    Four calls today - when asking to speak to a supervisor am hung up on. Fourth call spoke to a supervisor who told me they dont need to comply with TPS.

    To 'Telesales Operative' - you may only be doing your job but the company you are working for is breaking the law.

    For my sins I am a Legal Advocate and I can offer some advice about nuisance calls
    Actually BT or any service provider as much as they deny it are responsible as the calls are being made on their lines and nuisance calls or 'unsolicited calls' are breaching the privacy act as well as other acts.
    International calls are indeed a nuisance and I have tracked down a market research company who are based in India and the UK they are responsible together with other sister companies of 70% of the international nuisance calls, they are 'gfk' I have warned this company by contacting their managing director that he faced £10,000 fines and even imprisonment if this was not stopped, and guess what most all my international calls mysteriously have stopped. Don't stand for it complain as what they are doing is strictly illegal and a criminal offence.


    All nuisance phone calls... why suffer they are ALL ILLEGAL !
    FIGHT BACK ! Do the following
    1. Report immediatelly to your phone operator to have the call blocked, they have an obligation to protect their customers against abuse and harassment .
    2. Report to OFCOM

    3. You can contact the Police as the company who is making the call is against the law.

    4. If it is discovered that the company is a bailiffs or a credit card company then they could have easily have broken the law by breaking the following:
    a. The administration of justice Act 1970 Section 40
    b. The Data protection act 1998 various sections, in disclosing personal information over a phone line containing personal information for others to hear or overhear on say an answer phone.
    5. Contact the Office of fair trading and report the company when you discover who it is, they have great powers.

    6. When you have done this claim back your expences and don't be affraid to name and shame.
    I hope this is of help and it is about time we all stood together to stamp this out once and for all.
    REMEMBER your telephone operator/service providers are aiding and abetting this illegal activity and are liable, especially as they are earning off the backs of this scum by creaming off their commission, the customs and excise do not escape criticism as they are getting Value added tax, illegally !

Telecommunications Act 1984 section 43.  Improper use of public telecommunication system—(1)   A person who—  (a) sends, by means of a public telecommunication system, a message or other matter that is grossly offensive or of an indecent, obscene or menacing character; or(b) sends by those means, for the purpose of causing annoyance, inconvenience or needless anxiety to another, a message that he knows to be false or persistently makes use for that purpose of a public telecommunication system,shall be guilty of an offence and liable on summary conviction to imprisonment or a large fine or both. Exceptions to this are generally the Police or Government and very few others.

    In computing, PHISHING is an attempt to criminally and fraudulently acquire sensitive information, such as usernames, passwords and credit card details, by masquerading as a trustworthy entity in an electronic communication, the same rule applies,help others by reporting them too.

    If a UK company can be held responsible for any call covered by these regulations and powers, then the place from where the call was originated makes no difference.

    True call is a new device that plugs into your phone line and intercepts calls, voice recognition protects against recorded calls, any call which says press 1 for this or that are barred, your friends and family get straight through immediately without any hold up wheras the company calls are held up and checked out. Calls you do want being business oriantated can be on your favourites list and they get straight through. I think that this is well worth checking out.
