- Under Pressure replies to scammers| 1 replyThis group is aggressive! Has anyone actually had a lawsuit filed against them by the Law Offices of Ed Overcash?
- believe replies to Helping outPlease help me out. I do understand the Overcash firm has bought my account from Sears Visa. So now it looks like i owe Overcash. I just spoke to Sears, and they said my account with Sears is closed, due to Overcash buying my account. Overcash called yesterday, thus the nightmare begins. If i had the resources I would pay the bill. Suggestions, please.
- believewhat to do today, after the threat you pay or else? what does the or else mean?
- TeeI have started receiving calls from the law offices of Ed Overcash, since my uncle is an attorney I called him about the calls. He told me that by law if you ask them not to contact you by phone THEY MUST STOP... Also check the laws in your state they may not be legally able to collect from you unless they file a compliant in civil court. Just so happens the state I live in is one of those states and this state doesn't allow them to collect legal fee's so if they want the few dollars they claim I owe them they will have to spend thousands trying to collect it... Federal collection laws plainly state if they use ANY TYPE of harassment tactic's they could be legally held liable for you legal fee's and pay you for your time... I know from first hand experience that you can sue and win against a collection agency... It's actually not that hard.... Don't take any crap off these people file complaints with the bar association and the FTA...

- Miltiades replies to Brenda FiersI had this group of pond scum calling our house 4 and 5 times a day for over a YEAR before they finally sold our number to another scumbag. The only problem is that we have a phone guard which blocks out entire phone prefixes. The phone does not even ring :) I would have been willing to disclose the information they wanted about an ex-friend except they were so unbearable that it became a game to me. My advice is if your dealing with these kind of people who place endless calls BUT are unwilling to place anything in writing than research the net for the type of device I described about. Above all, never deal with any financial problem OVER THE PHONE! The moment you open your mouth to them you can extend the period of legal liability.
- Anon replies to Under PressureYes, and several people have won. Again, never deal with these people or anyone like them over the phone - period.
- Employee replies to Not paying| 6 repliesAt least WE have jobs and actually pay our bills and spend within our means!
- unemployedmichigan replies to legitA respectable judge. Judges are lawyers-period. And being a judge does not automatically make one respectable. Check history. And to those who would defend these people--- they should ask the banks for the money. They received a bailout and are richer then ever. And they are the ones who destroyed the economy. And these ed overcash types - I'd starve before I would ever work for Ed Overcash. He is not respectable but a leach.
- unemployedmichigan replies to EmployeeI paid my bills always but as many-- medical bills hit-- and then the same bankers you owe destroyed the economy, ruins lives, demands payment BUT gets a bailout at our expense!! If you have a job feel lucky, especially if it pays bills and keeps a roof over your head and has benefits. Your attitude is why we keep getting the wrong people in power-- and usually work for the ed overcash types.
- Bob replies to Bill CollectorWell, it will be a cold day in hell before I pay you guys. You will get the money over my dead body you B*tch!
- employee2 replies to EmployeeThats true we have jobs, and we have the ability to go home each day knowing that we have job security. Becasue there will always be those that take on more than they can afford and will default......
- Hopeful for a ResolutionI just got a call from Patty Diaz and Andon Michael (sp?). When I first got a call from this number yesterday, I was inclined to ignore it, but after reading the comments on this site, I decided that I did not want to have them contact my friends and family, so I answered the phone when they called back today. I have to admit that I was expecting the worst but was pleasantly surprised that they were very nice and helpful over the phone. Just to be clear- they called regarding a debt that I freely admit that I owe. They worked with the owner of the debt to come up with what (i think) is a very fair settlement. It is not what I would have wished, and I will be hard pressed to come up with the money they are asking for, but I will do my best and do not hold that against them. I am not an agent of this law firm, nor am I connected with them in any way. I can neither defend nor condemn this organization as a whole, and can only speak of my personal experience with them as a private citizen who finds himself in this position.

- AutoI looked on the back of the paper they sent and here is what it says verbatim " YOUR RIGHTS UNDER FEDERAL LAW TO DISPUTE THIS DEBT AND/OR MAKE A WRITTEN REQUEST FOR VERIFICATION OF YOUR OBLIGATION WITHIN 30 DAYS IS NOT AFFECTED BY OUR REQUEST THAT YOU PAY THE AMOUNT DUE OR CONTACT OUR OFFICE BY TELEPHONE".

- kates replies to Helping out| 1 replyI reported them to SC Attorney General's Consumer Complaints-the FTC- the NH AG DOJ, and my lawyer sent a CEASE and DESIST order to stop the mind numbing number of phone calls we were receiving! I am so pissed that they had the audacity to BREAK the C&D order and keep calling my husband at work! I have never received a statement from them-as I am ENTITLED to,so..because "Lisa" called after C&D order-she broke the law, infringing on my rights under the FTC Fair Debt Collections Act. Looks like I can now sue them!
