It's such a hard decision. I was told by one agency that it would be very difficult to fight it after it was paid, but my Mum was so distressed we paid it. Won't stop me trying to get them though!
I'd suggest calling Action Fraud and discussing it with them before you think of paying it. If you're convinced that they misrepresented themselves when they called you then you could report it as a crime as Joe has done, make sure you let all parties know that you dispute the case and then have a word with the CAB as soon as you can for legal advice before you decide whether to pay or not.
I'm so sorry I can't help with your decision, but I know how you feel. You're not alone, we're an army of 3 now and hopefully growing and there's strength in numbers!
This is more or less the SAR letter I've written:
Dear Sir/Madam
Please send me the information to which I am entitled under section 7(1) of the Data Protection Act 1998.
I am requesting all of the information you hold regarding myself, including all transcripts of any telephone conversations between myself and your representatives.
I enclose a cheque for £10.00 to cover your costs.

Yours faithfully.....
Keep it simple and pick what you need from the above, but quote the Data Protection Act - don't forget to send it at least by recorded delivery.

I have been on the phone for 2 hours phoning everyone one of the people you have advised to call.
I got back from holiday to find a letter from Capital Credit Management asking for £114.00 and apparently will be going up to £165.00 as of 5.00pm today.
Exactly the same thing happened to me. Satlite phoned me saying that they were part of Sky and that the insurance on my box had expired and that I HAD to take out more insurance on the box. I stupidly did this but when I did not receive any paperwork through the post I cancelled my direct debit as I did not have any contact details to do so by mail.
I am fuming!!!!
I too have phoned Action fraud and a lovely man named Phil was brilliant. Apparently your credit rating is not effected until the court judgement goes through. They also say that if you fight it they tend to stop contacting you.
I was very tempted to pay myself when they said that that it would be going up to £165.00 as I had not paid it within 7 days but if I paid today, as I have been away I could pay the £114.00!!! How kind. - Katy replies to JackieHi Jackie, this is great - we're an army of 4 now!
I have to say, had it been myself who'd been targeted I wouldn't have paid it, but Mum wasn't sleeping and was so worried that she'd end up owing £££'s if things didn't go well.
I'm so glad someone suggested Victim Support to you, there's an option I hadn't thought of and they will no doubt be able to offer help to alleviate the worry.
If you can, please keep us all up to date as to how you're getting on - things seem at a bit of a standstill for me at the minute but I'm going to re-e-mail Watchdog and my local radio station, batter them in to submission hopefully!

Take time to read back through all of the posts on this site - so many people have posted so much helpful information it's brilliant and I'd really like to take the time now to thank everyone properly.
Call the people we have recommended, like Action Fraud and National Debtline and Consumer advice - don't leave this, you need advice!
Keep checking back here regularly as people are constantly posting helpful links etc., and don't forget to contact Watchdog, the press and your local MP- very often their office will take the case up for you.

Will get on to National Debtline after I've collected my granddaughter from school! Didn't sleep much last night worrying about all this but the more people join in and the more I talk to these agencies, the better I feel. Thanks everybody.

- Katyjust called Action Fraud, they're experiencing huge volumes of calls at the moment due to a massive recent fraud involving thousands of people (not ours!) so when you call be prepared to be called back by them within 5 days. YOU SHOULD STILL CALL - THEY WILL CALL BACK TO TAKE DETAILS ON THE NUMBER YOU LEAVE WITH THEM.

I ask that in (7/14 however long you're prepared to give them) days from receipt of this letter, you review your recorded phone calls, send transcripts of these to me, and rescind this contract, refunding any charges.
Send a copy to Capital Credit Management asking them to freeze any interest and stop any recovery actions until the matter is resolved with Skylite. Send all recorded delivery.

- Captain America replies to LizzieM| 6 repliesI will explain my situation briefly. I received a phone call a year ago from Satlite stating they were associated with SKY. I never answer cold callers and I am always rude to the scum, but I was tired from work and made a mistake as I just got my Sky satellite set up and thought Ok the insurance may be ok, I realized it seemed far to expensive I said I would be ok with a down payment with a contract to follow they were very persistent but said I would get details. Like an idiot I gave my card out over the phone which I will NEVER do again. I soon realized it was a scam, and cancelled, they probably got forty pounds out of me, and I reported it to my bank as a fraud and got a new card. Now a year later this bogus capital credit is sending me letters. I work as a compliance officer at an investment bank. First of all, DO NOT PAY them, I feel bad for the person on here who paid capital credit, it may be difficult to get your money back. They can not affect your credit rating. They have to take you to court, imagine in front of a judge who would win anyways. Plus, they use an unregistered company to harass. This company failed to do due diligence on the Sat Lite company, and they buy up credit, they hope by sending threatening letters and phone calls they will get a percentage of people to pay. They charge a random amount like forty five pounds that increases each week. They have no evidence, they would have to provide a tape of the phone call that validates you were not actually misled, which I was in my case, that can not be binding. They will have no contract, Sat Lite sent no notifications. I formally complained to the financial ombudsmen, that means they have eight weeks to address my complaint. On top of this they can not randomly charge you each week, I have no contract with the credit agency either. Both companies are scams to fool the elderly they operate and pretend they are within the law. They should be physically tortured, one can only hope they all have horrible lives and after lives.
Now they sent me a second letter that someone will show up between 8am and 9pm monday through Saturday. That is so hysterical, so I should quit my job to wait 13 hours for them to randomly show up within the week. I hope they show up so I can call the police. Basically they would have to drag me to court which they will not do. I am waiting for a response to my letter now. I will if I have time drop in to my local police department.
Keep fighting them, don't pay them. Praying they all get cancer. - JackieI am going to try and get in touch with the Ombudsman tomorrow to see if we can do anything else. I think we have to put in our complaints first but there will be no harm in asking for advice there too.

I'm fighting this for my Mum now that she's paid it, she really is so distressed by the whole thing that she just wanted it gone, She knows she'll probably never get her money back but that's not the issue for her now (and I'll do my utmost with the rest of you to get this put right). The thought of her even having to go near a court broke my heart and she wouldn't be able to cope, she's so disabled she doesn'T leave the house without one of us and she's in a wheelchair, the thought of those callous....

Took £6 out of her account every month until I noticed it on her bank statement. She never required sky cover as all feeds where supplied to her warden assisted home free of charge. She was conned into giving her bank visa details so the only way to stop this was to get a new visa card for her. I tried many times to cancel the contract but was always cut off after a long wait on the phone, no e-mails were replied to either. Wrote a recorded delivery letter cancelling and got no reply. My poor Mum has now received the threatening letter from the bogus Capital Credit Management debt recovery company. I phoned them and got a VERY unprofessional response from some rude git who hung up on me. I shall not be bothering to reply. They are absolute [***]. They prey on old a vulnerable people.Someone should pay them a visit.
