    Has anyone heard of DBF Law Uk, they have written and e mailed me on the Sunday of August Bank holiday weekend and threatened to have a debt collector on my door within 10 minutes,.  They say they are the largest debt recovery agency in England but I have reason to believe that they are part of Studio 31 who have scammed hundreds of pounds out of me this year.  We paid what they said we owed and then I registered with TAPA and they told us to claim it back as it was a con.  They have now contacted me and said they are taking me to court and the amount has doubled.  The man  who spoke to me is called John Roberts.  Am now in contact with an investigative programme on Sunday evenings on Radio 5 live.  Who are investigating the whole company scamming and Tapa.  Will be broadcast next Sunday 21st October.

    There is a company that uses that name www.dbf-law.co.uk but they cannot send bailiffs to your address without a CCJ against you which they don't have at this stage.

    If they phone again they will ask you a series of questions at the beginning of the call such as date of birth etc. Just refuse to answer those questions and then they cannot talk to you any more because they can't identify you under the DPA.

    Of course, they may sue but they will not get any more than the sum of the contract plus court costs. They won't be allowed to add their debt collection costs in the way they are attempting to do.

    Each time this thread has another post added it becomes more of a farce! Tapa tell people random info gets posted just to bulk up the threads in the hope people see how many pages there are rather than read each thread and yet again prove their worth as the evidence is all on just this thread alone, let alone the other threads that seemingly link tapa to any number that ever dials out! Crazy!

    Have you read their notice board and press releases? There is some interesting info on there about companies they have had complaints about and investigated then handed over to the relevent authority, be it police or government that then the insolvency service or police release their info months later saying they have shut them down or made arrests.

    It kind of puts to rest the accusations of them being behind the initial scam if they not only help get money back but then also instigate the closure. You can check their claims of helping trading standards and the police by calling them so no need to take tapa's word for it! After reading the filth on here I understand I'm wasting my time on advising that course, but, hey ho!

    It's quite amazing Mr North you seem to repost old info. After finding and reading this old thread it's clear tapa are a victim of the same fraudsters as the business owners, possibly even now after so much nonsense though less people will fall foul of this type of bogus thread.

    A TV ad for Tesco stated “ Right now at Tesco this succulent leg of lamb is only £6 per Kg. These packs of fresh vegetables are only £1 each. And these delicious pizzas are only half price. These are just three of hundreds of special offers in store each week, to help you spend less each week. And when we compared prices with Asda’s on Saturday the 30th of January, shopping was cheaper for over 1.1 million Tesco customers. Tesco. Every little helps”. Tesco baskets were then shown alongside Asda baskets with the statement “1,150,000 cheaper” and “940,000 cheaper” The footnote stated “Equivalent products compared, covering over half our customers’ purchases, includes promotions. Excludes multibuys, non-matches, Express, selected Metro. To verify contact Tesco Price EN8 9SL or www.tesco.com ”.
    Issue

    ASDA challenged whether Tesco offered an appropriate means of verification for the basket of goods comparison.

    Tesco explained that the ad offered two means for obtaining verification for the price comparison claims: directly from Tesco by writing to a postal address; or by visiting the Tesco website. Tesco said the website contained an explanation of the methodology they used and a summary of the top line figures. They said the website also stated that Tescos head office could be contacted for further verification data. When ASDA requested verification information, Tesco said they sent them a copy of the methodology they used, a list of matched lines and a list of 380 baskets they selected at random, showing the contents of each basket.

    Tesco stated that the data for the advertised comparison was sizeable and no individual was likely to have the software capable of handling it. They therefore made a statistically significant random selection that featured all of the lines found most frequently in customers baskets. However, Tesco said it would not necessarily contain every matched item. Tesco argued that the 380 sample size was a statistically significant representation of the total number of baskets. They said they applied the appropriate mathematical formulae to the data and were confident that a random sample of 380 baskets was sufficient to provide a representative number of the total two million transactions at a confidence level of 95 per cent. Tesco explained that the data was held in a statistical analysis software package, which allocated each transaction an identification number. They said there was no manual intervention in the random selection process and they believed the robustness of the method had been proven in the multiple random tests they had carried out. Tesco sent us a copy of a letter from their chief mathematician to support their assertions.

    Tesco believed that ASDA had previously accepted that this method allowed them to adequately verify the comparison. Because the sample data was representative of the whole, Tesco believed that consumers and competitors could be confident that the comparison was properly conducted.

