repaying your debts are going to be twice as hard as they should be. You will not be arrested or charged with any crime if you don't pay. However because you are under a legal and binding contract, you are responsible for a large amount of additional fees. Credit reporting, your check logged into check systems which is all standard industry practices. If the payment arrangement is too high that you agreed to, then call me back and we can make it where we work around your bills and get this one taken care of as well. At this point I just hope you are able to do well enough to you and your family afloat during these tough times. Me a collector with a conscience who follows fdcpa laws always.

I received a call today in regards to a debt that is owed to a local check cashing company. The call came in around 11:25am CST 5/14/10 right before work. The individual that I spoke to name John Lomax said that I needed to have the issue resolved otherwise I was going to have a long weekend in the county. I asked him can I pay half of it and he said no! It all had to be taken care of by 1pm and did I have any relatives or anyone that can help me take care of the matter? I ended up paying the money through Western Union via quick collect to HPC. I called back and spoke to a person named Craig Lombarda to let him know the pymt was taken care of and he said he is taking the info down so nothing would happen to me and the matter is taken care of.  Someone gave me the info while I was at work about this site and I immediately became furious. I got on the call w/ my bank card to have the transaction stopped. They told me being I did it w/ WU I needed to contact them. Western Union told me w/ quick collect payments goes into an acct directly so their isn't a name of a person to pick it up. I am in the process of disputing the matter w/ my bank card now because my bank hasn't released the funds. The representative from Western Union said that I need to contact my local authorities so that an investigation can be brought against this company. I am so grateful this site is here to help people out. I am going to tell people about it and the # like wild fire and to not send any money.

Why act like [***] he says... Let me be frank with you here. I am guilty of having an attitude many times throughout a day. My reasons are simple and easy to understand. It is reflexive, reactionary and usually over with quickly if we can speak as adults with each other. For example : I call you out of the Blue, you have moved, changed your numbers, and even disassociated yourself with some of the people you used as references. <skip trace> We contact you and you play this amnesia card or then you get belligerent with us and yell and scream obscenities @ us. Of course it ruffles our feathers, it would the Pope for Christ's Sakes. I ALWAYS comport myself professionally from the outset, but sometimes (we are all human) we get caught up in the moment.; even then though, we never EVER swear, belittle, or threaten you. Telling you the consequences of your actions folks is not a threat if you think that then you are just ignorant (that is not derogatory either) because you teach your children from BIRTH that there are consequences to the things you do (and in this case you DON'T do). SO! Did you threaten your children their entire lives? No, of course not and neither do we. Next you will say we are not children! Do not talk to us in this manner! Well then why am i even on the phone with you? Because you must have been absent the day your mommy and daddy taught you about responsibility.

Nicky, O Nicky. I don't know the specifics of what is said, but here is the thing with this. If there are improprieties with this person it will be handled even through your complaint <if he went over the line he will most likely be caught> Additionally the monies you sent were for a valid debt the you do owe no matter how it was handled so you DID do the right thing by paying your debt. Attempting to rescind the monies through w/u seems moot at this point. Your complaint may have merit, if it does, do what you have to THAT is understandable.

Hello, my name is Antonia I handled a payday loan with Mr. Goldstein at this place H&P. The payday loan was my husbands and Mr. Goldstein always treats me with respect and he says yes mam and no mam to me. he worked with me on breaking up what we owed so it wasn't all at once. Then i got a call from another collection company and they threatened my mom with jail over hers. Mr. Goldstein was nice enough to talk me through what i told him they said and he told me all about fdcpa laws and how they protect me and my family. He told me to make a complaint and get a recording of people saying these bad things and then turn around an sue them. He says those are the kinds of bad collection companies that give his a bad name. My point is that I wish Mr Goldstein handled all of my bills because he was so kind and respectful in working with us. My husband can even go and loan with ace again since Mr. Goldstein made sure all our paperwork came to our home showing no more liability to the debt. I see many harsh stories on here and they are really bad if true but I just wanted to let you know that all people at H&P are not bad people. Thank you very much

These people are a crock! Like I have said, they called me about a "debt" from 2001.  They tried to threaten me with "legal" action.  Little did they know that I know my Virginia State Law and that debts under $200 have a statute of limitations of 5 yrs which means they are four years too damn late.  I searched this company's records and found out that they are indeed operating under a ficticious name.  That they have many lawsuits against them as well.  That when they are sued they tend to go out of business and then resume again under a different name but Noelle Poole seems to be the CEO.  Once I sent them my cease and desist letter, they did just that CEASE and DESIST.  But it required me to do my part and take charge.  This goes out to everyone....TAKE CHARGE OF YOUR AFFAIRS AND LET THEM KNOW THAT YOU WON'T TAKE THEIR CRAP ANYMORE!

Not everyone who posts is a deadbeat.  Sure, they may owe money to a Pay Day loan company.  Life sucks sometimes and people's situations at home go bad.  Maybe they had major heart surgery and couldn't work for 3 months; maybe they lost their jobs; who the hell knows what their situation was.  Y'all don't have to treat every person you phone as a piece of garbage; they are still human beings.  I'm sure there are "definite LAWS that protect your clients", but threatening to file criminal charges of theft on the first phone call is a bit much.  And your "help to facilitate" repayment is absolutely no help.  You do get over as quick as possible - give me all your money this month Wham Bam; next month we'll do the same and more.  You're just doing your job and don't care about all this, but I feel a little better.
