European Mediation Services Limited and Probate Solutions Worldwide Wills and Trusts Limited both wound up in the public interest

European Mediation Services Limited (“European”), based in Kidderminster, and Probate Solutions Worldwide Wills and Trusts Limited (“Probate”), which traded from premises in Lincoln, were both wound up in the High Court last week following an investigation by The Insolvency Service. Both companies were in common ownership.
‘European’ was a claims management business created to pursue claims under the Consumer Credit Act 1974 on behalf of individuals who had been mis-sold timeshares or property in Spain; although its business subsequently expanded to include other forms of recovery under the Act. In return, ‘European’ received either a fixed advance fee or a success-based commission.
Even though the company director of ‘European’s’ failed to co-operate fully with the Company Investigations team or deliver up all of its trading records, it was established that ‘European’ had:-
failed to account for monies recovered on behalf of its clients;
failed to keep adequate trading records, making it impossible to fully account for the receipt and payment of almost £½ million; and
failed to declare insolvency.
Furthermore, during the course of the investigation, the director caused ‘European’ to cease trading without taking any steps to regulate its affairs.
Probate Solutions Worldwide Wills and Trusts Limited, known as ‘Probate’ was the second company wound up. ‘Probate’ was marketed a franchise-style opportunity inviting individuals to learn how to take legal instructions from members of the public for the preparation of a range of legal products including wills and power of attorney.
The investigation found that ‘Probate’s’ business model was very similar to that of other companies previously investigated and wound up in the public interest in 2007 and 2008. Also that ‘Probate’ had adopted many of the practices the court had previously found objectionable. In particular, that misleading and inaccurate statements were made to prospective franchisees during the recruitment process, particularly in relation to potential earnings.
The Insolvency Service investigation found that ‘Probate’ failed:-
to keep accurate accounting records and as a result cash receipts and payments could not be accounted for;
failed to prepare accounts as required to by law; and
that it was abandoned by the director during the course of the investigation.

KW - K W replies to K WTo all Readers SOMETHING TO THINK ABOUT BEFORE YOU AGREE TO A HOME VISIT, If Express Law, National legal Assistance and any other aforementioned company can offer FREE advice on legal matters, because thats what they claim, who do you think pays for all the Telephone operatives and the telephone bill as this must be enormous 8 hour days 5 days a week 20 operatives, the stationary, the other office staff, the premises?????? we could go on, so it is NOT FREE YOU WILL HAVE TO PAY and likely more than you need to.
You could always agree to the visit and make them waste their time so it costs them. Just a thought!!!

KW - K WTo all Readers isn't it astonishing that the sales incentives at Express Law are usually bottles of vodka, cheap wine and pizza late in the afternoon, the list goes on and during the day Alana Benson cracks the whip and orders the operatives to up their targets on the telephone i.e. more appointments.
A few weeks ago a man parked up in the car park outside Express Law in broad daylight & masturbated in full view and then jumped out of the car dressed as a fireman and went into Express law to deliver his stripogram act - such class!
So is this what the clients of Express Law are paying for? Your humour!!! What a disgrace.
Because when a gentleman that you duped came looking for a refund you ushered him out of the offices and into the car park so fast telling him that the cooling off period of 7 days was up and he couldn't have a refund, although it was 14 days later he hadn't got anything for his money.
Please be advised if you have a meeting with an Express Law Consultant ask how long will it take to receive your documentation? If you have not received what you have paid for you have every right to go to the Police.
Is it also a coincidence that the one bad review for Express Law on Yell.com (see the first comment on page 18 - https://whocallsme.com/Phone-Number.aspx/01427858331/18) has been removed and replaced by 2 good reviews on the same day, you decide.

The council's Trading Standards is warning people to be wary of adverts and cold callers selling will writing services.
In recent months a number of people in North Lincolnshire have reported being conned into parting with hundreds of pounds to companies using door-to-door salespeople.
The cold callers promise people cut price wills, storage of wills, lasting power of attorney and property trusts that turn out to be anything but.
They frighten people, often older, into thinking that all their assets will have to be spent on their care and they then claim to offer free advice on how this can be avoided.
But the costs of the services offered can quickly spiral into hundreds of pounds and they often insist on being paid there and then.
According to some reports, the cold callers have also taken away hard to replace original documents such as birth certificates and not returned them.
People who have parted with their money might never receive the legal papers promised to them.
Those that do can find that the document supplied is not worth the paper it is written on.
Consumers are reminded that they have rights when buying from salespeople calling at their homes and have a seven-day cooling off period for any agreements made.
Legitimate businesses should have paperwork that identifies them and details of the cooling off period.
If you are in any doubt, do not agree to any offers and do not hand over any money there and then.
Will writing firms are not regulated by the Law Society so there are few safeguards if things go wrong.
Some people will have access to free legal advice regarding wills through their insurance company, trade union or other organisation.
Explore all options such as contacting local solicitors before entering into any agreements.
Cllr Nigel Sherwood, cabinet member for Highways and Neighbourhoods at North Lincolnshire Council, said: “North Lincolnshire Council Trading Standards has received 13 complaints, including one yesterday, since February this year where people have been paid between £1,200 and £2,000 for legal service that have not been provided.
“If you think you might have been conned in this way report the company to Consumer Direct on 08454 040506.
“They can give clear and practical advice on how to try and resolve the matter.”

• Watch out for “sound alike” names confusing their services.
FINAL WORDS OF ADVICE – Any trust should be created only after a thorough review of your tax, estate, and personal goals. You need to talk with your team of professionals perhaps an accountant or financial advisor to make an informed decision on whether to create a trust.
You can’t take it with you and you can’t change your mind, so draw up a professional will and trust.
