I think it's three months before they will discuss restructuring payments. In the meantime, like most of the advice here, ignore these calls from these morons.

They are just an agency working on behalf of a number of financial institutions who obviously get commission on the number of people who take the call. The payment kicks in I believe as soon as you answer their security questions. Hang up or bar the call. If you have any payment problems speak to your bank directly. Under the present economic circumstances this kind of harassment, particularly of people who have recently been made redundant, is totally unacceptable. Be happy to hear from anyone who knows who this agency is and where they are based.

I would like to hear people's stories, particularly those who have recently been made redundant and have been harassed by these calls. - RomanI got a call yesterday morning of another number, which appeared to be the same kind of thing, and today when they called, i thought it was the same number, since it started with 0845.. lol when i picked up i started swearing at them, when eventually someone starting talking and asking for a person with my name.. when i told him to go [***] himself, he asked me if that person was not available on this number. I told him i'd give a number to call him on, and after the first 4 digits, the [***] hung up... not a very good thing to do if you skank money of people, is it now XD

- KezHad 2 of these calls today and havent bothered answering. Im sure the Halifax normally call my house phone. Very odd. I wont be answering, thats for sure. One was around 8.30am the next was 12.20pm. Wonder how many more ill get today!!
- cpfc1978just got a call from this number, some african lady saying I owed money on a Bank of scotland credit card, I dont have a Bank of scotland credit card I have other cards that are processed by the Bank of scotland but she could not tell me who the card was issued by just went on about Bank of scotland so just gave her a load of abuse and hung the phone up, will do the same again until someone can tell me exact details !

- SareThis number is the Halifax. Not sure if its credit card or the bank. I have debts with both. If you have in the last 7 days made a payment to Halifax credit card they will still call you chasing payment. I made a payment 5 days ago and this number has called me about 4 times today - I will not pick up.
From reading other messages on this board I can also tell you the following:
1 Creditors/banks/debt collection companies etc. are not allowed to call at unsociable hours (i.e. before 9am and after 8pm.)
2 It is ILLEGAL TO CALL YOU AT WORK.
3 It is ILLEGAL (even more so than point 2 above) to call a family member to try and speak to you or even track you down. A credit card company keeps calling my sister on her mobile phone asking for me. She has never had a credit card and has never had any dealings with this company whatsoever. Yet they have her mobile number? She has on numerous occasions told them to stop calling her but they have not taken any notice. This has been going on for a number of years. Which brings me on to my next point:
3 Banks and creditors pass your personal details to each other (ever wondered why you get so much junk mail offering credit cards, loans etc.) This will be how my sister keeps getting calls from a company that I have a credit card with - they had obviously looked for someone else at the same address and found my sister and started calling her. What usually happens is if I do not pick up their call they will call her.
4 I have a friend who works in a call centre and I asked her what the deal was with these callers asking security questions. My friend told me that they are NOT allowed to ask you these questions and to refuse any information.- Caller: Halifax (most probably)

The Halifax advisor told me the staff had received an email about this number and it's an outside agency working on behalf of HBOS for sales and custimer services purposes.

I shouldn't be getting calls as all my debts are being dealt with by the CCCS but this number has started calling my mobile and doesn't leave a message. I am not getting any letters from my creditors backing up these phone calls.
Many thanks. - ronbuddharocketI can confirm that this is a number for a 3rd party debt recovery service that is employed by HBOS. It is also employed by other organisations such as RBS etc. Birmingham Midshires is a subsidiary of HBOS, hence their mention in earlier posts. Basically if you get a call from these people you owe money to someone. Ignoring it isn't going to solve anything and will probably complicate things further!

Prohibited conduct
The Act prohibits certain types of "abusive and deceptive" conduct when attempting to collect debts, including the following:
Hours for phone contact: contacting consumers by telephone outside of the hours of 8:00 a.m. to 9:00 p.m. local time[2]
Contact after being asked to stop: contacting consumers in any way (other than litigation) after receiving written notice that said consumer wishes no further contact or refuses to pay the alleged debt, with certain exceptions, including advising that collection efforts are being terminated or that the collector intends to file a lawsuit or pursue other remedies where permitted[3]
Causing a telephone to ring or engaging any person in telephone conversation repeatedly or continuously: with intent to annoy, abuse, or harass any person at the called number.[4]
Contacting consumers at their place of employment after having been advised in writing that this is not acceptable[5]
Contacting consumer known to be represented by an attorney[6]
Contacting consumer after request for validation: contacting the consumer or the pursuing collection efforts by the debt collector after receipt of a consumer's written request for verification of a debt (or for the name and address of the original creditor on a debt) and before the debt collector mails the consumer the requested verification or original creditor's name and address[7]

Reporting false information on a consumer's credit report or threatening to do so in the process of collection[16]
Creditors Calling at Work
A creditor can call you at home, at work, on your cell, anywhere and anytime (the "anytime" must be within reason, such as NOT after 9pm, etc.). They can also call anyone you've listed as a reference or contact in order to locate you (although they are not allowed to divulge specifics of the debt they are calling regarding in order to malign you). However, the first time they call you at work, you merely need to tell them ONCE never to contact you at work again and then legally they cannot do so-- if they do, they are in violation of the Fair Debt Collection Practices Act. Keep notes of dates, times, and names.
If you really want them to leave you alone entirely, you must send them a letter (send it certified) directing them to cease all forms of contact with you (phone, mail,etc.). After that, they can only mail you one more notice stating that they have received your request and are complying. Keep in mind that this does NOT negate the money you owe the creditor or remove it from your credit report-- the debt does not magically go away. You still owe the debt. And if it is a secured debt (with collateral such as an auto loan), they may still repossess whatever was used to secure the debt.
But they can't call you at work once you tell them not to.

The standard guideline for most collection agencies is to take a verbal statement from the consumer not to call your work. However by FDCPA your statement must be done in writing. This also applies to calls at home. If another person you work with verbally tells them they cannot call there, then they are legally prohibited from calling the business except for validating your employment.

- Sadie08456 029441 - this number calls me first on my home number usually at 8.45am then again on my mobile at least twice a week including weekends. The person always says they are calling from the Halifax and want me to confirm my identity before they can speak to me about a letter they say has been sent to me. Every time I tell them I have not had a letter from the Halifax and NO I will not give them my ID details, they become abusive. On one occasion the person told me that it was not in fact Halifax calling but an out sourced call centre. The last time I was called I asked the person to remove my number from their data base and she said she couldnt do it until I gave her details of my ID!

- Debt IvaderHalifax (apparantly ) Have tried a number of times on the 08456029441, in which when they do stay on the line to talk they are demanding repayment of my overdraft facility. I usuall have some one rude and patronising telling me what action i must take (YEAH RIGHT!)
I basically tell them to accept my £20 per month installments or take me to court.
You will find Banks never want to go to court as they will loose out on interest.
