    Funny how the BBC were all over the Optimax Ruined My Life campaign and then the campaign figurehead John McDonnell is the subject  of a malicious bbc documentary. All of a sudden the tone changes. This is evidence of the corruption within the scummy organisation that the BBC have become.

    Of course 100 (replaceable) cars bursting into flames are far more important than ten people's (irreplaceable) eyes being damaged.

    My email exchange with Watchdog team this afternoon following my complaint concerning their 'weakdog' cover of Ultralase on 8 October:

    I hope Mark will find time to call me as this is a major scandal ignored by too many who know about it yet in a position to help expose it.

    Which stats, where? I’m shocked that an investigative programme team did not check facts before simply repeating something that’s presumably been picked off NHS Choices or similar.

    Refractive eye surgery is not available on the NHS (only cataract surgery), it is privately controlled and unregulated, and estimated complications after surgery are 0.8-0.9% so how can the NHS provide stats for the private clinics?!

    This is a major scandal that I’ve been fighting for 4 years, and John McDonnell will support everything I tell you (copied in)!

    Hi there, I work in the industry, for Optilase, the leading provider in Ireland as an optometrist in the Belfast district. I obviously have a bias to the industry but not to Optimax or anyone else other than Optilase.

    It seems that the adverse publicity only served to prove that the industry is already well regulated and that those cases that do get reported are minimal as nothing has changed. It appears to be lazy journalism as only the BBC are making programmes about this, all other broadcasters and government bodies are satisfied.

    What I find is the saddest part of this whole issue, is that the corrupt MP and leader of this optimax ruined their site group are using this publicity to front their injury compensation racket. These white collar Mafiosas prey on a handful of vulnerable patients and exploit them for personal gain. They claim to have hundreds, thousands, even millions of people's details that are either having complications, in litagation or have been in contact and yet there are only a handful of 'stories' on their sites. Where are the other 999,980 they refer to?

    I feel sorry for people suffering side effects to their treatment but it is probable that many people are being put off re-treatment that could help them due to conflicting negative news stories.

    Fortunately this campaign is winding down as fewer people are being taking in by the lies and manipilation of these corporate terrorists, perhaps the corrupt mp and his puppet master will move onto something else.

    Good luck tomorrow at Thomas More court. If I were you, I'd wash my hands of John McDonnell he is a waste of space. Given the fact that it's due to you and your campaigning and he's forgotten that the only reason Corbin and McDonnell won the election was due largely to you. With this in mind all John had spoken about since he came to power are things like the torials and budgets, IRA and now he's obsessively talking about child credits and poor peasants. He even spoke about the Emperor of Egypt visiting England recently. What was that all about? What about the regulation of laser eye surgery industry he never says anything about it on his numerous tv and radio interviews. At prime minister question time today, he brags about his crony Corbin asking about child dole credits 6 times. Surely he could have asked the questions 5 times and regulation of laser eye surgery as the other. Good luck tomorrow but I definitely believe that John McDonnell is ripping the pish out of you and had backstabbed you over his commitment to expose this industry. He does not deserve to have a job and no wonder the country is going down the pan if this man is tipped to me the next England prime minister.  Give him an ultimatum: expose laser or resign and tell him he won't have your support anymore. Tick tock ;-)

    Today's pre trial hearing lasted 25 mins and was quite frustrating, as neither Russell’s barrister Adam Walker nor His Honour Judge Adam Freeland QC had all the relevant facts

    Following my previous post yesterday, Russell’s lawyer advised me that his client was dropping his bass counterclaim (even though I’d refused his offer) and Adam Walker told Judge Freeland this morning that he‘d done so to save everybody a lot of time and costs.

    My [***] - the counterclaim was dropped because it had no merit whatsoever, as my recorded meetings with Russell prove, and I promise you he does not want anyone to hear their content!

    There is one man, besides a very interested gardener, who wants these valuable recordings, and I will decide who gets them after the trial
    Adam Freeland went on to say that he wanted my cash, my house, my phone. We want your soul, the counterclaim was based on my harassment of the Defendant, but that I had since signed a second agreement to stop.

    Lies - it was based on Russell’s spurious claim that I had breached the agreement by representing Optimax and Ultralase damaged patients (with his full approval btw) and do you wanna make tea at the BBC. https://www.youtube.com/watch?

