    One more comment about Port Folio Recovery and other agencies, most states have laws in place where these debt collectors can try to collect money on old debts up to 6 years.  I think that is the norm in most states.  If they don't collect anything after that, then I think they have to stop.  But, you need to check with the law in your state.

    This company has been calling my home for about 3 years or more on a debt from Ballys dated 1998 or so.  They call about everyday even on Sundays which i thought was illegal.  The debt was from my husband, and it also it so old that Ballys wrote it off and it is no longer on his credit report.  Yeah Portfolio we will pay you $3000 so you can pocket it.  What a load of crap!!  What do they do with this money they collect?  Probably pay for all their mail they send out every f-ing day..Unbelievable!!! Oh...what I would like to do to these people...

    They're at it again.  Just got a call.  No message.  I no longer answer ANY calls on my cellphone (or land line, for that matter) if I don't recognize the caller's number.  I want to know how they get people's numbers?  Or is it just dial every number and hope they hit "pay dirt"?

    EVERY TIME they call report the call to the FCC. go to FCC's website and file a complaint. they will stop.

    do not talk to them at all, except to say do not call me anymore then hang up, if you answer at all.

    do not give any information, do not agree that you may have had any account they might call about. discussing any account, repayment plan, etc may, depending on your state, reset the clock on any old debt they are interested in collecting.

    a company of scumbags that will use any deceptive method necessary to collect. even going as far as just calling people with similar names in hopes of getting anything.

    It's funny how everyone wants to say what they are doing is not right, but I guess it is ok for you to rack up thousands of dollars in credit card bills and not pay it? That is STEALING! Why should I have to pay for my bills but you don't have to?!?!?!? Seems fair! Stop posting on here how the debt collector is wrong and take a look in the mirror, set examples for your children so they dont think everything in life is free. I am an average person who works 40 hours a week with a family to support but the difference is I know between right and wrong! do you?

    All the reply on this thread shares the same story.
    They are very old debt that has been closed by the original creditor and it is outside the statue of limitation "SOL".

    Since it is outside the statue of limitations, it is no longer recorded with the credit reporting agency and it is not impacting the credit score anymore.

    You may have seen it the after 12AM commercials "how to make money" they will buy a very old debt for cheap then try to collect and for sure not "all" but "somebody" will give them money and it is proved to be profitable.

    There is a good chance of reinstating that bad record back in their credit record if you give in to their claims of the collection that is SOL.

    Unfortunate things happens in life that may have caused the old debt.
    Mostlikely, the people on this thread have recovered and with a good credit standing - and that made it worthy to pursue.

    Bottom Line: Do not talk to the agent or give in to their demands.

    Lets sue these people!
    This is a collection company called, Portfolio Recovery. They call from a lot of different numbers, day, night, and weekends including sundays. The debt they're trying to collect from me is almost 15 years old, not on my credit, and WAY beyond the "Statute of Limitations" for the state it happened in and I think beyond any states limit of years they can legally try to collect a debt.

    So far they have called me from these numbers and I'm sure will use others in the future: 847-678-9710 / 757-961-3544 / 757-961-3546 / 877-803-0008 .

    I spoke to a lawyer and she told me not to asnwer their calls or talk to them at all because if you "acknowledge" the debt in some states that can waive the statute of limitations and they can then try to "legally" collect it from you. The Statute of Limitations to collect a debt is different in every state, even for credit cards, loans with contracts, repossessions, etc. but for most of all the U.S. it's 5 to 7 years with the exception of I think 11 years in some states.

    There's no law that says you have to communicate with a debt collector by phone. If you hang up on a debt collector there is nothing they can do about it. But, if the collector continues to call you repeatedly even after you have hung up on them, they are in violation of the FDCPA.


    My lawyer said, if I answer the phone, tell them to stop calling me, I do not owe any debt. To let them know I am recording the phone calls. She said if it gets too annoying that I can have her send them a letter to "cease and desist" their calls.

