Apparently he must have the wrong number since I have an excellent credit rating and have never been late on a credit card payment! I have no unpaid bills. Thanks for all of the informative posts! I will certainly not answer ANY calls from ANYONE unless I know the name/number! If you are being harrassed, send them a "cease and desist" letter. I would also report them to the SC bar, Better Business Bureau, FTC, etc. It's amazing to me this is still allowed in 2010. How about a class action lawsuit against this [***]?? Harrassment, intentionally causing emotional distress, threats, etc! Who's with me?

This is absolutely a bizzarre phone call and I hope it's the last one...if not, maybe I'll be able to go to the BBB.

I bet you have credit card bills that you haven't paid off so how can you sit there and tell people to pay their bills and you won't call, you collectors are crooks. We were hassled by debt collectors until we got our money issues straightened out for good with his help! It really has changed our lives. We need to pay back our debts, but at the same time, don't let some idiot in a cubicle make you emotional or determine if your kids will eat this month. I never saw it this way before and it was so upsetting before.

Whoever it was(would not identify himself) asked me about the arrangements I had made to pay off the Bank of America debt. I told him that I never have been associated with Bank of America and he went on about taking responsibility, etc etc. I told him that I have no credit cards as I declared bankruptcy. He said that this account was opened in 2008 after I told him I filed in 2007. He then tried to change when the date when this supposed account was opened. Then he tried to say that I told him it was opened in 2008. If this is representative of the legal professionals in the country, we are in serious trouble because the bottom feeders have taken over the legal system

Anyway, They have been calling me all the time.. I had a BOA CC. that was sold to them and that Josh guy, well, he's another story... Very rude, demanding, and made me feel like [***]..... Now, I had an agreement, that I would pay so much monthly with BOA, until I could get back on track. This was a verbal agreement, and I that we had something going here. Well, I didn't, they sold it off to ED Overcash.
Are they a law firm, or a debt collector, or both? I do understand that I have an obligation to pay back money that I owe, no problem, but I can't do so now, because I don't have a job, or anything like this.
One other thing, I know Overcash bought my BOA CC account for the sum of what I was going to originally pay them.
Now, what is the legality behind this - Will I be going to court? Will I lose anything? Take my other household belongings? Do I need to contact a lawyer of my own? Should I work with Overcash? Remember, I do have debt that I need to pay back.
All the help would be very much appreciated..

- pro se 'quid pro'Here's another couple of # for you - 864-298-1110, 864-233-5800. I haven't spoken to anyone from this "fine" ex-judge, now mediator, law firm aka debt collector. However they filed suit on behalf of CACH, LLC (which by the way has more aka names that good ole Ed does.) I not only filed an answer, but filed a countersuit alleging violations of Fair Debt act, asking that they provide original debt signature and validation of account. AND I requested a jury trial. This apparently P O'd Mr. Overcash because he actually signed a letter to me sending the same old junk as in the complaint, with a written threat of filing an amended Summons & Complaint seeking attorney fees for litigation if I do not call him within 7 days. HELLO, Mr. Overcash, a letter doesn't get it, dearie, you have to file an ANSWER now to my counterclaim & produce the documents requested. And will you be requesting additional litigation fees, as you have already requested them once?????!!!!!!!
- lawyerMake sure you know what the statute of limitations is, and what state laws govern the credit card contract. All states are different. If you don't pay and don't say you will pay for whatever period the statute of limitations runs, then it's gone. BUT if you even pay one penny, it will restart the clock. Same if you say that will pay.
The thing that is bugging me out is that they called my house looking for someone I've never heard of. How did they get MY number? Or maybe they knew the person lived here before? Weird- Caller: ed overcash's firm

