Talked with Quincy Johnson (yeah, that's not a real name) at (215) 642-3400 x108 for an hour and he kept putting me on hold while he "checked with the attorney to see what amount we could settle for" - LIES!!!!! There is no attorney, these people are based all over the country and make commission on what ever debts, real or not, they collect. I'm filing a class action lawsuit against them!! First thing you do is ask them to give you "VOD" which is verification of the debt. They wont send you anything. You must put this in writng and advise them that if they call you again you will sue them under for violations of FDCPA. Tom Landis is an attorney in their office and will be happy to pay you for any threat of lawsuit against harrasment. When you stop paying on a credit card debt,
The original creditor is mandated by federal law, to charge-off an account when no payments have been received for 180 days.
That date is refered to as the �Date of Last Activity (DLA)’ and reported as such, to the credit reporting agencies by the creditor.
After they write it off, they "Bundle" all these uncollectable accounts and sell them for pennies on the dollar on the open market, this is where the 3rd party debt collectors come in.
They BUY a "BUNDLE" of this uncollected debt info from the original bank.
However what they buy is your name, account number, and what you owed to the original bank.
They rarely or never get your "original signed contract" with the credit card company, your last statement of payment on the account, and the original writeoff amount.
This is what they need to "PROVE" in court that they now have "TITLE" to your original debt.!!
This information is usually sold several times within the "networks" still as a BUNDLE
of uncollectable debt!
They will harris you on the phone, send threating letters, saying that they represent
"XYC LLC" who now has title to your Bank of Bundi account in which you owe some
ridiculous amount.
First off the "XYC LLC" company is usually some "shell" company that the collection law firm has setup, because by law, the law firm itself cannot hold title and try to enforce a judgement against you.
So they have to "represent" a client who holds title, so they claim against you.
The law they are trying to collect on is "CONTRACT" law,,which requires them to have "the original signed contract", and the "deeds of transfer", indicating your account specifically with the "deeds of transfer", and a copy or original of your last statement, indicating your last payment on the account, and the "charge Off" amount. Which the original bank "wrote Off" its books.
They never have any of this information, what they present to the court is a hodge podge of information, a pasted piece from an excell spredsheet with your name, address ect, usually 2 pages sideways, "certifications" which are assembled by their own staff on their own computer systems, including usually an amount you owe which they assembled from their own computer system. From this "Budle" they bought for pennies on the dollar!!
The problem is unless you "ANSWER THE LAWSUIT" Requiring you to file an answer to the suit, contesting the "CONTRACT CASE" Pay the $15.00 fee to the court, and Show up on the Date of the court hearing and contest the case by demanding that they supply the original contract, deeds of transfer, and last payment statement,"
indicating your account "specifically" and the "charge Off" amount...
They will request a default judgement from the Judge..and he will grant it!
I have specifically fought 3 cases against me, taking several court dates, time off from work, endless hours of waiting, but they realized
I knew what I was talking about and that they could't proof their case,
IE get over on me...and they dismissed their suits...

I do not have a debt with them but they just kee calling my mom. My late wife had numerous accounts I knew nothing of. I am not responsible for her debts. She died in December of 2003. I don't appreciate that they do not accept that I don't owe the debt they are trying to collect. They should stop annoying my mother.

Debt Collectors Settle with FTC; Abusive Practices Affected Consumers Nationwide
The operators of a debt collection company that used false threats and other unlawful tactics to collect consumers’ debts have agreed to settle Federal Trade Commission charges that they violated federal law. The settlements bar future violations and require the defendants to pay $225,000.
According to the FTC complaint, the defendants, who had about three million consumer accounts and collected debts in every state, falsely threatened that nonpayment of debt would result in garnishment of consumers’ wages, arrest, or legal action. The FTC alleged that the defendants used illegal and abusive debt collection methods: they called consumers before 8 a.m. or after 9 p.m.; called their workplace when the collectors knew or had reason to know that the calls were inconvenient; told employers, co-workers, relatives, and neighbors about the consumers’ debts; continued calling after receiving consumers’ written demands to stop; and used harassing and abusive tactics such as calling many times a day, calling right back after a consumer hung up, and using profane or other abusive language. - TimThis number just called me wanting to speak with Barbara Lynch. This automated message asked if I was this person I selected "option #2"=NO...then it asked me to have this person call this number. Well how the heck can I do that if I don't know the person nor do I know how to "give the message"?

