    Do they ever stop calling? I didn't answer the phone and I'm not calling them back. I know he is not a real attorney because he isn't licensed in Pennsylvania. I checked. I called my phone company to get the number blocked, but they said they couldn't do it since it is cable phone service. However, they are trying to block the number for this whole area since I informed them of the scam and all of your helpful comments.

    I believe this is the same company I have been dealing with for the last 9 months!!!! I have actually gave them money....thank god only like $500.00 or less...I thought it was weird that they stop calling me for awhile and just recently started again. Unfortunately...they have my banking info, so I am closing this account ASAP!!!The letter they sent was so real and I did have that debt along time.....They say every month that my file is going to be fowarded and they are in contact with this old creditor. I will be expressing my found new knowledge of this company when they call me again

    about a month ago, they called my daughter, my parents and sister, who is married and has a different last name than my parents and I.  I don't know how they tied us all together.  Their call to us was a bit different.  They didn't accuse any of us of owing anything -- and none of us do.  But they are asking to confirm our names, our addresses, and our relation to a "Linda McCartney" who we gave positive references for.  References for what, I don't know, and none of us gave any references anyway.  I don't know how this works into their scamming.  Well, yesterday, my 80 yr old Father gets another call wanting to confirm a past address.  This time, though, they did not identify themselves as being from Landis office.  I am guessing they were, but no proof.  Anyway, my dad would not tell him anything, and he got rude.  Dad finally hung up on him.

    Advice from an attorney friend is that if anyone gets a call from his offices, or from anyone not wanting to identify their firm, do NOT confirm anything at all, tell them you will answer their questions if they contact you officially via accepted legal channels, and hang up.  Remember, ANYONE on the phone can claim to be anyone else, so you really don't know who you are talking to.  I think instead of all of us venting on this site, we should each independently report this firm to the Bucks County and Pennsylvania Attorney Generals offices.  as well, I am planning on contacting the local Media to see if they want to dig into a juicy story.  When you consider Landis' partner is in Jail right now, and the means by which this firm violates not only the law but just good manners, I think they would love such a story.

    ok....few things here..for all of you.  First, Tom Landis is an attorney. The Law office of Atty Tom Landis is an actual functioning law firm and ..yes, they specialize in debt collection. The collector's there are bound by the FDCPA and they are monitored for compliance. If a collector threatens you or is harrasing you, all you need do is ask to speak to his ir her manager and they will handle your account. ((they have to, or they will loose thier job)) Bottom line here is collections is a difficult job, and ((you guy's *debtors** should admitt..your not the easiest people to contact because you never answer your phone. Oh and also..if you want the calls to stop  PAY YOUR FREAKIN BILLS!!
    Complaining about treatment is not helping you. You WILL have to pay eventualy and the people that are calling you have the ability to offer you a settlement and save you a lot of money  ((that you owe))

    My wife just got a call from a Kim Jones at TOM LANDIS's office.  She asked for my wife using her maiden name, which she changed more than 5 years ago.  She would give me NO information and was a complete [***].  She talked over me and wouldn't let me get a word in edge-ways.  She would not tell me where (in the country) she was calling from (told me it was against the law to tell me !! B.S.!!)

    When my wife called her back, this Kim Jones person would give her NO information but started asking questions about someone with the same name as her Brother (who is a cop).  We basically told her to get lost and hung up.

    They're basically trolling for anything they can find on people who may or may not have debts.  They're obviously doing internet searches on the names etc. and trying to connect people.

    first, "amused reader" above appears to be a shill for the law office of ted landis, which means the chances are rather high that he/she is one of the winners calling you people.

    this "firm" appears to me to be somewhat suspect.  a friend of mine got a call about a debt that was FAR outside the statute of limitations; after she told them to go to hell, she got a letter from some "credit consolidation" company offering to issue her a credit card so she could pay off this non-collectible debt. in other words, this "firm" just transferred the account to some other company. that is exactly what i expected, as this friend is not located in PA, and the credit card that gave rise to the debt was not opened in PA, so this unless this "firm" had an attorney in her state, and they appear not to, they were powerless to do anything.

    i am sure tom landis is actually a lawyer, but i highly doubt his office is anything but him and some non-attorney subordinates. chances are, if you are just being called for the first time or two (or three or four), an attorney has not yet reviewed your file. they may or may not be able to substantiate that you owe a debt (which in many cases has been sold and resold to numerous third parties for pennies on the dollar).

    as a practicing attorney, i can tell you that collections is one of the most gutter areas of the law there is, right below ambulance chasing and handing out business cards at a hospital. the work is mindless and suited only for people who passed the bar by some sort of miracle or fluke. sure, one might respond that someone has to collect debts for honest creditors (leaving aside the fact that most of the debts are not owned by the original creditors but by vultures who buy up old debt for a song). true, but someone also has to clean toilets. spend your life accordingly.

    basically, if you get a call from a collection agency, law firm, attorney, whatever, concerning a debt you think you might not owe or are unsure whether the party is on the up and up with respect to their authority to collect on the debt, contact a lawyer ASAP.

