Nan Thankyou for your comments. Don't feel disheartened, we too do not agree with the removal of posts as new readers are not aware of the whole conversation and it's unfortunate that they don't see the cunning side of the Express Law and the lengths that they will go to.
However, we will keep going as this forum is working. There have been many clients that have come forward to wewillgivefreeadvice@hotmail.co.uk that don't wish to post on here due to reprisals.

This can have a detrimental affect on your estate plan and may result in the transfer of property to the wrong heirs, while costing you a great deal of money in preparing the trust agreement, in some cases, more than £2000, although this is even above the odds.
In most cases, such companies purport to use the services of an Solicitor, but usually, the Solicitor is only a front man for the company and does not play any part in the creation of your estate plan or trust. Also, such companies often make false claims about the benefits of a trust, in particular, they exaggerate the beneficial effect of a trust when it comes to asset protection,
Deceptive trust companies can be spotted in a number of ways:
They often sell trusts through seminars or through telesales offering free advice with arranged home visits, without giving you any way to check the credentials of the sales person or company. When they visit you at your home they may remove paperwork, leaving you with very little to look at or investigate.
Watch out for “sound alike” names confusing their services.
FINAL WORDS OF ADVICE – Any trust should be created only after a thorough review of your tax, estate, and personal goals. You need to talk with a team of professionals perhaps an accountant or financial advisor to make an informed decision on whether to create a trust.

Deprivation of capital
If you give away your property or savings deliberately in order to avoid paying for your care home costs, this is called ‘deprivation of capital’. The Department for Work and Pensions and the council are entitled to take account of this capital as if it were still owned by you, and can seek to make you pay the care home fees accordingly.
Some of the ways in which you may be considered to have deprived yourself of capital include:
*Giving away money
*Transferring the ownership of property, or
*Spending your capital on something not necessary, for example, an expensive painting.
Both the Department for Work and Pensions and the council must look at your reasons for giving the capital away and when you gave it away. For example, if you gave each of your grandchildren some money three years before you needed care, it may be unreasonable for the council to assume that you gave the money away in order to avoid paying care home fees. However, if you signed your property over to your son two weeks before you went into a care home, the council might decide that you did so in order to avoid having to pay the care home fees.
There is no time-limit on how far back the council can look at what they consider to be ‘deliberate’ deprivation of capital.
For more information on the above, please contact the DWP or your local council. Don't be fooled into making a costly error in having it protected, only to have it taken away after all. It's imperative that you receive the correct advice.

My 80 year old widowed Mum got a call from someone who said they were from "Express Law" last week. They asked her if she was aware that the Government was encouraging older people living in larger properties than they needed to sell them so that families could then have them. OK, the Government IS asking such people to consider moving out of rented Council and Housing Association properties but NOT owner occupied properties such as my Mum has. They then offered to do all the legal work that she would need with such a move as well as "anything else" such as Power of Attorney which, thank God, she already has. How the hell they got her number I don't know!
Now Mum might be 80 years old but she isn't in her dotage yet. She took down all the details and called me straight away; hence I found this site. Well, I eventually found it but only after wading through all the bullsh!t that Express Law have managed to get on the first few pages of a Google search. Obviously I told Mum to tell them to "do one".
Can anyone tell me what is being done to stop these scumbags dead in their tracks? I get annoyed when I see this sort of thing on TV but I get REALLY ANGRY when they are trying to rip off my own Mum.

You could suggest to your Mum that she signs up to the Telephone Preference Service (TPS) to stop most unsolicited calls. Please see the below details:
What is TPS?
The Telephone Preference Service (TPS) is a central opt out register whereby individuals can register their wish not to receive unsolicited sales and marketing telephone calls. It is a legal requirement that companies do not make such calls to numbers registered on the TPS.
The original legislation was introduced in May 1999. It has subsequently been updated and now the relevant legislation is the Privacy and Electronic (EC Directive) Regulations 2003.
Who can register?
The term individual includes consumers at their residential address, sole traders and, except in Scotland, partnerships.
How long will it take to become effective?
Once a number has been registered it will become effective in 28 days.
Is there any charge for registering?
No, it's free to register on the TPS.
Who pays for TPS?
No money is received from the Government to run the Service, the direct marketing industry pays for it.
Do I need to renew my subscription with the TPS?
No, the service is intended for live telephone numbers. As such, provided your telephone number remains active it will remain registered with this free service.

