Boy, I wish I came accross this website earlier. Yep, I’m a sucker too, purchased their product late 09. Just like you all it kinda sounded ok, I even asked to view the conditions before I signed, something I’ve always done. But I had a moment of weakness. Naturally they didn’t provide any details, they told me there was no contract easy in, easy out. Well until you signed up and paid the first months bill. Then you are hit with the “Welcome Pack” which is in fact a contract. But I haven’t signed anything. So is this contract bound legally? I’ve cancelled but still have no confirmation that this request has been processed. Apparently I’m now a couple of months in arrears of payment and now have to pay or be theatened with credit collection. I’ve changed my credit card details, hence no more payments to them. It didn’t feel right from the start and cancelled my card early in the program, -my search phrases didn’t list my business until I emailed their technical people, about 5 days it took. And on some days my search phrases didn’t even list my business at all. I've kept screen dumps as proof. So... always trust your gut! Now, what is the best way out of it, I'm from Australia. Any businesses from Oz in the same position? I've been told to threaten dotcom chrome with Australian Securities and they will not bother me again? Has anyone had any luck with this? What is the feedback? It seems like a lot of business owners are complaining to their countries consumer watchdogs but I can't beleive this company is still trading. It doesn't sound like we, the customer is winning the fight. What can I do to help?

We are a company in oz actually looking to hear from other businesses who have been ripped off, to build a case against this "company". Have you received a letter from a debt collection agency, here in australia? If anyone has please post on here anonymously and I can give you the contact person, to explain your situation. (as we'd hate for dotcom to harrass you any further. and nobody needs to waste their time any further with their pathetic games) The more genuine businesses they hear from the better, as they need to be aware of the "company" they are dealing with, in order to help us.

Strength in numbers.......Lets nail their ass** to the wall.

I tried to get out of paying my payments which were in arrears but after i refused to pay the collection agency they took me to court and I now have a ccj against my name, there are 2 things you need to think of when trying to fight them in court:

1: the recording- they record the second conversation where they read their "online agreement to you"
2: the welcome pack- if they can prove in court that your recieved the welcome pack then the terms and conditions are deemed as served. Doesnt matter if you signed them or not, the fact is you read them and didnt detest them which apparently means that you accept them ( according to the judge in england, may be different in oz)

Ask them for a copy of the recorded contract, ask them how they sent you the welcome pack to you ( if they say first class in the mail, again this is deemed as served) if they say second class then you can say you didnt recieve them, and then you only have the recording to worry about

the terms of service say your ads will appear each day for a month, this could mean once per day so like my situation you may have screen shots that show your adverts were not present on a particular day but it wont help.

take the recording and the terms to a solicitor and make sure you get a better one than me. I am still refusing to pay the courts despit the ccj and am even considering moving house for when the county court bailiffs arrive. Whatever happens, i dont care what the courts say im not paying them

also in my case,  dotcom had a document from google and a sworn testimony from one of their adwords managers , the statistics for my campaign, how many hits, impressions, positions on page, how long each day the adverts were shown etc...., now either google are in on this with dotcom or my computer was playing up because i very very rarely saw my adverts, certainly not the 87% ofthe month that googles statistics said they were showing

either way they are not getting another penny out of me

Dotcom Chrome sell their debts to debt collection agencies, so they really don't care whether you pay or not. You're not fighting them, you're fighting a debt collection agency.

The online agreement does not include much of the material in the Welcome Pack.

It would certainly not be unreasonable to attempt to cancel the contract immediately after receiving the Welcome Pack.

Though the Welcome Pack states "ads will appear a minimum of five times within the first month" the issue is what the salesman on the phone told you you were buying.

Mine told me:

1 - He was from GOOGLE CHROME.
2 - My ads would appear on page 1 every day, unlimited 24/7 for a month.
3 - He clarified, several times, the exact keywords I would get. This was the crucial selling point to me. He also clarified they were Australia-wide when I explained I didn't want area-specific words.
4 - What the wording of my Ad would be.

When I recorded the verbal agreement, I thought the lady said "Google.com Chrome" and she didn't mention anything about frequency of ads or what the keywords were.

The Welcome Pack arrived and I discovered:

1 - They were not from Google Chrome at all.
2 - My ads would not be appearing 24/7 unlimited clicks. In fact, it wasn't an unlimited click campaign at all.
3 - The keywords they chose for me were different from those I confirmed with the salesman.
4 - The Ad wording was embarrassingly wrong.