    I received a call from this law firm asking for a name that is one of my brothers.   He told me that my brother had given him my number as a second number.  Although I have a brother with the name he referred to, he told me a different birth date.  I told him that he must be mistaken as this was the wrong number.  I had a feeling that something was a miss.

    These jerks sent me a letter saying I owe them $9000+ for a car I purchased that wasn't even worth $5000. I am not amused by the almost $7000 in interest they are trying to charge me.  It's not amusing to be called a deadbeat for a bill I don't owe nor do I find it amusing that these people prey on others ignorance of the law.  DON'T give them ANY information about yourself.  If the debt is uncollectable because of statutes, if you in any way acknowledge that it may be connected to you, or send them even one penny, it reactivates the 7-years it can be reported to the credit bureaus and you give them or someone else validation to continue to try to collect the debt no matter what the origination date is.  One question: Why is Pennsylvania not doing something to revoke their ability to keep doing this to struggling people?

    These people have been calling me every few weeks for about a year or so and always leave a message for an ex-boyfriend.  I have called them back several times to tell them that he doesn't live here but I would pass along a message for them, and to stop calling me.  Today I lost my cool when a Mr. Fox refused to acknowledge that they are harrassing me for someone else's debt, after I've told them several times that this is not his phone number.  Then they had the nerve to tell me that I was harrassing them by calling them to respond to their most recent message for ex.  I told them to stop calling me and they said, "What are you gonna do, call the police?"  I wouldn't pay these unprofessional pricks a dime even if I did owe a debt.

    Thomas Landis is NOT a licensed attorney in the state of Pennsylvania! They aren't allowed to practice law!  They are a debt collection agency.  These scam artists dance around "unauthorized practice of law" (UPL) statues of the state of Pennsylvania.   Please search the PA Attorney Inquiry Search website at http://www.padisciplinaryboard.org/pa_attorney_search.php

    Also, verify "The Law Offices of Tom Landis" as a collection agency is licensed or registered with "your" STATE COLLECTION AGENCY LICENSING BOARD.  Most likely they are not licensed/registered.  If so, report to "your state" Attorney General.  Unfortunately, the State of Pennsylvania does not require the licensing of  collection agencies.

    Got a call from Allen Wakefield, for attorney Tom Landis on my landline. Left a msg. I was concerned since I didnt know of any attorney needing to call me.     I.  LEGAL AUTHORITY AND JURISDICTION

    The Banking Commissioner (“Commissioner”) is charged with the administration of Part XII of Chapter 669, Sections 36a-800 to 36a-810, inclusive, of the Connecticut General Statutes, “Consumer Collection Agencies”.

    Pursuant to the authority granted by Section 36a-17 of the Connecticut General Statutes, the Commissioner, through the Consumer Credit Division (“Division”) of the Department of Banking, has investigated the activities of Respondent to determine if it has violated, is violating or is about to violate the provisions of the Connecticut General Statutes within the jurisdiction of the Commissioner.

