I wonder if the all the funds will be located? There are more issues here than just the question as to whether this scheme breached any technical UK pension rules. Suppose that it is found in court that the scheme did not breach pension rules? Do you think that there will be a cause for celebration? I sincerely doubt it.

I'm in the same chain I think, Platinum Bay and www.pensionassist.co.uk are the people I'm dealing with
It seems we hand over our pension to sustainable weath and get 25% cashback.
Now the 25% cashback sounds attractive as I need the 25% now more than I'm likely to need the pension fund in 20 years time.
I need some sort of assurance I'm at least going to get the 25% before i hand over my fund though.
The 25% doesnt get sent for 6 - 12 weeks after Ive signed on the line though, by which time my pension and the company Platinum Bay / Pension Assist could be long gone.
Have you found any further information ?

Go to a qualified firm of IFAs( In the UK with UK authorisation) and run this past them. If this is not an FSA authorised scheme, then you will have no comeback if something goes wrong. For those that introduced the schemes, expect to be brought into the court proceedings.
For those affected, it looks like they will not only have to repay the loans, but could potentially be hit with unauthorised payments charges from the taxman. Logic would suggest, in this case, that HMRC would not impose these charges if all monies were repaid. Whatever the outcome, there will be a lot of people seriously out of pocket here.