    Tesco understood that the European Court of Justice judgement in Lidl v Colruyt in 2006 indicated that a comparison should be verifiable. They noted that the judgement itself did not explicitly state that all data would need to be supplied, and merely indicated that comparative claims should be capable of verification and that the consumer should be able to access that data to satisfy themselves of the accuracy of the claim. They said most consumers were satisfied with a description of the methodology they used and reiterated that it was available on their website. They confirmed that no consumer had ever requested the sample verification data.

    Clearcast said they had been assured by Tesco that the full data set for the comparison would be available to consumers if they so wished. They said the ad gave a website and postal address for verification purposes and, although the full data set was not available on Tescos website due to size limitations, they noted that a consumer was able to request the full set of information from Tescos head office. They therefore believed that the ad satisfied the requirements for comparative advertising.

    Upheld

    The ASA noted that Tesco supplied competitors and consumers with a sample of their total number of baskets and understood that they believed this was a statistically significant representation of the total number of baskets. However, we considered that in order for a competitor to verify the claim, Tesco should have disclosed the full data for the total number of baskets on request so that the competitor could then interrogate the data and ascertain for themselves whether the comparison was accurate. Because Tesco only supplied a sample of the baskets they had compared, we concluded that the basket of goods comparison was not verifiable.

    The ad breached CAP (Broadcast) TV Advertising Standards Code rules 1.1 (Complying with the law) and 5.4.6 (Comparative advertising).

    Action

    The ad must not be broadcast again in its current form. We told Tesco that in future they should provide consumers and competitors with the full data set for comparative claims for the purposes of verification.

    Bogus TPS Calls
    The Telephone Preference Service is completely free to consumers.

    TPS will not call a subscriber of the service to ask for personal details or payment to complete a registration.

    If you have registered via the web and have received an e-mail confirmation and clicked on the attached link, that's it! Your number will be registered for FREE with TPS.

    We will not contact you again in relation to your registration (unless you have number(s) registered with the Corporate TPS, where we will contact you annually by email to renew your subscription - this is still a free service).

    If you do receive a call from someone claiming to be from the TPS or a similar sounding organisation, asking for personal information or charging you for this service, our advice is to not pay or give them any personal details, it is most likely a scam.

    We are aware of a number of organisations that call from overseas, possibly India claiming to be TPS or affiliated with TPS or BT. They ask for your credit card details to complete a registration to stop unwanted calls. They often claim that you previously gave your permission for this call. This is a scam. Never give out your credit card details over the phone.

    There are other companies that are not necessarily scams but they are not TPS. They usually claim to offer a similar or even an enhanced service to TPS.

    They make exaggerated claims about the effectiveness of their service and may even suggest that TPS does not work.

    My point was that complaints happen. Tesco blatantly charge over the odds for the majority of their stock (refer to recent tv commercials where asda is far far cheaper), is that not exploitation of customers that may not be able to travel to a cheaper alternative? No, It's competition with other providers of a similar / same service.

    If the TPS atually worked then there would be no arena for companies to set up and claim to do what the TPS has not managed (stop the unwanted calls). I have 1st hand experience of both TPS and tapa and tps stopped a few calls but not con merchant ad companies, not 'market research', not Indians wanting to access my computer, not the AA wanting to 'ask a few questions' . . . . the list goes on. Tapa has not stopped the AA calling, nor has it stopped the overseas calls but they stopped the con artists in their tracks and not once can I see where they claim to be tps nor have I been given that impression.

    On a final note, research how many fines have been issued as a result of the tps since it began all those years ago and ask them why it's so few. The tps is simply an office that handles complaints then passes them to the ICO or OFT. To make a complaint to tps you need more information than you most times will ever get thus rendering it useless. Personal experience has made sure that I never bothered the second year. My advice is to call your phone service provider and block witheld numbers coming through.

    Oh, if you think I'm an isolated case just google it. Tps stop cold calls which means if you have ever filled in a form, called a company with an enquiry or initiated any form of communication you are 'allowed' to be called back. Great!! Some are happy with tps without a doubt but if a sales company pays no attention to tps, blocks its number and is vague with details how do you report them?? Plus, if I get a claim filed against me by a rogue publisher will tps help me with a defence? will they stand in court with me? Unlikely. Tapa will and have for other people. No, there is no hidden cost for that either. Whats your experience with tapa btw? You are aware tapa on their website direct people to tps if they have not tried them yet? Not the best at pretending to be them if they in the 1st line on their website explain they are not them!