Within 10 hours I cancelled, within a day I was told no refunds would be issued as they'd delivered all they promised, within a day or two I was receiving abusive emails and threats.

Unfortunately, though government agencies are good at logging the number of complaints against these sort of companies, they simply will not do anything to shut them down.

Dotcom Chrome is not an authorised Google AdWords Professional, as their certification was taken away from them some time ago, but AdWords is happy to continue taking money from them so don't expect them to do anything about it. In fact, Google have said that anyone can run any ads about any companies, even competitors, so I wouldn't be surprised if someone started running Google ads for Dotcom Chrome leading consumers to a competitors site instead.

It really is up to consumers to act against them.

Maybe someone will hack their site?

For a company to have this many complaints

and still be able to continue trading is a sad state of affairs and shows up the true incompetence of the UK Trading Councils and relevant authorities set up to "protect" consumers.

Another 7 days on google adwords with the best keyphrases for my industry according to dotcomchrome with same titles and still no clicks and they are supposed to be internet marketing gurus and to cap it all 14 days on broad matches and we have only had 11 page impressions.

so in other words the service you provide in your own words is crap due to the fact that dotcomchrome gave me the keywords which were the best for my industry .No clicks on ads in 14 days on all 5 of your keyphrases means no business for me .I myself have found better keywords than your company have provided which have resulted in work and i dont profess to be a marketing guru

Well customer service to prove a point i am using the same keyphrases titles and ad that WAS USED ON MY FIXED FEE AD CAMPAIGN RUN BY DOTCOMCHROME  so get with th programme numpty .And had no hits in 14 days so as i say i have therefore had no calls and your supposed to be marketing gurus and all the keyphrases were given to me by dotcomchrome as being the best for my industry .

We sued this company in the small claims court today in Manchester  and won our case. Jamie Mcdougall couldn't even be bothered to come and defend himself or send his so called fantastic soliciters. We were awarded a full refund of the £430 he had conned out of us and costs including interest, petrol and parking fees What a fantastic result. we are really pleased just to have proved our point and for the court costs of £80 I would reccomend any body else to do the same. If you want any advice of how to do it let me know through this site and I will give you some advice I represented myself and didn't need a soliciter.

I'm very interested as I, like many others want to defend our consumer rights. So gimme the heads up!

Take jamie mc dougal of dotcon to court its cheap as chips to do it only costs £40.You will win because I no of someone who has just won and claimed all the money he stole from him plus expenses and court costs.The little bad mouthed wimp will not attend the court because he knows the police,trading standards and google are all watching his every move and he is in the wrong.
Report all threats to your local police and inform trading standards of your case.Then look into small claims courts.When you win give him 14 days to pay then hand the case to a debt collection agent who will be able to take goods to the value of to [pay you back,they will also add to the total and he will also pay them for the privalige of repoing his assests.Its not the money its a principle thing.THE MAIN THING IS TO ENJOY DOING THIS TO A VERY UNPROFFESIONAL RUDE PERSON WHO HAS HAD HIS DAY.

Does anyone know whether this 'voice recorded contract' DCC keep banging on about does actually have any power what so ever? The 'Welcome Pack' says you can cancel by email so I don't understand what leg these guys have to stand on - obviously none judging by the fact they appear to be losing all the court cases, but if anyone could tell me whether this voice recording does actually hold any power as they are saying, I would appreciate it. I guess its just another of their lying scare tactics......

It's simple just launch your claim via moneycliam online.gov.uk complete the form and pay the £35 fee keep the information basic and factual you can not sue for bad service and bad attitude but you can sue for not providing a service or taking money out of your account without permission remember to also state you want to also claim interest under section 69 of the county courts act 1984 at the rate 0f 8% per year. If you want me to send you my copy let me have your e mail address and i will e mail it to you. The rest is pretty straight forward they send him the form and ask if he wants to defend and on what grounds he returns it stating his defence and asking for it to be moved to Manchester it is then passed to Manchester and a court date is set at that time you have to pay £50. You will get threatening e mails and calls from Jamie but just ignore him he is making half the stuff up. If you are a little unsure see if you can find a soliciter who gives a free consulation hour and they will just give you some advice on what is legal and what isn't but don't worry because he won't turn up in court so the judge makes a decision based on your evidence. I will help you at each stage and give you advice in pulling your evidence together.