- MPJust received an automated call back from this number. From reading the comments on this board pretty sure they are trying to locate a Hector Gomez, aka Ixsa Gomez, aka Jose Gomez. So Mr. Gomez has used my cell number for his loan documents (based on other 3rd party debt collectors). But I won't waste my time to verify if this in fact the problem.

- AllieKatGot a letter from this company for a debt that is 6 years old, which is 2 years past the SOL. However, I was scared by their letter and called them to arrange a payment plan, which I'm hoping will not bite me in the end. They were very, very rude to me and INSISTENT that I pay the "settlement" of $1300 on a $2K debt. I told them that I had no idea how to come up with that kind of money, and they also suggested to me that I take out a loan, or ask my family or friends. The first "case manager" I talked to told me that I needed to pay up today and when I said I couldn't figure that out immediately, he yelled at me that "he was going to stamp my file refusal to pay and that I should look forward to being served," and then hung up. Then a lady calls me back and stresses to me again I need to pay and transfers me to "Mike Mahagony." Mike tells me that I need to pay immediately and to have my Dad call to pay the funds "in 20 minutes." Luckily my dad researched this company and told me to report them. Oh, and they have called my phone 4x since then and it's been 3 hours.

This is not the first time they've called, nor the first time they have been deceptive on the phone. If you do a search for "Attorney Tom Landis" on the web, you will find that these people have numerous judgments against them for their illegal debt collection practices. File a complaint with the Attorney General's Office in PA if they do the same to you.

- Dont they ever stopI received a call from the 1-800-853-4000 number about an old debt that is close to 12 years old now- they said they were from the law offices and that I needed to make payments regarding my account which is past due. I told them I am sorry that I am on a tight budget and they are not currently on it. They said they were in the process of filing papers to take over my home if I did not agree to pay them -- I told them since I live in Texas they can not legally take my home away for payment --they had to check the laws-- this company is only trying to find a way to get money from people on old debts and they are a scum company I dont answer calls if I do not know who they are from I have since flagged this number as a collection agency and will not answer it anymore

I explained that I had no income, was waiting to be approved for disability and would forward proof of that and did intend on paying the debt. she proceeded with scare tactics and other rude comments trying to get further personal info. Needless to say these are vultures who will do anything to accomplish their goal. BEWARE!!!!!

I was told they wanted to talk to Hortense, they couldn't pronounce her name. Hortense is my mother who is 84 years old. They didn't want to speak with me, they asked for her telephone. The first time I returned the call, without proving any information, I managed to get some from them. I was told by the "legal assistant" I was calling Atty Donald Burak. The next time I called it was the office of Thomas Landis.
I looked them both up on the Pennsylvania Bar Association's web site and found that a Thomas G Landis has a criminal conviction and his license to practice was suspended in 1997. He has since been reinstated. Donald Burak was recently disbarred.
I don't know what game they are trying to play but BEWARE. - AnonymAfter listening to about 20 voicemails from these pigs I finally called them to get them to stop. I spoke with some guy who tried to convince that my 12 year old debt was still active...PLEEEEEEASE!!! Anyway, I told him if he was so sure of this debt than I want to see them in court over this debt. He then blurts out my dads (who's deceased) ex-wife (who's a [***]) name to me!! I said "do you even know who she is?" He says "Can you get the money from her?" I said again "Do you even know who she is?". Then he hung up on me. OK, I call back to verify their address because I wrote a cease and desist notice. The skank that answers the phone for a living says she needs my social security number, I said "I'm not giving you that information" she said "well, I can't help you". OK, I've sent off the notice and filed a complaint with the attorney generals office. Why and how are they still in business??!!