    No. You should report your concerns to the Companies Investigation Branch about any such company and your local trading standards office who will investigate and take them to court if they are found to be working against the public interest.

    Are you aware how long these scams have been going? I have little faith in making a complaint. CIB also would not help me file a defence or go with me to court. Tapa are ther instantly when I have a problem and have been to court for others.

    I pay tax which goes towards public services including the police. I still also pay ADT for an alarm as crime is rife! Are you saying adt are milking me as the police should do what they do, i.e. prevent crime?

    You seem to be under the impression the best way is the free way (if there's such a thing?!). Theres a reason these companies exist you know, because the free way does not work. If tapa have thousands that have been to trading standards or the police etc etc etc and still have the problem yet tapa have helped them why is that bad?

    You HAVE to respond to a court claim genuine or not and making a complaint will not change that. I blame the government, but where does that get us? I know you titled yourself as help but deterring people away from an extremely helpful company seem's as much irresponsible as anything else. I read the oldest comments with interest that tapas this and taps that and the police are investigating as are trading standards. If they were genuine ask yourself why they still let them trade. Surely they would have concluded their investigation? I also read in other places they have already been shut down and so on. Seems there is a reason behind these bigus posts and tapa says its the rogue traders stopping victims getting help. Kind of adds up now. Even the government and police shut down the rogue traders faster than that so one must accept they are doing something right. They had an ajudication as they set a service up and rightly or wrongly were not clear so they stopped that service. If they were that bad then why not just carry on?

    It's a weak but interesting link. I only say weak in the sense that there are an awful lot of websites with direct links to others yet are only connected by that link. On the other hand if it is true then at least both sites are informative, helpful and clear in their intentions. 1 pretty much tells you what sales company has called and connects people with problems, much like this one yet seems far less agressive in it's content (no charge either so free information). The other had problems which were sorted and by the governments own admission (trading standards) they have no problems with tapa and have received numerous reports about bogus ad companies.

    I strongly urge you to contact Merseyside police who they have assisted by giving them evidence and reports, 1 of which resulted in a prison sentence for the person they reported and the other that looks likely to go the same way as is being looked in to now.

    I do not 'support crime' neither do I intentionally set out to try and ruin a company that helps people.

    Last question, why are you so against them? Have they not worked for you? Do you run a firm they are looking in to? Are you a relative of somebody that is in prison because of tapa? I have stated several times my position but seemingly the posts from yourself under different pseudonyms never seem to indicate you have actual 1st hand experience of their service.

    I have called the courts a while back and they confirmed this information about tapa going to help these people. Can you argue with HMCS now and say they too are wrong?

    If this so called ex-con does run them then ok, not ideal but I'm sure you are aware there are far worse people that have done much naughtier things that have turned their life around and become successful and actually celebrated members of society. You may remember a very popular film a few years back called Catch me if you can based on the life of Frank Abagnale. Duncan Bannatyne did a spot of military and civilian jail time and the list goes on.

    I would be reluctant to believe that an alleged king pin as this site would have us believe is in direct contact with government offices, the police, national newspapers and the courts. Especially when all sources confirm they have indeed not only had stuff from them but also visited their offices, seems a little far fetched doesn't it?

    Did you call the courts, police, trading standards, or ico? The info about the ruling has been repeated that many times it's just nonsensical. Only in the sense that 4 complaints were made and in the ruling the asa actually say although the info was on the site because it was still posible for someone to miss it they upheld the 4 complaints. I still use talk talk even though for 3 or 4 years they were the most complained about service provider, a mantle recently taken by orange (yes, the mobile phone giant) but I'm sure they will still have customers for many years.

    If you ask trading standards about them not putting a name on the site they pretty much say they are aware and alow it. Speaks volumes.

    Report them to OFT for it as companies house have no power as it is (or most certainly seems to be) an unlimited partnership not an LLP. It seems that like your own and many posters before you on this very thread have been "reporting" them for years, are you not puzzled as to why they are still allowed to do what they do? Is it maybe because the powers that be let them for very OBVIOUS  reasons ;-) . . . . . . They actually help!