    Section 36a-17(a) of the Connecticut General Statutes provides:
    The commissioner, in the commissioner’s discretion, may make such public or private investigations or examinations within or outside this state, concerning any person subject to the jurisdiction of the commissioner, as the commissioner deems necessary to carry out the duties of the commissioner.
    Section 36a-51 of the 2008 Supplement to the General Statutes provides, in pertinent part, that:
    (a) The commissioner may . . . revoke . . . any license issued by the commissioner under any provision of the general statutes by sending a notice to the licensee by registered or certified mail, return receipt requested, or by any express delivery carrier that provides a dated delivery receipt.  The notice shall be deemed received by the licensee on the earlier of the date of actual receipt or seven days after mailing or sending.  Any such notice shall include:  (1) A statement of the time, place, and nature of the hearing; (2) a statement of the legal authority and jurisdiction under which the hearing is to be held; (3) a reference to the particular sections of the general statutes . . . involved; (4) a short and plain statement of the matters asserted; and (5) a statement indicating that the licensee may file a written request for a hearing on the matters asserted within fourteen days of receipt of the notice. . . .
    (b)  If a hearing is requested within the time specified in the notice, the commissioner shall hold a hearing upon the matters asserted in the notice unless the licensee fails to appear at the hearing.  After the hearing, the commissioner shall . . . revoke . . . the license for any reason set forth in the applicable licensing provisions of the general statutes if the commissioner finds sufficient grounds exist for such . . . revocation . . . .  If the licensee does not request a hearing within the time specified in the notice or fails to appear at the hearing, the commissioner shall . . . revoke . . . the license.  No such license shall be . . . revoked except in accordance with the provisions of chapter 54.
    Section 36a-802 of the Connecticut General Statutes provides, in pertinent part, that:
    (a) No such [consumer collection agency] license and no renewal thereof shall be granted unless the applicant has filed with the commissioner a bond to the people of the state in the penal sum of five thousand dollars . . . .  The bond shall run concurrently with the period of the license granted to the applicant, and the aggregate liability under the bond shall not exceed the penal sum of the bond.
    (b)  The surety company shall have the right to cancel the bond at any time by a written notice to the licensee stating the date cancellation shall take effect.  Such notice shall be sent by certified mail to the licensee at least thirty days prior to the date of cancellation.  A surety bond shall not be cancelled unless the surety company notifies the commissioner in writing not less than thirty days prior to the effective date of cancellation.  The commissioner shall automatically suspend the license on the date the cancellation takes effect, unless the surety bond has been replaced or renewed.  The commissioner shall give the licensee notice of the automatic suspension pending proceedings for revocation . . . and an opportunity for a hearing on such actions in accordance with section 36a-51.



    II.  MATTERS ASSERTED
    1. Respondent is a Pennsylvania limited liability company with an office at Four Greenwood Square, 3325 Street Road, Suite 220, Bensalem, Pennsylvania (“Bensalem Office”).
    2. Since February 15, 2008, Respondent has been licensed to act as a consumer collection agency in Connecticut from the Bensalem Office pursuant to Section 36a-801 of the Connecticut General Statutes.  Such license expires on September 30, 2009.
    3. On April 4, 2008, the Commissioner received notice from Hartford Fire Insurance Company that bond number 14BSBEQ8614 issued on behalf of Respondent with respect to its consumer collection agency license for the Bensalem Office would be cancelled, effective on May 12, 2008.
    4. On April 7, 2008, pursuant to Section 4-182(c) of the Connecticut General Statutes, the Division sent a letter to Respondent giving Respondent an opportunity to show compliance with all lawful requirements for retention of its consumer collection agency license in Connecticut.
    5. To date, Respondent has failed to file a new bond or a replacement bond with the Commissioner.
    6. The Commissioner automatically suspended Respondent’s consumer collection agency license in Connecticut for the Bensalem Office effective on May 12, 2008.
     


    III.  STATUTORY BASIS FOR REVOCATION OF
    CONSUMER COLLECTION AGENCY LICENSE

    Section 36a-804(a) of the 2008 Supplement to the General Statutes provides, in pertinent part, that:
    The commissioner may . . . revoke . . . any [consumer collection agency] license . . . , in accordance with the provisions of section 36a-51, . . . if the commissioner finds that the licensee or any proprietor, director, officer, member, partner, shareholder, trustee, employee or agent of such licensee has . . . (3) violated any of the provisions of sections 36a-800 to 36a-810, inclusive . . . .
    Respondent’s failure to maintain a bond that runs concurrently with the period of its consumer collection agency license, as more fully described in paragraphs 2 through 5, inclusive, of the Matters Asserted, is a violation of Section 36a-802(a) of the Connecticut General Statutes, which requires that the Commissioner automatically suspend Respondent’s license to act as a consumer collection agency in Connecticut from the Bensalem Office pursuant to Section 36a-802(b) of the Connecticut General Statutes, and constitutes grounds for the Commissioner to revoke Respondent’s license to act as a consumer collection agency in Connecticut from the Bensalem Office pursuant to Section 36a-804(a)(3) of the 2008 Supplement to the General Statutes.


    IV.  NOTICE OF AUTOMATIC SUSPENSION, NOTICE OF INTENT
    TO REVOKE CONSUMER COLLECTION AGENCY LICENSE AND
    NOTICE OF RIGHT TO HEARING

    WHEREAS, the Commissioner has reason to believe that Respondent has engaged in acts or conduct which, pursuant to Section 36a-802(b) of the Connecticut General Statutes, requires that the Commissioner automatically suspend Respondent’s license to act as a consumer collection agency in Connecticut from the Bensalem Office, and constitutes sufficient grounds for the Commissioner to revoke its consumer collection agency license for the Bensalem Office pursuant to Section 36a-804(a)(3) of the 2008 Supplement to the General Statutes.

