    Can I call you Darth?

    There are some clear indications that this is not as it seems (and maybe nor are you Mr Vader).  Do people believe that each credit card agreement is different?  Written just for them?  If there are flaws in agreements, then anyone in the business of reclaiming would have a list of good and bad ones on their wall and be able to say "Sage Cards, yes they messed up" or "Ham Cards, sorry can't do anything there."  But .. they don't, they say it will take a few months, time for their 'experts' to look over your agreement (yeah right), and in the meantime they will charge you a substantial amount (I was quoted about £900 including VAT).

    What's the worst that could happen?  They don't find any errors and in 3 months time they return your money and you end up with having paid slightly higher Card repayments for a period of time?  Wrong!  The worst that can happen is that in 3 months time there is no company there to get your money back off, they have disappeared as so many companies do and you are left as a creditor (good luck with your claim).  Worse could happen, they could max out your credit card before doing a bunk, but that is less likely.  Now if these guys are specialists in legal loopholes what makes you think that they can't find one to save their behinds and go on to open another company running exactly the same scam next month.  If it sounds too good it probably is and if they are appealing to your greed then you will probably be the one being burnt!

    So back to Mr Vader's reassurances.  They have a website - you want one I'll do you one in an afternoon!  This proves nothing.  They are registered by the ministry of justice (or something like that) - do you have any idea what the requirements are to register?  Believe me it ain't a lot!  Most of these posts are about cold calling, the trap has not been sprung yet and once it is then they will move on to trade under a different name, so you will only find posts about them scamming when it is already too late.

    So Darth (or should I call you Craig), do get back to us when you write off your debts, but I for one won't be holding my breath, I'll be trying to find a way to pay off the debts I have run up, not adding to them in my greed!

    received phone call today 16th dec 2010 asking for a payment of £199.00 for information pack reduced from £500.oo  they wanted my credit card details  not given   I asked for more details to be sent by post didnot seem to be very intersted afterwards.

    I have found that www.delete-uk.co.uk and www.consortiumreclaim.co.uk were the same company at one point and you can clearly see from the websites that they are set out the same. 0800 987 8844 you should google this number like you have the 0800 987 8240 and read about people who have given there details and have no way of getting there money back........     Hello all,

    I work for Consortium Reclaim.  I can tell you, that it is just like working at any other call centre.  They do take things very seriously indeed, each call is monitored, regardless of whether the the customer goes ahead or not.  I have seen a number of staff being sacked for inappropriate use of words, or any hint of miselling.

    For example, you cannot use the tern "No win no fee" when dealing with unenforcability of CA's, the reason is simple, the customers contractual minimum payments WILL increase, so there is a cost to the client.  However you can say it with regards to PPI claims.

    And yes they do give refunds to customers.  They are also very good at what they do, we regularly have updates on succesfull claims, but they never mention the customers name, only the member of staff it relates to (data protection reasons).  We are not permitted to write down any credit card numbers, they must (if taken) be entered onto the secure computer server system.

    For your information, the MOJ DO NOT say that a company should not take an up front fee, they simply say that the customer must be provided with the information before any payment can be taken, and that sending by email satisfied this requirement.  So i can assure you, before payment is taken the call is passed to Quality Control, they process the payment after the whole deal has been confirmed again with the customer.  In the case of UCA the customer also gets a 14 day grace period, yet another stipulation of the MOJ.

    They are also moving to a brand new office, just across the road from where they are now and are increasing staff numbers 3 fold.  Now this does not strike me as the kind of company who are not serious about what they do, or are not in this for the long term.

    I hope the above provides you with some comfort.  Put it this way, i have morals myself, and if they were in any way dodgy i would not work for them, i do not believe in conning people and would have nothing to do with that behaviour.

    I processed a UCA the other day, and i actually told the customer they could indeed do this themseleves, but as they were a very busy couple i suggested that they might want to consider letting us do it, so they could carry on their business.  I gave them a few days to talk it over and write down any questions they may have.  They decided to go ahead and i hope they will be sucessfull in their claim.  Now i know for a fact that a large percentage of my colleagues do their business in the same way, and i dont see anything wrong with that sort of practice, do you??

