they arent breaking any laws and it is all legal, theyre regulated to make sure of it

- Mary Jayne Smith| 1 replyThe text comes from Xinwin. You may like me have accidently clicked on a pop up whilst browsing a mobile friendly website, by doing so you subscribed to Xinwin competions and vouchers. Whilst not illegal, it is immoral.
I received several texts but didn't open them at first. However, I later discovered I was being charged £4.50 per week. I reported this to o2 (who I have a mobile contract with) and they opened an investigation on my behalf. I have been offered a partial refund by the company but I am taking further action to get a full refund. If I do not have any success with Xinwin I intend to take it to:

The Texts themselves from 82288 are extremely misleading using terminology such as FREEPLAY and FreeMsg. You may like me have received a seperate message from Xin / Xinwin regards charges and how to cancel.
'To sign up' for something implies you have been pro-active in joining and have agreed to ‘Terms & conditions’, that you have been made aware what you will receive for your subscription fee.
In this instance I was unaware that I had subscribed.
Accidentally opening something on a mobile friendly website, should not be taken as agreeing to join!

I received a call from their customer services team following the o2 investigation

I was told that I would get a same day response to my email to the management team.
I did not even receive a courteously acknowledgement. So I called the customer care team back.
I was shocked to learn that it could take up to 28 days to receive a reply.
She told me that I was ’lucky’ to have been offered a partial refund because according their records I had visited their website (not a pop up as claimed) and given my phone details and entered the computer generated PIN number that they had sent to my mobile and accepted their terms and conditions! I think I must be suffering amnesia because none of this sounds at all familiar to me.
I am giving them to time to reply. But worried whether I have done the right thing turning down the partial refund. If what she says is true then I might end up with nothing L
When I mentioned speaking to The Office of Fair Trading or Trading Standards. She said if I involved a 3rd party to act on my behalf they would not consider issuing a refund …… this last comment seemed more like a threat and she became very offish with me, I asked if I could speak to a manager, she said no they didn’t have a number to put me through to, I would have to email them again, at this point she said that there was nothing more she could do, as I had already taken it over customer services heads, I would just have to wait. - Mary Jayne Smith replies to ms campbellHi, Please read my post on here 13/14 October - I Hope it might help. If I dont get any satisfaction from my emails to the company I do intend to take it further, if anyone is considering taking it further a Group claim / law suit would likely work better than a single complaint against them. Got to be worth consideration.
