I am a telemarketing compliance manager, and I asked her if she realized she was breaking federal law for making a telemarketing call after 9:00 pm local time. She told me those laws don't apply. In looking at their website, they are doing market research. How does that not equate to a telemarketing call??

They are not bound by the same rules as a telemarketer because research companies are not covered by the law. They are perfectly aware that what they do is extremely annoying. They make no apologies for this and basically tell you that they make these annoying calls because they CAN. I had a "researcher" argue with me over my assertion that what they do is invasive and rude. She would not give up.
I think it's noteworthy that what they do is not "marketing," per se but it is done by a private, profit-making company for financial gain (theirs). Thus, they should never have bheen given a set-aside from the dnc law. Their website does have a link that allows one to give them "feedback." I think everyone who gets called by these reprobates after they've been told NOT to call, should use this link to give them a piece of your mind. They deserve it for holding their callees in contempt.

Your chosen username reveals a contempt for the people receiving these unwanted calls. You advise the "complainer" to email the company. The people who are bothered by these calls should not have to take any action whatsoever to stop receiving unwanted telephone calls. When you call someone you don't know you may be calling a house in which a person is ill or dying. You may call a house where there is a sick child. You may call a house where a loved one has just left for their third tour in Afghanistan. You may call a house of someone who works all hours and needs the little time they have for rest to be undisturbed. The fact that there was a legal carve-out of the Do Not Call system for researchers does not mean that it is morally or ethically correct to make these invasive and unwanted calls.
Scarborough is not a charity. It is not a not-for-profit. It is a profit-making money who is rewarded financially for the companies they contract with. But their attitude, OMG's attitude, and the attitude of the rude woman who called me on 5/23/12 is that they have every right to make their calls until the victim takes action to make the calls stop, and even then you have to wait 72 hours.

Also, they need to get through the survey as quickly as possible. So if you have the free time, see how long you can keep them on the phone. Ask them their opinion on things, ask them the same questions they're asking you, whatever...and then when they ask the last 2 questions: how many live in your household and how old are you, give them ridiculous answers. It invalidates the survey.
They will ask if you or anyone in your family works for a radio, newspaper, television, etc. If you want to keep it short and not have them call you again, the answer is "yes." They will ask which? I said all of them, I'm married to Rupert Murdoch. They were going to end the survey but I told them I was kidding so I could find out more.
I kept them on the phone for almost a half hour. - bamaI didn't take their calls until I got a post card asking if I would take part in their survey on radio, tv, and newspapers. I agreed and we set up a time. I just finished a 20 minute survey with a very polite woman. She asked if I would be willing to fill out another part of the survey if they mailed it to me and I agreed. I had no problem with this call.