I was cold called by a Sheffield-based legal company. I don't normally have anything to do with cold calls, but when my father went into a care home some years ago he had to pay out substantial fees, which broke his heart.
I agreed to see a rep of the company who was not a solicitor but part of a franchise system. The cost, at £4,100, seems very high and they want the money up front.
Should we get other quotations?
A: Jonathan Hill, who is a certified financial planner at the Solicitors Milford & Dormor, of Chard, Somerset, says:
"Local Authorities have strict rules which allow them to disregard any schemes which they deem to be deliberately arranged so as to avoid care fees.

Will-writing rogues get regulated

At last people wanting a will drawn up are to have some protection from the rogues infesting this industry.
The Legal Services Board has announced that everyone who writes wills must now
be regulated. The decision follows an investigation by the board, which said it had uncovered "systemic problems".
"We found consistent patterns of sloppiness, simple errors and poor communication," it said. "Too often consumers were subjected to unfair sales practices.
"There have also been some well-documented examples of fraud and deception."
Maybe they have in mind habitual wills conman Gerald Barton. When we came across him 10 years ago, he'd been running the will-writing company JHD Associates, which collapsed, and thousands of wills were dumped in a barn.
His Nationwide Legal Services firm was shut down, the High Court hearing that it was
"scandalously run to the huge detriment of the public".
And last year his Minster Legal Services of Gainsborough, Lincs, went under and this time boxes of wills were dumped in the street. Regulation can't come too soon for the likes of him.
Chairman of the Legal Services Board, David Edmonds, said: "Ultimately, people must be able to write a will with confidence, not fear. For that to be possible, everyone offering such services must deliver a baseline of consumer protection. This is not about extending regulation for the sake of it; it is about maintaining public confidence in an important legal process; enhancing the environment for reputable providers; and protecting consumers at particularly vulnerable times in their lives.

I work for a charity supporting older people in West Yorkshire. Two of my service users - both vulnerable, have been called and had pressure put on them to agree to a home visit from someone who wants to help them to check that 'they have their affairs in order'. I actually went to the home of one of them to ensure that they were not fooled into parting with money for anything. The second ladys daughter rang 1471 and gave me the number which I rang. The company that answered are called Express Law. I asked the woman who answered why they are cold calling people and making appointments with older people who are vulnerable and have dementia and learning difficulties, to which she replied that people need help with making wills and managing their estate..
I have told my service users to hang up and not to enter into conversation with these people.

Express Law are now targeting elderly groups around the UK. Can anyone advise if I should contact the local trading standards in regard their bully boy tactics or the ones where their office is located. I'm trying to protect an elderly group where my mother assists. As soon as she rattled through their presentation I knew it was bad news.
Any advice on blocking them, as they took the details of many trusting group members is appreciated.

Please provide facts. Do not lie and say we use bully tactics as that is ridiculous. People have a reciver in their hand. They can put the phone down at ANY time.
No you can't block us.
Finally feel free to go to trading standards this firm has been running since 2009 and we have helped many many people. This fourm is a hate campaign run by kw a ex employe. Your a fool to think that posting on here will get you anywhere. This forum has been 'bringing us Down' ext since 2010. Yet we are bigger then ever!

I'm within my rights to have an opinion. Your response to me on this site has provided me with no details, just like your marketing materials had no details on it (no address or phone number, no registered company details etc) - very strange from a starting point when you're talking to people about legal matters. And if you want to gain their trust. I would expect far more attention to detail in a company spouting the 'worst case scenario'.
You speak of a disgruntled employee - its called Whistleblowing and they are quite within their rights to ensure that your actions are highlighted. Sadly the age group you target don't have access to such methods to check the validity of a company.
Also, your website spouting on and on about scams and such - it doesn't exactly give those of us who are a little more savvy any positive indications but that you are speaking out to cover your backsides.
If you were legitimate you'd not need to state such rubbish on your site.
Seriously - think about it...
So here are my questions to you, as you are willing to act as a defendant of the outfit.
Are you registered with any legal bodies to provide this information, do you have any true legal qualifications to present your 'you will lose you home' tactics to people who are closing in on the end of their lives? Any qualifications as financial advisors?
I state bully-boy tactics as the wording used, the force to gain details from the respondents was disturbing to me. People act in trust, yet you do not fully disclose your own lack of qualifications or any validity when speaking with these people.
Based on the words used in the presentation, the chasing tactics and lack of professional qualifications - I'll call you whatever I like.
