This is collections, if you can't' stand the heat leave....this is what collections is.......collecting on debtors, which you are probably one.. any fool that whats the calls to stop, I have a great idea..pay your debt and you will never receive another phone call. And anyone applying get a back bone its not hard work.

    866-354-0567 calls me 5 times a day asking for Juan no name given from the caller only to call "corporate office" Buckeye Title Loan ext 6079. Hello, I work and have my own home!!!!!  I don't know any Juan and I am blocking it from my phone.

    What is Debt Collection Harassment?

    The Fair Debt Collection Practices Act (FDCPA) has a set of rules that determine what can be termed as harassment by the debt collector. Harassment can be either written or verbal. Calling you repeatedly at home or work place is a form of harassment. Harassing in any form is considered a severe violation of the FDCPA.

    According to the FDCPA the following are considered violations of the Act by the debt collector:

       Harassing by calling repeatedly
       Threatening to use violence
       Using obscene or abusive language
       Calling at work place
       Calling after you request him not to call
       Calling but not giving name
       Sending notices that look like court notices
       Publishing a list of consumers who have not paid
       Trying to extract payment over phone
       Giving false identity of being an attorney

    A debt collector can call you if there is a genuine debt to recover. But debt collectors are often over- enthusiastic and may end up placing too many calls or end up using tough language. This is considered to be harassment. The FDCPA punishes harassment by debt collectors. The Act gives out specific guidelines on what is considered unlawful behavior. These guidelines protect consumer rights.

    If debt collectors obey the rules of the book the emotional stress faced by the debtors can be avoided. In the absence of this understanding there is a possibility of the consumer falling into the emotional trap.

    You can avoid the harassment by following these simple rules:

       Stay calm during the call
       Do not enter into argument
       Do not use foul language
       Do not give away your bank details
       Ask for debt validation
       Send a cease and desist letter
       Dispute the debt

    If the debt collector has harassed you and violated your rights, you can sue him. You may engage an FDCPA attorney who will take care of the legal aspects.

    A Debt Collector CANNOT:

       Telephone you an unreasonable number of times
       Telephone you at an unusual time/ unusual place
       Disclose information of your debts to third parties
       Use profane or other abusive language
       Contact you after written notification that you do not want to be contacted any further
       Claim to be affiliated with any governmental organization
       Misrepresent the character, amount or legal status of a debt
       Threaten of to take any action that cannot be taken legally
       Accuse you having committed a crime
       Threaten or communicate false credit information
       Attempt to collect, until he honors your request to validate
       Use deceptive methods to collect debts
       Call you before 8:00 a.m. or after 9:00 p.m.
       Call you, but not announce who he/she is

       Reduce or completely zero out your interest payments
       Avoid or reduce late payment fees
       Combine several loans into a single payment plan
       Get a single, low monthly payment to clear all your creditors
       Get errors in your credit reports rectified
       Get invalid or time-lapsed entries in your credit reports removed
       Get peace of mind

She was mean and I believe they are harassing us without any reason. I am not against following all debited people.. But, I am not willing to take their sh...ts on us.

    Well, I paid back the stupid cash advance, and these jokers still won't stop calling and harrassing.  I just loved the line a few posts back about the fist full of hundreds.  Like we won the lottery?? Really?  I don't think that is how the majority of people feel when they take a payday cash advance.  If it weren't for us "late" people, you RUDE people that work at checksmart wouldn't have a job now would you?  You wouldn't be getting paid $4.75/hr for being a head-set phone jockey that only harrasses people.  There is a right way and a wrong way to collect a debt, you a**holes are definitely doing it the wrong way.  I just wonder about the language you use to collect your debt - would you be using this same language if you had to go to someone's house to collect a debt face to face.  I really don't think you would, would you?  And if you were "straight up" debt collectors that were doing an honest job, why not use your own name?  I use mine everyday at my workplace.  I bet it's because you don't want anyone to know who you are, so when you do use the foul language you use, the person you are calling won't come and find you.  Well, Karma doesn't need an address....

    These jokers called my internet phone number... it's one I had set up a couple months ago but have never used. I have also never used any cashadvance or whatever the heck the number calling is from.  They left an automated message for a name I've never heard of.  This is a voice to text transcript of the exact message:

    "This message is intended for "Jane eversole?" or any friend or family of Rodney Melvin. Rodney has left this telephone number as his contact number and said we can leave a message for him here. Please Have, Ronnie return the call to the corporate office is a check for this is regarding your current matter. He has in Kentucky. T telephone number is 1(866) 354-0567 extension 4096. Thank you. "

    I don't know anyone by any of those names. Perhaps the automated caller is a scam since they literally dialed and left a message at a random number.

    You are right. I am a bill collector, but my company doesn't allow these things to come out of their collectors mouths. If we leave a message or we actually talk to the consumer then we can't call back for a min of 3 days. If we don't, then we can call back the next day and we usually do. U're always gonna get those ppl that say we are harassing them, but when this is the first an only time we've called we're not harassing you. And then u get the ppl who say they don't have the bif (balance in full) but are intent of paying the bit when they have it. Which is confusing to us when we offer affordable and some not so affordable pa (payment arraignments) we even offer stls (settlements) when our clients allow it. I never thought I would be a bill collector, but seeing as I make more then $9/hr and up to an extra $600 for hittin my goal, I can't complain much. I don't make ppl cry or make them feel bad about not being able to repay a debt. So don't compare all of us to every collector u talk too. We've all been there. Trust me. I'm there now, but some of the things I've heard about this company and their collectors is down right degrading. These ppl make consumers hate all bill collectors. Hell I hate them now

    You shouldn't reply to someone's message that you know nothing about. I am being called by this number is why I looked it up. I have NEVER taken out a pay day loan! So, they obviously are calling me for no reason.

    lady said it was a personal bigness matter did identity company she was calling from tried to call the number she gave a recording came on said thank you for calling the corporate office. i lost my job and callled check smart  and tole them what happened said the i would need to speak to there collection office. They call me about every 20 minutes leave a message

    Pete - this number called my under-age son, told him that he was a reference for me and DEMANDED he tell them how to contact me.  He said he didn't know where I am or how to reach me. The caller told him to find me and have me call them within 24 hours or he would be in legal trouble.  He asked severaltimes for their name and phone number and they said to just use his Caller ID.

    My identity was stolen and I can only assume this is somehow related to that BUT there is NO excuse for threatening a child.  You need to stop watching Maury and pull your head out of your ass.
