    Another MotorTrades Victim
Had I not witnessed the absolutely shocking telephone tactics used by Motor Trades Ltd personally, I would never have believed any of the claims made here by other victims of this so-called company.  I heard just one of several telephone calls made to my employer recently and I have never heard anything like the level of abuse that was leveled at my boss by the representative from Motor Trades Ltd.  I felt literally like I had just been 10 rounds with Mohammed Alli - and I was simply witnessing this shocking dialogue.  The bullying tactics were outrageous!  I can fully understand the anger expressed by other victims both here and elsewhere on the web.

There seems to be a gulf sized difference between the manner in which customers are spoken to on the phone and how the "customer services" would like to be perceived in writing here.  The standard message seems to be that Motor Trades Ltd is very keen to resolve any issues and invites all complainants to contact them via phone to sort any issues out.  This wouldn't be a problem if it wasn't for the inability of the people tasked with manning the phones at Motor Trades Ltd to converse with anything other than chronic aggression and intimidation.  It seems that the business ethos is to send the "heavies" in whenever anyone disputes the unexplained hike in fees between year 1 and year 2.  It was from £400 to £1800 in our case (which included the pressure selling discount which needed to be "taken immediately or else!").

I can thank Motor Trades Ltd for one thing - we have all learned a very expensive lesson in all of this - and when they eventually get closed down and that really is just a matter of time - they and going to find it a lot harder work to find gullible idiots like all of us next time around.  I was told by one of the authorities I contacted in this matter that sadly people like Mr. Jakes and Mr. Corby are a bit like the phoenix in that when this venture folds they just start up another doing the same thing.  Let's all just make sure that we've learned this lesson well - they won't catch me or anyone I work for ever again ;-)

Keep reporting your experiences - the noose is tightening and the more victims speak out the more likely it will happen sooner rather than later.

To Motor Trades Ltd - who if they follow their usual tactics will respond to this entry:  No! I do not want to contact you to discuss any issues that I may have.  I "opt-out" of your bullying tactics!  You should perhaps consider that 'where there is smoke there is a very good possibility there is a fire'.

Another Motor Trades Victim replies to vince
    Vince,
I can only suggest that you read all the posts on the following sites (there are also many others) which will give you a great deal of interesting insight into the modus operandi of Motor Trades Ltd.  The victim posts are all pretty much the same as it seems the bullying, verbal abuse and heavy handed tactics is universal, as is the huge unjustified and unexplained increase in the rate from year 1 to year 2, but read them all and one or two do provide some ideas of who to contact for assistance.

Surprisingly it is the replies written from Motor Trades after every victim complaint that offers the most insight into what you need to do when one of their customer representatives calls you on the phone.  I’m not so sure about the bit where they ask you to call them on a direct number to talk to a nameless operations manager, as it seems all you seem to expose yourself to is yet more verbal abuse.

The interesting bit is the little details they share.  From what they say it seems that in order for this “auto-renew” to be valid they need two things from you, firstly they need a “yes” or agreement over the phone (they tape these) and then they need you to ‘e-sign’ the email contract that they have sent you.  This happens automatically when you open the contract they email you (again this is recorded by time, date, IP Address etc.)  From what Motor Trades says in their responses to the victim claims, the e-contracts are not valid without this - regardless of what they seem to be saying in their terms and conditions from the first year.

    All I can suggest is:
    1. DON’T LET THEM GET HOLD OF YOUR MONEY!  Immediately cancel your over draft, move all funds, cancel any credit cards of any account they hold information on.  Contact your banks fraud division.

    2. DO NOT accept, agree to or say ‘yes’ in any way to the bully who phones you up to renew your advert.   It's the reason he's continually calling back.

    3. DO NOT open any emails from them as several people claim to have been duped into e-signing their e-contract this way.

What is the most shocking of all this is the brazen confrontational style the Motor Trades Ltd representative uses when he phones.   His goal is clearly to intimidate you into acting quickly, without  any time to think rationally about what he is saying or more importantly, what you are doing.  All he wants is for you to say ‘yes’ so he’ll then go away.

From other posts on here it looks like perhaps the winds of change are blowing?

    To Whom It May Concern:

We’d like to make clear the way that our order process works and try to clear up any confusion that there may be with regards to some recent postings.

    1
Our standard agreements contain an automatic renewal provision, just like agreements with BT Customer Street, ufindus.com and many other internet providers including many internet services offered by Yell.com and BT

    2
This is made clear in the contracts and agreements issued at the point of order

    3
Reminders are issued throughout the term of the agreement to remind people of automatic renewal and to tell them how to cancel the provision if they don’t require it

Automatic renewal can be cancelled quickly and easily by email if this element of the campaign is not required.

    4
When a renewal approaches, we mail a specific renewal pack out, using a letter worded and prescribed by Trading Standards – this letter ensures that no legislation is breached, and makes clear how the renewal can be cancelled

    -    This pack provides a further 21 days for the automatic renewal provision to be cancelled with no obligation to renew should you cancel the provision at that stage
    -    If you do not contact us within 21 days to withdraw your right to the renewal or to the extension of the agreement, we will bill you for a further term in accordance with your signed agreement and contract

Our standard rate card prices have not changed since late 2011 and have not increased on a like for like basis in almost two years.

