    Hi Martin,
Is it an actual summons from Maidstone County Court, or is it Capital Credit Management just threatening proceedings if you don't pay up? If it is a summons, you can certainly go and defend yourself, and you can ask for the case to be transferred to the County Court nearest to you. (I was told that by one of the many agencies we've all contacted. THEY CANNOT TAKE YOU TO COURT WITHOUT YOUR KNOWLEDGE AND IT'S THE COURT THAT ISSUES THE SUMMONS, NOT CAPITAL CREDIT. By the way, they charge another £45 every week when they send a letter. Have you contacted any of the agencies we've all recommended? They're really helpful.

    Hi All,

Sorry I've not posted for a while -been trying to catch up on all sorts!

Fritz - please don't forget to update your case notes about this latest horror with Action Fraud, the Police will need to know that Cap Credit are taking more money, you'll need your reference and password.
The Daily Mirror have contacted SatLite, I'm going to send them the full case notes today.

Liverpool Trading Standards have been on, they've passed the info to the Croydon Office who will be looking in to it.

I'm still waiting for the Fraud Squad to contact me for a full statement but I know that the more of us that complain the more likely it is that they will investigate, so if you haven't up to now, please contact Action Fraud or nothing will be done to stop these people.

Trading Standards did say that as SkyLite and SatLite have been dissolved  (they ARE Sampora now), then there is nothing they can do to" retrieve" this money unless Receivers are engaged to claw it back, and they will have to go through the courts.

Hi Lizzie - I've been looking in to getting a more formal group together, it looks as though the best way would be to set up a Mailing List but it's a hell of a lot of work! It would also mean all of you trusting me with email addresses etc - a big ask I know as we don't really know who we can trust on here so it's a huge leap of faith to trust our email addresses with one person (initially anyway).
How would everyone feel about this - could you all have a think and post on here whether you want that level of "Support Group" or if you can think of a better way?
By the look of Fritz' post, things seem to be taking a turn for the worse here if CC are now dipping in to bank accounts - I'll ask my Mum to check hers today and ask Santander to take this more seriously, which I have to say they haven't up to now.

Don't be intimidated by the threat of Court action - apparently there is nothing they can do.

    Hi All,

I've researched Lending Stream and they appear to be a legitimate payday loan company (with huge interest charges, but nonetheless legit).
This could be a result of ID theft, possibly through personal details being bandied about, but also possibly unrelated to the companies we're dealing with.
I've contacted my bank (who were aware of Lending Stream), and they stated that they are legit, and this incident is likely to be a separate ID theft - Fritz, as if you don't have enough to worry about.

Everyone should keep a really close eye on their accounts, either by phone or online, daily to make sure nothing is being withdrawn without authorisation.

    Hi Lizzie and All

The letter they sent me was on orange paper advising they are instructed to issue proceedings against me in Maidstone County Court, I have spoken to the Fraud Office Trading Standards, Financial Ombudsman, Sky TV, my MP and Watchdog. My MP has asked for all relevent paperwork so hopfully might get somewhere with her.

Hi Martin, as Lizzie says, do nothing unless it's actually from the court, then hotfoot it to the nearest CAB as they're very used to dealing with nasties like this and will advise you on the court action and you'll be able to talk to them face-to- face. It's a long time since I've been to them but you were able to call them and make an appointment with one of their Solicitors. Take everything with you!

Yet again I've found more work for us to do......came across an agency called CIFAS while I was looking for info on Lending Stream. I didn't have time to look at it properly but it looks like another good place to report all this. If you google it will take you to the site.

Is anybody else feeling really angry about the amount of time and energy this is taking up - not to mention the stress?
Martin, still not sure that the letter is an actual summons - who has signed it and what's the letter heading? It might just be a more elaborate letter from Capital Credit to get you to pay up. Can you show it to a solicitor, Citizen's Advice or someone similar to verify? If it is an official summons, then perhaps we all need to beware! Don't forget, you can ask for the case to be transferred to your local area County Court.
Katy, I would trust you with my details!! Just called Consumer Direct, who say I have to send Satlite ANOTHER letter, giviing them 14 days to respond, before West Yorkshire Trading Standards will get involved. Must admit, I did wonder about both Skylite and Satlite being dissolved. Presumably then, they will no longer have the phone records we need to prove misrepresentation - if indeed the calls were ever recorded. I find it really annoying that the onus is on us to prove that we've been misled, rather than to them to prove that we've defaulted on agreed payments. What kind of human right is that??!!

Lizzie I totally agree, I'm supposed to be setting up a business (ha ha) and you've undoubtedly got a busy life - and look at us! It hugely P's me off that all these agencies can't seem to get together and investigate this thoroughly and stop what is without a doubt happening to a lot of people!!
I must admit I now hold very little hope of a reply to my SAR - but if not then we'll have them - they told me they were SatLite Ltd when I called to check - now they're answering the phone as Sampora!!
I imagine that this is what they want - they hope we'll get sick of pursuing them and then they can move on to the next unsuspecting victims - well I'm not, those Directors have a lot to answer for and I'm going to call Action Fraud at the beginning of next week if I've still not heard from the Fraud Squad - they must have had many complaints by now. Thanks for your trust Lizzie, I just wish the others would let us know what they want to do. I'll give it a couple of days for everyone to respond and then we'll put our heads together about it. They cannot get away with this!