    Most of the people on this forum are complaining about being contacted so often, then let me assure you, all you need do is answer, let us know and we WILL remove you.  Duplicate records happen at times, this is the same for any company dealing with large ammounts of data.  It is not in the interest of any sales person to keep calling an uninterested party, that would just be counter productive, so we don't do it on purpose.  We use an automatic dialing system, and you cannot reasonably expect any sales person to remember any clients details, when they are calling hundreds of numbers daily.

    my wife got a call  from this company today  sounded really good their offer ! they wanted 50£ up front to start the claim cover their cost's for paper work they said ? call back later the wife said when she has spoke to me (hubby) tthey did call back  she questioned there attitude they hung up 2mins later they ring up again special offer £20   I think scam !!!!!!!!!!! ? but that might just be me me ?

    its not a scam i used to work for them,very handy to use if you have any credit agreement,debt or ppi.if you took out a credit card before april 07,have outstanding balances,if they ring you let them help cause it works.

    Had a phone call from this company 5 mins ago. If wanted to reclaim any money I will do it myself and not get a company like Credit Claims as they call themselves. Doesn't matter if you sign up to TPS as it never works. I signed up with them a couple of years ago & I was still getting nuisance calls.

    Worked for me. I have two credit card bills that have been 'account closed'. I'd chat to them. They have something quite spectaclur going on. They make money from the money they saved me. I know marketing calls are annoying but this one actually paid off! At any time when you enter your details online (or a coupon in a magazine in my case) you're details are 'out there'. I guess there's no avoiding it. Bit difficult to undersrtand the process but it's worth finding a fair few minutes to talk and discuss with them. KR

    I had to intervene when the very pushy agent would not take no for an answer.  I have now e-mailed this company stating they must not contact us again and for them to remove our details from their database.  I placed a delivery and read receipt request on the e-mail I sent (and I have received back the delivery and read receipts) as such any further calls and they are in breach of the Data Protection Act. If they refuse to state where they obtained your details from quote Data Protection Act and the Freedom of Information Act to them.  If they call me again, I will see how they deal with that.

    As per Kevin Rogers post we only contact customers who have asked to be contacted after completing an online or magazine/flyer survey allowing us to contact them.

    As per TPS website
    "If you are receiving unsolicited sales and marketing voice recorded messages down your telephone line, and you have not given prior consent to receive such messages, you can ask the marketer to stop sending these."

    Therefor no rules have been broken.

    We are a fully regulated company and have recently had our license renewed and have since lauched a UK wide radio campaign.

    We are not trying to scam people, if you do not wish for Consortium to contact you please request that you are removed from our database and we will not contact you again. As I have mentioned in a previous post its not in the companies best interest to keep contacting uninterested people

    I too recently got a phone call - and was told something very similar.  I eventually put the phone down.  I am going to report my call to my credit card supplier.  They  had tried to ring me on numerous occasions - we were either out or it was one of these multi dial calls and the first person to answer got the interrogation.  They haven't rung me since - but they should be stopped because I feel some people may be taken in by them - especially people with a lot of credit.

    They will charge you £495 plus 10% of your outstanding balance and then VAT on top of that.  You can request a copy of your Credit Agreement, by making a Section 77/78 request under the Consumer Credit Act 1974.  Just write it up using freely avaiable template letters, enclose £1 postal order and send it by 1st class signed for post.

    The creditor has 14 days in which to comply with such a request, if they dont they committ a domestic infringement and you can then send them an account in dispute letter.  But DO NOT stop making payments as creditors can and will destroy your credit rating file, all they cant do is take you to court if they dont have the credit agreement, but you still owe the money.  The account is regarded as unenforceable until such point as the creditor can produce a copy of the executed agreement.

    If the creditor does in fact send the credit agreement, it doesnt need to be a signed original, that comes under section 61 of the act.  It can be a reconstituted agreement but they must tell you if it is.  It also must contain the prescribed terms and the form and content must be executed correctly.  This can be very technical and i would recommend using a solicitor or company with experience of this, you can get your credit agreement checked by credit clear services for just £19.99.

    Oh and by the way credit clear services is where Consortium Reclaim send your credit agreements, so you pay through the nose for something they get done for less than £19.99 initially.  Does that sound like a fair dela fto you.