    5
If you have received a telephone call from our Sales team regarding a new order, and you do not wish to proceed with the order, you should open the electronic agreement on your PC, Smartphone or Tablet and press the REJECT AND CANCEL facility

    6
This cancels the order and no contract is formed, and nothing can, or will be billed to you

    7
If you wish to proceed with the order, when you have opened the contract, press the ACCEPT AND SIGN facility – at this stage a contract is formed and you will be billed

    Our sales process is robust, and protects both parties to the agreement. The purpose of the recorded confirmation call is to confirm the salient terms of the order prior to the electronic agreement being generated, and to ensure that the agreement is produced correctly and with accuracy;

There is a clear choice when the electronic agreement is opened and downloaded – to either REJECT AND CANCEL or to ACCEPT AND SIGN – if you do not wish to proceed for any reason, simply click the REJECT AND CANCEL facility.

If you have any direct complaints, the best way to resolve the position is to contact our Operations Team directly, which you can either do by email to operations.manager@motortrades.co.uk or by calling 01277 89 77 70 asking for Operations.

Our Operations team is not faceless, they will do their best to assist, and a member of the team will be happy to help.

We hope that this has clarified the position, but as stated, we will be happy to help any complainant on a one to one basis.

And finally, we should keep things in perspective, we have over half a million on-line listings live, and any operation of that scale, will inevitably, have a number of unhappy customers. We are aware of around 50 on-line complaints, which represents 1 in every 10,000 or so listings.

    Yours faithfully

    Operations

    To Whom It May Concern:

If a Customer does not wish to make a new order, or has changed their mind prior to e-signing, they should reject and cancel their e agreement.

If a Customer wishes to cancel an automatic renewal, they should simply email us and cancel the automatic renewal by emailing operations.manager@motortrades.co.uk quoting their agreement number.

If a Customer receives a renewal pack through the mail and they do not wish the contract to renew automatically, they have a further 21 days in which to cancel the automatic renewal.

All agreements are signed at “arms length”, we do not deal on a face to face basis with Customers at their own premises and therefore, we are unsure as to how “bullying” could occur.

Any genuine customers with an issue that requires assistance or a resolution simply have to contact the Operations team who will do their best to assist and resolve the matter.

    Yours faithfully

"How to... Defend a small claims case
We've come across numerous cases of conmen who unfairly demand payment for goods or services, and threaten to sue if not paid.

Small businesses are often targeted, being told they've ordered ads in publications they've never heard of, or have ordered an entry in a business directory.

The conmen behind these scams often threaten legal action, but a hearing in open court (with us on the Press bench and Mirror photographers waiting outside) is the last thing they want.

Remember, if you haven't ordered something, a court is unlikely to make you pay for it.

You should write to the person demanding money explaining why you will not pay. Send the letter by recorded delivery and keep a copy. Should the case go to court you can use this in your defence. A solicitor is not necessary.

If you do not owe a debt, do not be cowered by threats of having your credit rating ruined if you don't pay. Even if you lose a case in the small claims court, your rating will not be affected if you pay in full within a month."

"BT Customer Street – complaint about direct marketing

    July 21st 2009

This related to a sales call during which a consumer agreed to sign up to a three month trial period. The consumer did not wish to proceed beyond the trial period, but claims monies have been taken from his account without his consent. This complaint was upheld as it is a breach of direct marketing standards not to address consumer and business complaints. Complaint upheld.

If you believe a DMA member is in breach of the Direct Marketing Code of Practice then contact the Direct Marketing Commission – you can alert us to an issue you see here http://www.dmcommission.com/make-a-complaint/complaints-form/ "

"Members turn to IAAF for help with Internet directory problems

    21 Jun 2012, 11:03

IAAF members have been contacting the Federation offices concerned about arrangements they have entered into with the specialist Internet directory Motortrades.

To help them, the IAAF has been giving advice and links to the Federation’s 24 hour, 7 day per week, legal hotline. In addition IAAF Chief Executive Brian Spratt has been in contact with Motortrades on members’ behalf and, so far, has successfully concluded an amicable resolution to a member’s problem, with work ongoing on behalf of other IAAF members.

The reaction follows concerns surrounding Motortrades, which were the subject of a warning by legal firm Lawgistics. Of particular note was the section of Motortrades standard terms and conditions which required their clients to cancel their contract 60 days before the anniversary date. If not the agreement will, apparently, automatically renew; but not, say Lawgistics, at the same ‘introductory price’ previously paid.

Lawgistics warned that the directory firm would then contact the client by phone and demand payment of, what they report as “an exorbitant sum, possibly as much as £11,000”. The legal firm recommended that under no circumstances should clients make any payment, as “it will not end the matter”. Instead Lawgistics suggested concerned companies should contact them as they are collating a casefile about the firm.

The queries to the IAAF appear to confirm the contract terms, although the sums for renewal have not reached the levels reported by Lawgistics.

Brian commented: “We have spoken at length to Motortrades, who have expressed themselves willing to examine clients’ complaints and attempt to resolve any issues. This has been successful in the first instance we presented to them, and we’re hopeful that it will be the case with other members’ problems. In the meantime, any members using Motortrades’ directory service should make sure they know the deadline date for cancelling the arrangement, should they wish to do so.”

Members with concerns on this topic should contact the Federation office for advice or for details of the Federation’s legal helpline."