    In the letter, you should state that the collector should cease and desist further communication with you.

    You should know that the cease and desist letter only applies to debt collectors (the collection co. calling you driving you nuts), not the original creditor (so if it's the "original creditor" calling, they can try to collect their debt).

    Once the collection agency receives your cease and desist letter they can communicate with you once more, via mail, letting you know one of three things: that further efforts to collect the debt are terminated, that certain actions may be taken by the debt collector, or that the debt collector is definitely going to take certain actions. (in which case they can't touch you if the debt is beyond the statute of limitations.)

    When you send the cease and desist letter to the debt collector, send it via certified mail with return receipt requested. This will provide proof that the letter was sent and received. If the debt collector communicates with you beyond the single instance allowed by law, this evidence will allow you to seek punitive action against the debt collector.

    Even without sending a validation request, debt collectors have certain rules they must follow when it comes to contacting you over the phone. For example, they can't call you before 8 a.m. or after 9 p.m. your local time. They can't call you repeatedly, and they can't call you at anytime you've previously stated is inconvenient.
    If a collector calls at a bad time, simply say, "This is not a convenient time" and let them know specifically what time is convenient such as between 4pm and 5 pm (then don't answer their calls when they call you at that time). Also, record the conversation and let them know you're recording the call (if you asnwer the call, that is). That way they know you have proof that you let them know when is and is not a good time to call.

    These people have been calling my UNLISTED FAX machine and hanging up. I've had this number for well over 5 years and have, in the past 6 months or so, started getting multiple calls per day. I finally had to do a *69 to get the calling number and call them back long distance at my own personal expense to have them stop the calls. The calls were causing my fax machine to get into some strange state, requiring a complete reboot. That makes it rather useless for receiving faxes while I am out of my office. They claimed they don't use an automated dialer. Why in the world couldn't they figure out that it was a fax then? Hmmm... Picks up on first ring ALWAYS and screeches in your ear. Apparently someone at some point in history had my fax number or just made it up and now has bad debt. It cost ME money to fix. That ain't right.

    I keep getting these calls and have never answered. Thank god for caller ID and the internet. So after finding out these a**holes won't stop calling me for a debt I paid off and closed in 1997, I decided to answer the phone call this morning. Which of course came at exactly 9:01 am. They asked for Carrie(me), and I told them that Carrie passed away a month ago. They did not even say sorry to bother me or anything, they just hung up on me. Then about 20 minutes later, the same number comes up on my phone, so I answer it again to see what part of the first reply they didn't understand. They are now asking for my 21 yr old daughter, who has no debt. I think they are trying to bug her about it now. I am pretty sure that this is very illegal, and I think I am going to have to take action against them now. Before I just thought it was funny that they were that pathetic, but my daughter should not even have to deal with any of this crap. They have now crossed that line.

    constant calls three four times a day.  Answered once and they were collecting a debt that was not mine.  Told them and they call again and are rude and say nasty things.  wILL NO LONGER ANSWER THEM

    Got a phone call from them today and they asked for someone who isn't me -- maybe an old cell phone #.  Found this link about the same company (?) being sued by the Missouri State General Attorney's office.  Thought some of you might want to know...

    Check the laws in your state regarding "Time-Barred" debt.  Creditors and Debt Collectors are not supposed to go after you for ANY bills that are over a certain amount of years old.  If you make any negotiations to pay the debt it will REAPPEAR on your credit files.  After so many years any unpaid or collections bills come off your reports and that helps to boost your score back up.  BUT if you talk to these people and work out any payment plans, it will go back on and shoot your scores way down!  Do not listen to them if they say there is no such law and that they have done their own research and their finding are correct regarding old debt. Everyone should be notifying the BBB (Better Business Bureau) and file a complaint against this company for not only harassment, but fraud and any other thing you can think of under the laws.  Those who have been affected should make arrangements to file a Class Action Law Suit with a respectable attorney who handles these kinds of situations.