    NOW THEREFORE, pursuant to the authority granted in Section 36a-802(b) of the Connecticut General Statutes, the Commissioner gives NOTICE that on May 12, 2008, the license of Law Offices of Donald S. Burak, Esq., LLC to act as a consumer collection agency in Connecticut from Four Greenwood Square, 3325 Street Road, Suite 220, Bensalem, Pennsylvania, was AUTOMATICALLY SUSPENDED pending proceedings for revocation.

    FURTHER, notice is hereby given to Respondent that the Commissioner intends to REVOKE Respondent’s license to act as a consumer collection agency in Connecticut from the Bensalem Office, subject to its right to a hearing on the allegations set forth above.

    A hearing will be granted to Respondent if a written request for a hearing is received by the Department of Banking, Legal Division, 260 Constitution Plaza, Hartford, Connecticut 06103-1800 within fourteen (14) days following its receipt of this Notice of Automatic Suspension, Notice of Intent to Revoke Consumer Collection Agency License and Notice of Right to Hearing as set forth in Section 36a-51 of the 2008 Supplement to the General Statutes.  This Notice of Automatic Suspension, Notice of Intent to Revoke Consumer Collection Agency License and Notice of Right to Hearing shall be deemed received on the earlier of the date of actual receipt, or seven days after mailing or sending.  The enclosed Appearance and Request for Hearing Form must be completed and mailed to the above address.  If Respondent will not be represented by an attorney at the hearing, please complete the Appearance and Request for Hearing Form as “pro se”.  Once a written request for hearing is received, the Commissioner may issue a notification of hearing and designation of hearing officer that acknowledges receipt of a request for a hearing, designates a hearing officer and sets the date of the hearing in accordance with Section 4-177 of the Connecticut General Statutes and Section 36a-1-21 of the Regulations of Connecticut State Agencies.  If a hearing is requested, the hearing will be held on July 8, 2008, at 1 p.m., at the Department of Banking, 260 Constitution Plaza, Hartford, Connecticut.

    The hearing will be held in accordance with the provisions of Chapter 54 of the Connecticut General Statutes, unless Respondent fails to appear at the requested hearing.  At such hearing, Respondent will have the right to appear and present evidence, rebuttal evidence and argument on all issues of fact and law to be considered by the Commissioner.

    If Respondent does not request a hearing within the time prescribed, the Commissioner will issue an order revoking Respondent’s license to act as a consumer collection agency in Connecticut from Four Greenwood Square, 3325 Street Road, Suite 220, Bensalem, Pennsylvania.

    5. Please verify under penalty of perjury that you know and understand that certain clauses in a contract of adhesion, such as a so-called forum selection clause, are unenforceable unless the party to whom the contract is extended could have rejected the clause without impunity.

    6. Please verify under penalty of perjury that you know and understand that credit card contracts are a series of continuing offers to contract and as such are non-transferable.

    7. Please provide verification from the stated creditor that you are authorized to act for them.

    8. Please verify that you know and understand that contacting me again after receipt of this notice without providing procedurally proper validation of the debt constitutes the use of interstate communications in a scheme of fraud by advancing a writing, which you know is false with the intention that others rely on the written communication to their detriment of (your name here).

Please provide me the documents I have mentioned in the letter, and please do not contact me again at the(your # here) 1-785-000-0000 phone number as my employer does not allow such communications at work. The Kansas FDCPA prohibits contact at my place of employment after receipt of this letter asking to cease contact at the above phone number.

    I know Mr. Landis replaced Mr. Donald Burak who is no longer in the law office because he has pleaded guilty to child pornography charges and is looking at 20yrs in prison.

    Please send this letter with my file when you sell it to the next collector.

    My ex-boyfriend received a telephone call from an affiliate of Atty T Landis, insisting they needed to speak with me in regards to a judgement against me that would be pursued as of January 1.  They refused to tell my ex what the judgement was for, would not give him a case number, but demanded a telephone number I could be reached at.  He would not give them my current phone number as he was not comfortable with the manner in which they spoke with him on the telephone, and he did not believe it right to disclose my number to the arrogant SOB that was on the other end of the conversation.  I decided to google the name that appeared on the caller id and found this site and information.  I'm really glad it was here.  I contacted my ex and gave him an appreciative thank you and told him to disregard any additional calls from that phone number.

    Got a call from this number,215 642 3400,I answered and this very rude lady told me about a debt I owed,that I had paid 10 years ago.the conversation ended up with me yelling at this lady and telling her not to call back.the next morning I received another phone call,telling me that they were having an affair with my husband,I am guessing they tried blocking their number,but it didnt work.got on the internet did some research.why are these people not being stopped,this is an outrage.