- lawyer replies to JByou need to see the terms of the card, what state laws control. It'll be there somewhere. Then you need to find the statute of limitations for contracts in the state that the contract says is the controlling state, it's usually something like 3 years but I know there are a few states with like 8 years or something. If you haven't paid anything, or promised to pay anything, in that amount of time, then you have a defense in court, and the judge will get poopy with the creditor for wasting time and being a sleazebag. Usually places sue you before the statute runs out, though.
Yes ed overcash is a law firm in south carolina. They will probably harass you a bunch more before they actually sue. How much is the debt? Because if it's 1500 or less, you may as well pay it, an attorney will cost that much or more. Do you have a house? If so, if you lose in court, they can put a lien on your house. Then they get paid when you sell yourhouse, because you can't sell a house with a lien on it. Do you have a job that you aren't able to leave, or aren't trying to leave? Then they can garnish your paycheck (that's not a problem for you now, but once they get a judgment, they can still go after you later). DO you have a checking or savings account? If so, they can garnish your bank accounts. They won't take personal property (your stuff) because most personal property has no value (if they know you have diamonds or something, then I guess they could try for those).
Before dealing with them I would recommend at least consulting with an attorney (generally you can do a consult for like $100 or so) to see if the debt is still legit. If the statute of limitations has passed, then you are fine. - Dead BrokeI was just served papers from "Ed Overcash" yesterday. I did the right thing and contacted his office. No answer, suprise suprise. A couple of hours later I recieved a call from Joseph Bishop. Totaly rude from the moment I answered the call. Told me that I had 10 days to get him $4000.00 or he would put me and my sick husband, 7 month old infant and my six year old son out on the street. Wanted my bank account information over the phone. I am like all the rest of Americans in this country that are broke and made bad decisions in their past. This idiot gave me a panic attack as I was driving home from work. I about had a wreck while he was harassing me over the phone. This guy needs to realize what he is doing is unethical and he needs to be stopped. I have gotten a lawyer and will settle this the right. I am going to drown this so-called law firm into the ground with paperwork and wish that they had never messed with me. And also the money that I owe will go to the rightfull owner and NOT ED OVERCASH and any of his minons.

That is not a real solution, or realistic, at all.
And the only 'person' it would help is Ed and his employees. Most of whom are rude, unhelpfull, and unpleasant.
But dont let them drag you down.

Pity the person who has made this their life, who pays their own bills through intimidation and threats.
Just let it go. If they do sue you, the courts will be far more respectfull and organized. And your money will go to the right people, the people you rightfully owe. Not someone who bought your debt with the implicit understanding that they would have to intimidate you into paying.

Your comment that the calls will stop once you pay your debt is about as ignorant as they come. How do you know him? Are you his gardener? Obviously you are not one of his peers in the legal profession. If you were you would know that there is this little thing called, the Fair Debt Collection Practices act. One of the provisions is that a debt collector may not call you after they have been instructed not to do so. If they do you can sue them. Once you request in writing that you wish no further contact from a third part, then they MUST stop
- Out of Work Professional 22 MonthsWow! These folks are evil! Ms Bowers called me from 888-511-1130 ext 153. I called her right back to explain my situation. She listened (gathering intel) while I told her that I had been in touch with Bank of America WEEKLY since my inability to pay my VISA, keeping them updated on my situation and job search. (BOA folks were really pretty decent.) I also told her that I had been out of work 22 months and had depleted all of my savings and retirement, and had exhausted any "friends or family" resources just to keep up with living expenses. I told thrm that during the past 22 months i was able to keep current on my $1800 month mortgage for 14 of these months and that it was now in shortsale prior to foreclosure. I had continued to pay my BOA VISA for 16 months until they shut down the card because the past due mortgage showed up on the credit bureau flags (they were still being paid on time). I even made a payment a few months ago to try to keep it from being charged off and into the hands of these vampires. I then told her that I will pay BOA once I get a job, but for now I have exhausted my unemployment,have disconnected my water, shut off all power at breakers except one outlet, s old off all my furniture and was on my way to consigning my clothes when they called (all true!). She wasn't interested him any of this and said, "Then you REFUSE to pay?" I told her I didn't refuse, but couldn't pay anything by their "10 day deadline". She then hung up on me, saying I was waisting her time!. So I called back and asked for the address of the "Law Office" and she rattled it off and then put me on "hold". I called back and got "Steven" and asked again for the address. He kept asking why I wanted it and I said I would like to write them. He said unless I was sending a payment they didn't care what I had to say. It took 10 minutes of this before I could get the address. These folks are NOT Bank of America, they are second rate collectors. DON'T talk to them! I know I told them waay too much, but even if they have take me to court I have nothing to take. Again, don't talk to them. They cancome at you for seven years FROM THEIR LAST CONTACT with you. And they will continue to harrass you even if you eventually pay off the debt to the original lender or work with a credit consolidation company. When I get back to work and have money to pay this debt, I'll deal with BOA directly. It's paying my way through school and will pay to start my business. I'm going as far as I want to in life. I don't fight with people, I try to reason with them. Because when we call its past the point of a collection agency. This is a law office that works for a company that purchased your debt from these collection agencies, if they are not paid legal steps are taken and I call to help prevent it from going that far because if it does its over. The court system takes over and if you thought you had nothing before it can get worse if you get sued for non payment of a debt. Trust me I've been there, my family has been there.
