The question, from what you state, is why did one ceding scheme appear to have robust systems in place before allowing a transfer and others did not? There must be a reason that this scheme had alarm bells ringing.

I think some ceding scheme trustees have some serious questions to answer. I would suggest you start asking them.

I fear that you will find the various government funded institutions that are there to protect the public have as much value as an ashtray on a motorbike.  The scammers know this and push the boundaries to the extremes without fear of comeback.

Get yourself a competent class action group together, pool resources by linking up with each other and don't give up. Good luck to you all.

Thats the big question. .I approached Royal London on behalf of someone but they hid behind the fact that HMRC gave it a reference number...be interested to see which companies did and didn't flag it...

Love the "ashtray on a motorbike" quote!  The Pensions Regulator's Scorpion campaign is obviously not working but it makes the government feel better and gives them the illusion that they are doing all they can.  Which isn't much.  The Regulator and the FCA and all the quangos don't really want to get their hands dirty, and this is a dirty business with most of the perps offshore (mainly Spain, Czech Republic and Dubai) where they think they can't be caught.

Hope for whom?  The perpetrators?  There is always hope for victims - Ark's money is reasonably safe and most of the assets have been recovered from the various original investments: land in Cyprus, timeshare in St. Lucia, property company in British Virgin Islands and a brothel in the North of England.  Talking of England, somebody who is fat and bald is in the UK atm for urgent meetings - maybe checking up on his brothel portfolio?  The perpetrators had better watch out because none of the Ark victims or Capita Oak victims will give up until every last one of those responsible for their loss and liabilities have been caught and brought to justice.  Lets hope those recycled shipping containers are worth something.

As much as I want in fact need the money returned and put into a legitimate scheme..I want these thieves brought to justice just as much..jailed not only for the potential loss of my hard earned cash but for the sleepless nights  the constant worry about my financial future and the heartache and humiliation for being naive enough to be taken in by them and also for the same that's happened to the other people duped by them. I have a ton of faith in Angie and Paul T and I for one am extremely grateful for them pointing some big guns at these people who think they are above the law and think it's ok to ruin peoples lives for their own greed..It was only a few months ago it really felt like my world had ended..They have given me the strength to think there is a pretty big chance these people will be brought to task..I'd be quite happy to see the StoreFirst/CapitaOak/Ark lot all swing for what they've done..but all put behind bars will suffice. ..If I CAN get my money back that really will be the icing on the cake

So, let me get this right. All these schemes were allowed to established by the UK taxman without checking whether there was actually a firm that employed people that transferred their pensions to these schemes, which all appear to be employer sponsored schemes. Is that correct?

So, the only ''employee" was the director of the firm that sponsored the scheme in question. If this is a loophole, which I guess it is and has been exploited mercilessly, why don't HMRC close it?

Surely, it is not beyond the bounds of reasonableness to put in place a system that checks whether people transferring into a company scheme are actually employed by the sponsoring scheme's employer?

Why do the victims have to resort to a class action? Surely this is a systemic failure and should be sponsored by those government bodies that allowed this to happen by their ''alleged'' negligence.

If the UK systems that are supposed to protect the UK consumer fail, then it is little wonder that offshore salesmen get in on the act too. Am I missing something ?

I cannot believe that HMRC, the Pension Regulator, the press and others stand idly by and effectively leave it to a cancer patient to make a stand on his own.

Looking into this further, there appears to be more than just Ark and Capita Oaks linked to this constant catalogue of pension failures.

    http://www.ftadviser.com/2012/09/19/ifa-indus ... nL/article.html

Who was one of the  directors of Pilgrim Trustees during this period, leading to a claim on the FSCS of at least 14.5 million pounds and at least 88 victims? Not going to name anyone on here, but Google will help no doubt.

There has been a systemic failure here by the authorities and hundreds, if not thousands, have been badly let down by the various government agencies whose job it is to protect, as much as is reasonable, the public from these issues.
