- At Last Justice!As a result of an investigation, the Claims Management Regulator has decided to issue directions to Aims Legal Ltd.
Aims Legal Ltd was found to be in breach of its additional conditions of authorisation (effective from 20 August 2012) and the following Conduct of Authorised Persons Rules 2013(2):
General Rule 1 - A business shall conduct itself with honesty and integrity
Client Specific Rule 1a) – A business shall act fairly and reasonably in dealings with all clients
Client Specific 1c) – A business shall ensure that all information given to the client is clear, transparent, fair and not misleading
General Rule 8 - A business shall operate a complaints scheme in accordance with rules made by the Regulator.
Complaints Handling Rule 4 - A business must have in place and operate appropriate and effective internal complaints handling procedures (which must be in writing) for handling any expression of dissatisfaction, whether oral or written, and whether justified or not, from or on behalf of a complainant about that business’s provision of a regulated claims management service.
The directions are as follows:
1. Aims Legal Ltd will complete a review of its systems to identify all affected clients who meet the following criteria;
i. Clients passed to you from Aims Projects Ltd and you have processed their payment in advance of your provision of a regulated claims management service after 20 August 2012;
ii. Clients identified above who have either
a. not had a successful claim; or
b. have had a successful claim but the value of the claim (following deduction of your settlement fee) did not exceed the total fees paid to you; and
c. have contacted you to make an expression of their dissatisfaction, and/or
d. have contacted you to cancel the agreement/contract
2. Aims Legal Ltd will review all complaints made by affected clients
3. Aims Legal Ltd will provide in writing the following information to all clients who have been identified as part of the above review that:
i. You have conducted a review as a result of regulatory action and have identified that they had paid the advance fee to you when contacted about a potential mis-sold PPI claim; and
ii. You have noted that their claim was unsuccessful or the amount they received following a successful claim did not exceed the total fees paid to you (where applicable); and
iii. You have a record that they have contacted you to cancel the agreement/contract; and/or
iv. You have a record that they made an expression of dissatisfaction; and
v. You have reviewed their complaint and the outcome of that review; and
vi. They have the right to complain to the Legal Ombudsman (providing their contact details).
4. Obtain prior approval from the Regulator in relation to the proposed content of correspondence to be sent to affected clients.
5. Maintain records and provide to the Regulator (upon request) to demonstrate the scope of the review carried out, to include full details of:
i. The records inspected
ii. All clients identified under direction 1
iii. Names and addresses of identified clients
iv. The date the client was written to
v. The outcome of the review of their expression of dissatisfaction; and
vi. Whether the client made a complaint to the Legal Ombudsman- Caller: AIMS Reclaim