    Anyway, final point, is a complaints procedure not ther when people are not happy with a service not to go to and say, "I saw a bogus post from a total stranger telling me I should complain, so i am, yet i do not have a problem with them?

    it seems a bit too personal on here when posters that don't come on with a grievence but just regurgitate very very old posts and almost demand people make complaints but seem uninterested if people actualy have any reason to. It's almost as if the reason is because tapa is having a very negative impact on that person. Now, if tapa is helping people that have been conned, I ask who possibly could want them shut down so very badly?haha!#transparent!

    1. So TAPA, The Advertising Protection Agency, is an "unlimited partnership", defined within the BIS document http://www.bis.gov.uk/assets/biscore/business ... or-business.pdf , as a Partnership and thus an unincorporated legal form, the distinguishing feature of unincorporated forms being that they no separate legal personality.

    Partnership

    A Partnership is a relatively simple way for two or more legal persons to set up and run a business together with a view to profit. A partnership can arise, without any formal agreement, when people carry on a business in common, but typically there is agreement to trade as a partnership. Partners will usually draw up a legally binding partnership agreement, setting out such matters as the amount of capital contributed by each partner and the way in which they will share the profits (and losses) of the business.  
    Again the Partnership has no separate legal personality. Partners share the risks, costs and responsibilities of being in business. Because partners generally bear the consequences of each other’s decisions, partners usually manage the business themselves, though they can hire employees. Partners usually raise money for the business out of their own assets, and / or with loans, although again being unincorporated limits borrowing in practice, and not being a company with a share capital prevents the
    business itself from raising equity finance by issuing shares.

    Each partner is self-employed and pays tax on this basis on their share of the profits: The partnership itself and each individual partner must make annual self-assessment returns to HMRC, and the Partnership must keep records showing business income and expenses. Legal persons other than individuals – such as Limited Companies or Limited Liability Partnerships – can also be partners in a partnership. They are treated like any other partner except that they have additional tax and reporting obligations – for example
    companies must pay corporation tax rather than income tax on their profits from the partnership.

    2. And that TAPA is not a:

    i) Limited Partnership

    Not to be confused with a Limited Liability Partnership (see below) – a Limited Partnership has two sorts of partner: general partners and limited partners. The form is similar to a Partnership, with the main differences being that the limited partners may not be involved in the management of the business and their liability is limited to the amount that they have invested in the partnership. Note that limited partners are different from ‘sleeping’ partners in a Partnership or Limited Partnership, who do not take part in running the business but remain fully liable for its debts.  Limited partnerships must register at Companies House, and do not come into existence until they are registered.  Changes to the partnership must also be registered

    ii) Limited Liability Partnership (LLP)

    A Limited Liability Partnership is a body corporate with a separate legal personality similar to a company. Unlike in a normal partnership, the members of an LLP enjoy limited liability as the name suggests liability is limited to the amount of money they have invested in the business and to any personal guarantees they have given to raise finance. Each member takes an equal share of the profits, unless the members' agreement specifies otherwise.  

    Much like a Partnership, each non-corporate member of an LLP needs to register as selfemployed with HMRC, and both the LLP itself and each individual member must make annual self-assessment returns HMRC. Non-corporate members of an LLP pay income tax and national insurance contributions on their share of the profits. Additionally, LLPs must register and file accounts and annual returns at Companies House. At least two members must be “designated members” who hold additional responsibilities – it is they who appoint auditors and sign off and file the accounts at Companies House.

    Limited Liability Partnerships have much more freedom than companies over arranging their internal affairs, for example in the way in which decisions are made, and the way in which profits are distributed to members.

    iii) Nor a Sole Trader, Unincorporated Association, or any type of incorporated legal form such as a Limited Company.  

    2) Given the above, and that the The Business Names Act 1985 ( http://www.legislation.gov.uk/ukpga/1985/7 ) requires the disclosure of the names of current partners where the firm (in this case TAPA) has a place of business (which in TAPA's case is 27 Old Gloucester Street, London, WC1N 3AX) and carries on business in Great Britain under a business name (TAPA) and which does not consist exclusively of the surnames of all of the partners, why are the partners so reluctant to comply with the The Business Names Act 1985 and not publish their names?

    3) Given that TAPA by definition has no separate legal personality...

    i) when an individual or company instruct TAPA, who exactly are they entering into a contract with?

    ii) How can a third party conduct due-diligence if the partners are unknown?