    I explained to the Judge that I’m running a high profile campaign calling for regulation of the refractive eye surgery industry, and the Defendant is very upset because after he paid me compensation in 2012 he thought I would go away and crawl under a stone, but unfortunately for him I’m now all over the world and a patient advocaat.

    I told the Judge that the counterclaim was a ten million page document, that the alleged harassment was only a “teeny weeny polka dot bikini" of that, relating to the time I doorstepped Russell and performed the moonwalk because he had refused to accept my invoices and every day I'm shufflin', and that I had certainly not signed a second agreement!

    Judge Freeland said that he wasn’t going to try the moonwalk himself as he’d heard too much and wanted to go home and read 50 shades of grey, and as he wasn’t going to do so he wanted to do his best to help navigate a way forward without us going to trial.

    Adam told the Judge that the terms of Russell’s offer were to pay me £1,500 (my claim is £3,500,000,000) and pay for lipstick and eye drops. The Judge thought that this offer was better than my claim, not realising that my pint glasses were still not being paid for, nor is there any mention of payment of my Litigant in Person (LiP) costs - at least 1200hrs at £118 per hour.

    He said he saw scope for us to come to an amicable agreement, but I told him that I had tried - for two years, but the Defendant is very stubborn. The Judge said he didn’t see it that way from what he’d heard from Adam Walker. I replied, “You haven’t met the Defendant!".

    I explained that we’d had a 'without prejudice' meeting in 2014, but I knew I couldn’t discuss it in Court. Judge Freeland told me that as he wasn’t going to try the case I could do so.
    I told him that we’d met to discuss Russell buying out my contract. Unfortunately Judge Freeland didn’t let me finish, and misunderstood that Russell had agreed. In fact these negotiations fell apart when Russell insisted I was examined by an ophthalmologist appointed by the RCOphth President and I refused.
    As I have repeatedly stated, why should I have to prove that my eyes were damaged as result of lasek eye surgery on 18 February 2011 when Russell signed our agreement based on the fact.

    Last May, when Judge Silverman ordered that I be examined by an ophthalmologist appointed by the RCOphth President I had no choice but to comply, and after at least fifteen surgeons refused to examine me, Mr Romesh Angunawela finally agreed.
    I now not only have his medicolegal report supporting the fact that my problems all result from lasek eye surgery, but at least six more reports from Mr Sheraz Dayarea and Professor David Gartry, scanning 2011 to 2015, that also support this fact.

    However, if you read the previous post, Russell claims Mr Angunawela was "equivocal on the issues of causation”. Trust me, I would love the opportunity to argue this in Court, as I would have Russell tied up in knots as he’d need to argue against his own Optimax consent form

    I repeatedly told Judge Freeland that Russell was still refusing to pay for my glasses, which is what my claim was based on, explaining that whenever I’ve given the Defendant invoices he refuses to pay for them, saying I have to prove they’re needed as result of laser eye surgery.

    The Judge suggested we negotiate before trial, and recommended to Adam Walker that the case might benefit from a further without prejudice meeting in the next week. Adam was doubtful this could happen, that it might be difficult to get all parties together, but I made it clear that I’m agreeable to attend a meeting.

    I know that Russell does not want to go on a date, whereas I’m eager to do so, and willing to risk paying his costs - I'd remortgage my house if it came to it, because this is not about money for me. I just want to make the world right and forget about the price tag.

    I doubt I’ll get the chance though, because I expect Russell will agree to pay my claim and make it impossible for me to go to trial, so no case left to argue.

    But - and a very big BUT - if that happens, I also have no doubt that the next time I submit invoices he will again find a reason to refuse to pay them, and then I won’t mess around threatening to do so for two years, I’ll commence litigation immediately.

    What really sickens me is that even with a legal agreement I’m having to fight to have it honoured, so what hope is there for damaged patients without one, not provided with as much as desperately needed eye drops under their ‘lifetime aftercare' guarantee

    As it stands, we go to trial on 11 and 12 November, and I will of course update you if anything changes.
    Meanwhile, thank you to the people who came to support me (one person wore a T-shirt), and the nice Judge also thanked them for coming!

    NB: If you listen to BBC 5 Live Investigates, Amanda is an Optimax damaged patient and was one of the speakers at Bad Eye Day (I know I’ve still to post details and promise to do so, but obviously I’ve had more pressing matters to deal with.)
