Every week, Tony Hetherington replies to readers' letters, adding comments, advice and the results of his enquiries.

Minster Legal Services UK Limited explained about putting our property into a family trust so it could not be used for care fees, and my wife and I paid £1,995 for a trust deed to be prepared.

That was in February, but we have received no deed.

I am wondering if this is a proper, legal company or have we paid almost £2,000 for nothing? D. G. G.

Minister is a properly registered company, but that is where the good news ends.

The business operated from offices in Gainsborough in Lincolnshire and advertised a will writing service as well as drafting trust deeds. It was set up in April last year by Andrew Young and Martin Smith, but within a couple of weeks they handed over day-today running to solicitor David Hodgson.

The watchdog Solicitors Regulation Authority was already investigating Hodgson and in September it decided he was not fit to run a law firm alone. It ruled that he had to have at least one partner or work as an employee.

However, this had no impact on Minster, because as the law stands anyone can draft wills and deeds with absolutely no qualifications or experience. And Hodgson's running of Minster became academic anyway, when he died in February, a fortnight after you paid his company £1,995.

And this is where things get really murky. For according to Companies House records, Young and Smith got rid of their shares in Minster several months ago and now operate a different will writing company. Minster is run by Gerald Malcolm Barton, who became the sole director a few weeks ago on May 9 and was already behind Minster's website.

Ten years ago I reported how thou-sands of wills belonging to customers of his JHD Associates had been dumped and in 2008 Barton began an 11-year ban as a director over the subsequent failure of Nationwide Legal Services. Last year he was even jailed for eight weeks for breaching legal undertakings connected to the liquidation of NLS.

Against this background, he could be looking at a long stretch inside if he took on a new directorship. And last Thursday, Barton, who lives in Lincoln, denied any wrongdoing.

He told me: 'There has been so much rubbish going round for the last few days.' He is 'absolutely not' a director of Minster, he added, and he claimed that someone falsely gave his name to Companies House.

The real problem is that there is no legal control over who can draft wills and deeds. Brian McMillan of the Society of Will Writers says: 'There was a time when the profession was small and relatively clean.' Now he feels stronger powers are needed.

The Society does set standards for its members, but Minster was not one of them. Nonetheless, McMillan and his colleagues have taken over a lot of Minster's paperwork in an attempt to help its customers.

So where does all this leave you? On paper, Minster still exists. It might be worth instructing a solicitor to sue the company, though there is no way of telling from the outside whether it still has any money in the bank.

McMillan believes that some Minster money has ended up in an account in Spain.

On the other hand, who could have emptied its account after its only director died? The whole affair cries out for an investigation by the Insolvency Service's Companies Investigation Branch.

SAGA LEGAL SERVICES/MINSTER LEGAL SERVICES

We wish to warn clients about the activities of these unregulated Will writers who have been trading on the reputation of the Saga Group (which provides services for the over 50’s) and which have been targeting elderly people with unsolicited personal calls persuading them to sign up to various legal services and obtaining substantial payments in advance. We have personal experience of this because one of our own clients in the area was unfortunately persuaded by one of their smart and well-trained salesmen to part with a cheque for £4,500.00. Her instructions had been cancelled but they have failed to return the monies. They have informed us that the sole proprietor has died and that the activities of Saga Legal Services have been transferred to Minster Legal Services, which operates from the same address.

The Saga Group has informed us that they have received information that over 50 individuals have been misled or duped into handing over money. They have reported the matter to the police and Lincolnshire Trading Standards. They instructed their own solicitors to write a “cease and desist” letter and they strongly suggest that our client insist that the police prosecute the people involved.

Can I ask if anyone can give me the address/wherabouts of a Miss Christine Crombie of Gainsborough? As a representative of Minster Legal Service she scammed nearly 2k out of my elderly parents in Hull and I would like her to explain herself to me and my family in person. Not surprisingly my parents have never received anything from Minster, they handed over all that money for nothing and I would dearly love an explanation from the woman responsible.

I can confirm Minster Legal Services have changed names and tried to make out the company has moved however this is not the case, they knew they was going to be found out therefore wrote a letter to all existing clients advising they had moved when in actual fact they have just changed names. Trading Standards are fully aware of Minster and everyone who works there knows how dodgy the company is. The man in charge (Gerald Barton) uses his daughters name to try and hide away because he knows he is ripping old people off. I am sure no one who works there would like it if it happened to their families, yet they make out they have a geniune company! You only have to type Geralds name in google to see what kind of person he is and what he has done in the past.

I understand from Trading Standards that they are investigating National Legal Assistance/Saga/Minster Legal Services and Mr Barton plus key staff currently at Mercury House in Gainsborough and that I am unlikely to get my parents' money back.
The Society of Will Writers have told me that they will finish the work for my parents; but I would like to hear from Christine Crombie personally about how she can work for these crooks and how she sleeps at night knowing she takes money fraudulently from vulnerable elderly people who trust her. I have been reading this forum and I hope that someone can help me contact Christine Crombie to get her to explain herself to me.

Just out of curiosity here....has anyone actually tried to contact someone from this company to see if they can help? I have read through the comments and can't see that anyone has actually tried. The number is written on almost every page of this thread, surely someone must have tried?

Yes, in fact we first contacted them when we realised things weren't quite right back in December.  Since then we have communicated numerous times with them and have got absolutely nowhere.  Once their director died they gave up all responsibility for the work they should have done.  Our dealings have been with Minster Legal Services, then Saga Legal Services, then National Legal Assistance and also Express Law and the answer is the same from them all, we cannot have a refund of the money we paid in all good faith last September.

Try contacting Saga/NLA again (whom are nothing to do with Minster) and I am sure someone will deal with your queries, hopefully to your satisfaction.
