    ROLF, you'll like this!

I just got my daily call from RTA.

I answered the phone saying "Good morning RTA Business Consultants" the guy on the other end was a bit confused and ask me to say again:

"RTA Business Consultants" - I say
"Who are you" - he says
"It's Bob from RTA Business Consultants, who's calling" - I say
"It's Callum from RTA Business Consultants, are you upstairs" - he says
"What you calling me for?" - I say
"The number just came up on my list" - he says
"You must have a bad number" - I say
    "Yeah" - he says
"OK bye" - I say [hangs up]

We're draconian, admits manager of RTA business sales firm
BY ANDREW PENMAN ON JUNE 29, 2011 11:00 PM IN WORK

We've already had a few run-ins with Paul O'Reilly, boss of what claims be Europe's largest privately owned business sales agency, and now things have turned particularly nasty.

O'Reilly wrote to one unhappy customer who'd seen our stories to tell him: "What you are unaware of is that the Daily Mirror printed downright lies which were proven by us and the Press Complaints Commission made them print a retraction."

The PCC did no such thing - it did ask for a clarification of one possible ambiguity of a previous piece of ours, you can read both the article and clarification here.

We're not surprised to hear O'Reilly making such a claim, judging by the way his firm RTA (Business Consultants) Limited treats his clients. The latest batch of complaints we've received includes one from Peter Bracewell, who put his Glasgow pottery firm on the market through RTA.

After three months and no enquiries he asked for the contract to be torn up - and was presented with a demand for £47,360, then a summons.
The case was thrown out when RTA didn't turn up in court.

David Darling, who owns a printers in Bournemouth, says he got a £6,000 bill "as their fee for not being able to sell the business".

"Seething" Clare Brookes, of Beetledrive, a specialist wedding firm that rents white VW Beetles, told us she's had a demand for £10,800, but: "You would not find us on their website even if you were looking for what we do as a business."

John Griffiths put his fitness firm in Basildon, Essex, on the market with RTA two years ago.

"I heard nothing for the entire time and when I told them I had sold it via another contact they demanded £5,000 commission."

In Brighton, Jessica Rosenthal asked RTA to sell her bridal shop, but the business closed, unsold, in 2008.

She heard no more until getting a £600 bill this year, plus a letter insisting: "We have undertaken our best efforts for you".

Then there's the Bolton butcher's shop with an annual income of about £30,000 that RTA valued at £450,000 so, funnily enough, it hasn't sold.

O'Reilly says that every issue put through their complaints procedure is "satisfactorily resolved".

"Unfortunately some people choose not to follow the procedure or attempt any form of resolution.

"Sadly many do not do so because they are empowered by what they read in the press and more specifically on the Daily Mirror's blog.

"If your blogs are empowering people to renege on legitimate contracts then this is wrong and you are inadvertently doing more harm than good."

When we met RTA manager Ceri Edwards he made an extraordinary admission about those "legitimate" contracts, describing them as "draconian" and "heavily weighted in RTA's favour".

Something you can show the court if RTA sue for what you consider to be unfair fees. A judge may read it with interest.

    CERI EDWARDS SAID:
RTA have a successful complaints procedure. So successful in fact, that we have never failed to resolve any formal complaint received. We encourage any client that has an issue to follow our complaints procedure which can be found at:-
    www.rta-complaints.co.uk.
We are disappointed by the actions of The Daily Mirror. This complaints procedure was put into place as a direct result of a meeting with The Daily Mirror, in return they agreed to encourage any unhappy customers to follow the complaints procedure which would allow us to resolve matters before publishing issues.
Sadly we have not been given this opportunity in any of the cases mentioned.

    PAUL & MICK SAID:
Not sure if that complaints procedure was there sept 2009 but if it was i did not see it and your customer service did not point me there either
Well i would like to challenge you live online, through this thread and let the people decide if you complaints procedure is fair, and i will prove after numerous calls and mails the only response i got was a very abusive call, very cleaver not to leave a mail trail i suppose
It all started for me late September 2009, where we had one of your representatives come to look at our business, valued our business and said it was worth £129,000 even though the last 3 years accounts showed 80k max, he told us that was not a problem as he had many people who wanted our business and would go fast, he quickly filled out a contract and dated it 1 month in advance as we said we needed time to have a look as he was in a hurry and had to dash off somewhere , but dont worry the contract is not binding and the true contract will be in the post later that week
within 24hours we had a call asking why we had not paid, we told the guy on the phone what the salesman said he said we signed, so we owe 4k and if we dont pay we will get a summons
Thats when i wrote my first mail to RTA (bare in mind this is 24 hours after our fist meeting)
I kept getting calls demanding money, threatening behaviour down the phone.
We offered to pay for the time advertising they have done but was not going to pay another penny because of the threats not only to us but from the complaints i had read, they would not let me cancel they did not advertise our property
I took screen shots of their website with our search criteria and nothing there.
They keep going on about we signed a contract, and yes my business partner did not me, and it was dated 1 month in advance from when they visited. so the sales man was 100% clear on our actions but duped us by blatantly lying he even told us he had cancer (i really do hope that was not a feel sorry for me ploy)
Please feel free to respond I today got court summons, i told the guy who called me yesterday to gloat and ask for money that i would be happy to challenge him in court, as so many have won lately and we can prove without a shadow of a doubt that we were duped, their over inflated pricing of a business to create more commission, we asked them to evaluate correctly and they refused saying we only go off what you tell us (I wish it was that easy to get a bank loan) we showed the rep our accounts
I have sent many mails with no immediate response, we just get random calls from withheld numbers weeks and months later

Not good, and if this how you earn a living conning people then shame on you.
We will challenge you in court if we have to

    SHOULDER TO CRY ON SAID:
As a member of the group which supports RTA customers faced with court action, I know that a number of our group members who have raised their issues with RTA have merely received the standard "you're a liar" letter direct from O'Reilly himself. In fact he told one of his customers that the only way to save their souls was to donate money to a good cause!
O'Reilly claims that there's just a handful of their customers who have issues - I believe a number around 14 was mentioned - and yet we have that many coming to us every week!
The contract IS unfair, it IS misrepresented, and those naughty clauses that are hidden on the back are just a travesty!
And lets not forget the new rulings that came in October 2008 - any estate agent dealing in residential property (property that is wholly or partly used as a dwelling) must be part of a Redress Scheme. RTA are not. RTA flaunt the law. So, if you're a B&B owner, hotel owner, are selling your home along with your business, why not complain to the OFT.
RTA - MAKE YOUR CONTRACTS FAIR AND JOIN A REDRESS SCHEME!!!
In the words of Ceri Edwards....simplzzz!

They have rang us for the past couple of days. They ask to speak to the owner and when they are not available they refuse to leave a message and say they will call back another time. I know these people have a job to do but with the "enthusiasm" they use on the phone surely they must realise they are just annoying folks?