    Hi all,
Just glad i found this site albeit to late. Same story as most cold called, gave card details, became suspicious, cancelled card, sent cancellation letter etc. All this roughly 12 months ago. Thought it finished with as others on this site did. Then it rears it's ugly head again in the guise of CAPITAL CREDIT MANAGEMENT. Paid debt of £120 with card details. (hadn't found this site at time). Then noticed LENDING STREAM had debited my account, alarm bells! I have never dealt with them before. Have informed bank, they are writing to this company to get explanation. Have been in touch with trading standards C.A.B. and Action fraud (strongly urge others to contact Action fraud).
P.S. Please keep check on your statements for any suspicious withdrawals. Stay safe.

    Hi Martin, Hi All,
Martin mate, please dont worry about the latest capital credit crap its just another way of trying to scare you into paying these scum easy money. Look back at my last blog, i have the same letter on ORANGE PAPER, woooooooo, scarey, please dont give any card or bank details whatsoever to these scum coz for one thing you never know where theyre going to end up, probably to some other bell ends who will no doubt try and scam you out of even more money, and then where dose it end eh?
Not me folks, the only way im gonna part with any money is if a JUDGE in a real court says ive got to. and im a mlillion per cent sure that thats never gonna happen. these scum probably bought our details in some way from the satlite cockroaches and send letters to us all in the hope that some poor sods will crack under the strain and give in, but like i said, where dose it all end,
To my mind the only way to stop these scum is TO FIGHT THEM USING ALL THE MEANS AT OUR DISPOSAL, they keep on but guess what? SO CAN WE, and i know that in the end, WE WE WILL WIN. stay strong and focused people.  Regards to all, Joe.

    Captain America replies to Katy
Its Captain America here, and as noted earlier I work in compliance, in banking, with lawyers and things like this as part of my job. These [***], have not yet replied to my letter. When you complain via the Ombudsmen, to capital credit, they have to respond within 8 weeks. So far I have not received anything. interesting because some folks on here are getting orange letters about court, but I have yet to receive one. I sent them a strongly worded letter without devolving into cursing or anger laying out the facts, I also sent two letters because one entity is registered, but it won't be the entity that is actually sending you these scam letters. I also made copies of the envelopes, and I refused to sign, I signed with an X, and told them I don't trust them with my signature in case they tried to produce a phoney contract. Hopefully it did the trick and they went away. It is a real shame how the world is, in the old days, we could have armed ourselves went down, and buried them all up to their heads near the Thames and waited for the tide to come in while drinking cold pints in this wonderful letter. As usual I still wish cancer on all Satlite employees, Sampora employees, Capital credit employees, and their children.

    Hi All

Received a letter today from Porta Verde Financial Services in response to the complaint sent to them by the Financial Ombudsman on my behalf. PVFS is the regulatory principal of Sampora (which was Satlite, which was Skylite Ensured) and they are responsible for making sure the company complieswith the rules set down by the Financial Services Authority for insurance related business. HAH!!

"We apologise that you have had cause to complain and in accordance with the FSA's requirements, we will attempt to provide a full response to your complaint within 8 weeks. We hope to be in a position to respond earlier than this but, in the interim, if you have any questions or would like to discuss this matter further please feel free to contact me."

I suppose its a waiting game now. Tried to find a link between PVFS and Capital Credit, but there doesn't seem to be anything.

Captain America - having finished a course of aggressive chemotherapy for cancer in May, I heartily second your wish for the employees responsible for this mess!

    Hi Lizzie,
I'm going to contact the financial ombudsman again I think - I didn't get very far with them last time but  I wasn't sure of the Sampora link then. I'm amazed you've had a response!!

I'm so sorry that you're having this to deal with after having to go through chemo - you should be enjoying yourself now not worrying about this mob - even more reason to get them!

As you say, we all continue to wait....in the meantime I hope everyone has a good weekend, enjoy the sunshine while it's here.

It is a very good reason to go for them Katy - I've had the worst thing that can be thrown at a person, and then these low-lifes think they can make easy money by scamming me! Well they can think again! Meanwhile, I've enjoyed the sunshine in my elderly aunt's garden....oh my God, don't tell Satlite I have an elderly aunt!!!  Keep the faith people!

M - Orange letters don't mean anything unless the address at the top of the letter is Maidstone County Court. Anybody can print a letter on orange paper, but I doubt that any County Court would. I'd be far more worried about red print on white paper - and there you go, I've given them a hint as to what to do next! (I doubt they are intelligent enough to know how to change the font colour).
Please don't worry about orange paper folks - its not an official legal letter colour! Its just another tactic that Capital Credit are using to get you to pay up what you don't owe. Report it all to Action Fraud and take their advice.

I will not pay anything until they prove it

Technically, your issue isn't with Capital Credit (lying, cheatin scum though they are). They're not bothered about the contract, they just bought the debt. Write a letter to Satlite under the Misrepresentation Act 1967, stating your so-called contract number. Ask them to review any phone calls between you and them,  send you copies and transcripts, and rescind the contract, refunding any charges. Send a copy of this to Capital requesting that they freeze any interest and stop any recovery action until the matter has been resolved with Satlite.
In an ideal world, the powers that be will decide that Satlite are guilty of fraud and misrepresentation, those of you who have paid Satlite will have refunds, Capital Credit will be ordered to repay folks who have made payments to them and then Capital Credit will go after Satlite to get back the money they lost!

    Hi All.
Check out, Unenforceability & Template Letters - MoneySavingExpert.com forums for brilliant guides on what to write to these scum, how to put it, legal terms etc..
    Other news.
Got some info back from my local MP on these scum, very interesting stuff, plus ive got a personal meeting with him shortly.
Katy, if we want to form an action group against these scum but are wary of giving out details over the net how about if you ask your MP to talk to my MP and get them to pass our details over to eachother and then they can pass them back to us? That way we can all contact eachother safely and really take the fight to them as an organised group. What do you all think of that? Please let me know.
Keep the faith people. Regards to All.
                                                               Joe.
