I'm ex-directory and TPS registered and so far as I'm concerned there has been a breach of confidential data.
marcus (marcus.lashley@curvedairms.co.uk) informs me that their automated calls re,. market surveys do not breach TPS rules -- if so something needs to be changed.

An option was given to press "9" to opt out and then my number would be withdrawn from the database.

Why the hell you think it fine to blind call people at random in the evenings last one 20 min ago for myself.
Your "opt out" (press 9) is obviously fake and all it serves is a confirmation of a "live" number so it can be sold to other scammers for more than a unchecked list.
Your "business" is barely better than organised crime and the fact you are allowed to operate at all is shameful.
If you truely were a respectable company you would post your real name, and real contact details of you company and not try to hide them as you do now.- Caller: Scammers

- Dave from WiganWell I got one these "have you ever purchased an elecrical item purely for its energy rating" calls on 2nd. My voicemail picked it up and the automated message gave up after not getting a response to requests to push buttons. (Scottish voice BTW)
I have to say I think these people are total scum.
My phone number is not in any directory as it is SIPGATE VoIP number. It is NOT a landline of any type and these feskers have sod all right to contact me.

- Annoyed.comEven hanging up doesn't work!! When I get these calls and the automated bit kicks in, I put the phone down. Pick it up a few moments later to add to my Choose to Refuse list and the message is still going on. How come putting the phone down does NOT disconnect the call but allows the message to keep playing? Surely that must be against the law?

- Informed| 1 replyEx directory means just that - you are no longer in the phone book. No-one uses phone books to "get" your number - they use random digit diallers. Its not illegal, or immoral - you are, after all connected to a public network. It is annoying, don't get me wrong but please stop whingeing about being called. TPS is solely to stop sales calls as it says on the agreement you signed up to. If you dont like it, dont answer the phone! Or better still, get rid of your landline.

When we were having a problem with similar circumstatnces recently I got the following advice from the Market Research Society (in 2 emails):
It is correct that genuine market research calls do not have to screen against the TPS list as that list exists to prevent unsolicited calls for direct marketing purposes. It is the advice of the TPS and MRS that if you do not want to receive such calls, inform the caller to remove your details from their call lists. It is important to note the name of the organisation that calls you as if they continue to call (and have MRS members) MRS can contact the organisation involved in line with the MRS Code of Conduct. It is also useful to obtain the name of the organisation calling as marketing companies may conduct 'sugging' (selling under the guise of market research) exercises in an attempt to avoid the TPS list and should be reported to TPS accordingly.

I would suggest reporting this organisation to TPS – it really does appear that these are unsolicited sales/marketing calls. It is a legal requirement that all organisations (including charities, voluntary organisations and political parties) do not make such calls to numbers registered on the TPS unless they have your consent to do so. - JezzJust had several calls from this nuisance caller over the past few days. I refuse to call them back to add my number to a 'don't call' list, a) because I would have to pay for the call and I don't see why I should pay for them to b) add my number to a list when they shouldn't have it in the first place!
One very useful tip: it is the telecoms operator "Thus" who owns the phonenumbers for this company. I intend to complain to Thus about the nuisance activites of one of their customers and report them to Ofcom also.

For example, I input 0845 030 4416 and I am told that Thus owns this number. Click on Thus and I'm given contact details. As other users above have commented, they are essentially making sales calls hidden by a thin veil of marketing in order to circumvent the TPS regulations. Having worked in the telecoms industry I know that if enough folk complain to Curved Air's telecoms company (i.e. Thus) that their customer is abusing their line and making nuisance calls, Thus will be compelled to do something as they would be held partly responsible.
Also I just contacted Curved Air on their 0845 050 0344 and spoke to a chap who ostensibly appeared to be helpful. I basically asked him where they got my number from and he said he would investigate and let me know; it appeared the client was using their own list and not one which had been created by them. He said he would find out and let me know. I'll let you know what happens.

Do not take my word for it if you phone that number you will hear the final deception at the end of a "so called" Market Research.
You will also get the same end result if you log on to their website and use the "Contact Us" tab.
Worse is that their selling method is by recording this effectively blocks the telephone line of the unfortunate reciprient untill their recording runs out. which takes some minutes.
That is extremely frustrating if the reciprient (like myself on this occasion) is either awaiting an urgent call or needs to make an emergency call out.
ALL unsolicited Marketing and Sales calls should be banned.
I have had as many as 6 in one day, and some have been as late as 09:30pm.
My home is a place where I and my family can retreat to for peace.
Not to be pestered to distraction by the like of the above.
Or block my urgently needed communication lines.
At least this one was traceable, most are not and nearly all come from India and the Far East.
My telephone is installed for my benifit. Not for intrusions from unsolicited sales callers.
